Vodacom Dual SIM Locked Device

Terms and Conditions

NOTE:

A. These Terms and Conditions highlight the limitation of rights for both the end customer and Vodacom South Africa.

B. These Terms and Conditions highlight that a purchase or use of any of the products outlined as “network locked dual sim” devices constitutes an acceptance of these Terms and Conditions.

C. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (the "Consumer Protection Act"), no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.

1. Introduction

1.1 The Vodacom Dual SIM Network Locked Devices are applicable to all Vodacom Customers who purchase any Dual SIM Locked Device on the Vodacom Network, for a period of 12/24/30/36 months, from the date of purchase, dependant on your device plan type .

1.2 The offer is available from April 2022 until Vodacom in its sole and absolute discretion elects to discontinue these dual sim devices (the “Offer Period”).

1.3 Notwithstanding the Offer Period, Vodacom may, in its sole and absolute discretion, amend the duration of the Offer Period to a shorter or longer period, or withdraw the Offer in its entirety, without any prior notice to customer. 2. Qualifying Customers

2.1 The Offer is available to all New and Existing Vodacom Customers who purchases any Dual SIM locked device during the Offer Period:

2.1.1   All new customers who successfully activate their devices, in terms of the Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2002 as amended and any regulations thereto (“RICA”). RICA may be done at any approved Vodacom vendor or store (the “Qualifying Customers”);

2.1.3   New and existing customer who elect to purchase a qualifying dual sim network locked device.

3. The Offer

3.1 The Vodacom Dual SIM Network Locked Device offering allows customers to purchase any Dual SIM Network locked device on the network.

3.2 The device will be locked on Vodacom's network for a period of 12/24/30/36 month’s dependant on your device plan type.

3.2.1 Prepaid customers can however request an unlock code from Vodacom only after 24 months from activating a network locked device

3.3 Customers will not be charged for an unlock code, however customer need to request and unlock code from Vodacom via 082135.  

3,3. Unlocking of devices may take up-to 48 hours from the unlock code request time

3.4 An active Vodacom SIM must be inside the device at all times.

3.5 Primary sim slot will be locked on the Vodacom network and can only use active Vodacom SIMs.

3.6 Secondary sim slot can be used for other network SIMs.

Subsidised devices:

3.7 During the locking in period the Secondary sim slot can only be used as a voice SIM on 2G technology if the device is subsidised by Vodacom

3.7.1 If the device is subsidised and the Secondary sim slot has a Vodacom sim card, the device will be open to all voice and data technologies.

Unsubsidised devices:

3.7.2 During the locking in period the Secondary Sim slot on unsubsidised devices will be open to all device technologies subject to an active VODACOM sim card

3.7.3 Once a device has been unlocked, both Secondary and Primary slots will have access to both Voice and Data technology

3.8 The Secondary sim slot cannot function independent of the primary sim slot having an active Vodacom sim, therefore at all times primary sim slot should have an activated Vodacom SIM. This condition is applicable for both subsidised and unsubsidised devices

4. Terms of Use

4.1 Vodacom reserves the right, in its sole and absolute discretion, to terminate or suspend customers from using this product or the network services where Vodacom suspects abuse of its network, the service, any of its services, fraud, criminal activity or where the customer’s use of the service is placing an unreasonable constraint on the Vodacom network which may impact the experience of other Vodacom Customers.

5. RICA

5.1 In terms of RICA, customers are obliged to provide proof of your full names, surname, Identity Document number and residential address to a RICA officer when purchasing a SIM card.

5.2 Failure by any person holding/using a SIM card to comply with RICA is an offence. Contact your service provider or see https://www.vodacom.co.za/vodacom/terms/terms-and-conditions for details.

6. Cancellation

6.1 Customers may cancel their service contract by contacting the Vodacom call centres during the 24/30/36 month’s contract period.

6.1.1 However, post the cancellation of a service contract, customers can only request a unlock code only after month 24/30/36  of the activation of the device on the Vodacom network

6.2 Customers are bound to the cancellation provisions contained in their Vodacom Customer Contract Terms and Conditions, which includes, but is not limited to, cancellations not being requested prior to completion of the contractual period https://www.vodacom.co.za/vodacom/terms/contract-terms-and-conditions

7. Modification of Terms and Conditions

7.1 Vodacom reserves the right, to change, vary, amend or replace these Terms and Conditions and any rules relating to this offer at any time as required by law,

7.2 Vodacom reserves the right, at any time as required by laws and regulations, to change the products and services and/ or modify, without any notice.

Any changes to rules and/or Terms and Conditions are effective from the date that they are published on the abovementioned website or elsewhere in any media.

7.4 Vodacom reserves the right at any time to amend, suspend or discontinue the services, with notice, without liability to you or any third party.

7.5 in the event where Vodacom  puts in places any of the actions in clause 8.3 Vodacom will under no circumstance be liable to you for any error, delay, failure or non-availability of the service.

7.6 By participation in the Offer, you indemnify Vodacom against any damage or loss you may sustain as a result of possession and/or use of the SIM card, Vodacom network services, or any error, delay, failure or non-availability of the service. 8. Limitation of Liability

8.1 Subject to the provisions of the Consumer Protection Act, to the extent allowed by any other applicable law and also subject to clauses 9.1 and 9.2 below, Vodacom will not be liable to you or to any other person for any loss or damage suffered (whether it is direct or indirect)

9. General

9.1 Vodacom is not responsible for a service being interrupted and/or failing for any reason or for any interruption in the network services.

9.2 You will be able to access services only when you are in the Republic of South Africa.
