Terms and Conditions

Vodacom Payment Services (Pty) Ltd (“VPS”) is running the “ VodaPay Kwika Birthday Prepaid Promotion ("the Promotion") where the Qualifying Merchants will pay zero Transaction Fees for 3 months under the Merchant Agreement, on the Terms and Conditions below (“Reward”).
All participants during the term of the Promotion agree to be bound by the following Terms and Conditions:

Duration

1. The Promotion will commence on the 7 August 2024, and it will run until the30 September 2024 (the “Promotion Period”).
2. The duration of the Promotion may be extended or curtailed at the discretion of VPS.
3. VPS reserves the right to amend these Terms and Conditions and where such change is material, VPS shall provide its customers and/or participants with reasonable prior written notice before implementing any such change.

Eligibility

4. To qualify to participate in the Promotion:
5. During the Promotion Period, the registered business is: (i) a new VPS merchant (and does not have an existing Merchant Agreement with VPS); (ii) signs a new Merchant Agreement; (iii) successfully completes the Merchant onboarding process; (iv) is formally approved as a Merchant to process transactions (“Activation Date”); and (v) has been active as a VPS merchant for a minimum of 7 Business Days from the Activation Date ;
6. Purchase a Kwika Device for R799 during the Promotion Period.

(“Qualifying Merchants”)

5. Employees, directors and agents of VPS and all participating stores, their immediate families, life partners, business partners and associates and any person directly involved with the sponsoring, devising, production, management, or marketing of this Promotion are not eligible to participate in this Promotion.

Reward

6. Qualifying Merchants will receive the following Reward, which will be applicable after 7 Business Days from Activation Date (“Reward Activation Date”):
7. for a period of 3 months from the Reward Activation Date (“Reward Period”) be charged zero Transactions Fees (as defined in the Merchant Agreement) for all transactions processed on the Kwika Device up to a cumulative, maximum amount of R20,000.00 (“Maximum Amount”) or until the expiry of the Reward Period, whichever comes
8. Transactions conducted prior to the Reward Activation Date will incur charges at the normal rate applicable to the relevant Merchant as per the Merchant Agreement (“Merchant Rate”).
9. Upon expiry of the Reward Period, or upon reaching the Maximum Amount, whichever is earliest, VPS will reinstate normal Merchant Rate pricing in line with clause 10 of the Merchant
10. If the Transaction Fees are billed to the Merchant after the Reward Activation Date, VPS will refund the Merchant such Transaction Fees, within 28 Business Days from the Reward Activation Date.

Personal Information

11. Vodacom respects the right to privacy and takes the protection of your personal information seriously. Vodacom will only use your personal information for the purposes of the Promotion as stated in these terms and conditions and in accordance with Vodacom’s Privacy Policy available on, http://www.vodacom.co.za/vodacom/terms/privacy-policy.
12. You hereby consent to Vodacom share your personal information with third parties identified by Vodacom from time to time solely for the purpose of execution of the Promotion.

General

13. In the event of a dispute in regard to any aspect of the Promotion and/or these Terms and Conditions, VPS’s decision will be final, and binding and no correspondence will be entered into.
14. VPS may refuse to award a Reward if any of entry procedures or these Terms and Conditions have not been adhered to if it detects any irregularities or fraudulent practices. VPS is entitled to in its entire discretion to reject any participant for any reason and will not be obliged to notify participants that they are rejected.
15. VPS is not liable for any technical failures affecting participation.
16. VPS shall not be liable for any costs incurred by the Qualifying Merchant for participating in the Promotion.
17. VPS, its directors, employees, agents, and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any Reward nor in respect of any warranties, guarantees or undertakings given by any person other than VPS.
18. If VPS is required by law to alter or cancel any aspect of the Promotion or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Promotion being offered, with immediate effect and without notice. In such event all entrants hereby waive any rights which they may have against VPS and its associated companies, agents, contractors and/or sponsor.
19. Neither VPS nor any other person or party associated with the Promotion, their associated companies, agents, contractors, and sponsors and any of its personnel involved in the Promotion shall be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Promotion or from claiming the Reward.
20. In addition, neither VPS nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating and/or the Reward process of the Promotion.
21. All information relating to the Promotion which is published on any marketing material will form part of these terms and conditions. In the event of any conflict between such marketing material and these terms and conditions, these terms and conditions shall prevail.
22. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations, as the case may be, created for either the participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (CPA).
