Terms and Conditions

  1. The 6 month once-off data bundles (the "Bundles") are available to Prepaid, Hybrid and Postpaid customers.
  2. You may purchase these Bundles through any of the following self-service channels:

  1. You may purchase multiple Bundles at any given time.
  2. All pricing of bundles is inclusive of VAT.
  3. The balance of your Bundles will be depleted for the volume of data sent and received, and not the time you spend connected.
  4. The Bundles are valid for a period of up to 6 months (180 days) from the date that you made the purchase (the "Validity Period").
  5.  You can extend the Validity Period of the Bundles you initially purchased (the "Initial Bundles") by purchasing additional Bundles of the same size and validity (the "Additional Bundles") before the Initial Bundle has expired. The purchase of the Additional Bundles will result in the Validity Period being extended and calculated for the date that you purchased the Additional Bundles.  
  6.  If your Bundle is depleted and there is no other applicable data bundle remaining, all data usage will be stopped by default, or you will only be able to use data at out of bundle rates if you have opted in to current out-of-bundle data charges.
  7. If a Bundle reaches the Validity Date and expires before the Bundle is depleted, data usage will continue at the Out of Bundle rate, applicable to the tariff.
  8. Data transfer rules will apply, whereby you have the ability to transfer the bundle to other Vodacom customers. Please visit the data transfer terms and conditions for full details:

  9. If you have bought more than one Bundle, the Initial Bundle will be depleted first.
  10. These Bundles do not apply to data roaming.
  11. Vodacom will at all times allocate to you the Bundles that you have paid for and shall not pro-rate or make deductions on such Bundles.
  12. You can view the balance of your Bundles on the following channels:
  • USSD (*135);
  • Online (MyVodacom App & Portal);
  • Customer Care (082 135).

General

  1. Vodacom reserves the right to suspend the Service in the event of suspected abuse or fraudulent usage, outside of what is considered reasonable for private, non-commercial use.
  2. Vodacom reserves the right to limit the Service in regions or areas where there is limited network capacity (high congestion) in order to maintain consistent quality of service. 
  3. Vodacom reserves the right to alter or terminate the Service in order to prevent a catastrophic impact on the network. 
  4. While Vodacom will use its reasonable endeavours to provide the Service, it does not commit to the uninterrupted supply of the Service, due to potential capacity limitations on the network. 
  5. Vodacom reserves the right to suspend, cancel or convert the Service with reasonable notice. 
  6. Vodacom reserves the right to change and/ or expand on these terms and conditions and will provide reasonable notice of any material changes prior to such change as and when the circumstances permit.

Terms and Conditions

Vodacom (Pty) Ltd (“Vodacom”) is running the # Dataasseblief for various soccer matches or during the soccer season   (the “Competition”) on Vodacom’s official social media platforms.  

These are the Standard Competition Terms and Conditions that apply to the Competition and comprise Part A (which contains the Competition-specific information) and Part B (which contains general terms and conditions that apply to all competitions). In the event of any conflict, the terms and conditions of Part B prevail.

By entering and/or participating in this Competition, entrants/participants opt into, agree, and consent to be bound by the Terms and Conditions (comprising Part A and Part B) stated below.

Part A: Competition-Specific Terms and Conditions

Competition Duration

  1. The Competition period/duration is from:
    • Start date: 09h00, 1 August 2023
    • End date: 23h59, 31 May 2024

Competition Prize/s

  1. The Competition Prize(s) are stipulated for each competition on the social media post.
    • Total number of Prizes will be stipulated for each competition on the social media post.
    • Value of the Prize (per Prize) will be stipulated for each competition on the social media post.
    • Prize exclusions: n/a

Eligibility

  1. The Competition is open to anyone who entered via Vodacom social media platforms, by posting your correct answer to the specific competition question as well as #Dataasseblief on the social media post, or other stipulated requirements for entry as specified for the Competition.
  2. You are required to follow or be a follower of @Vodacomsoccer and / or @Vodacom.
  3. Participants are allowed to enter multiple times.

Prize Delivery

  1. The delivery of the prizes, will be dependent on the nature and / or type of prize(s) that is being offered per competition.
  2. If no specific delivery/collection method is stipulated, the general provisions of Part B, in clauses 31 to 42 below, will apply.

Part B: General Competition Terms and Conditions

In addition to the Specific Competition Terms and Conditions outlined in Part A above, the following General Terms and Conditions apply to the Competition.

Duration

  1. The duration of the Competition (as stipulated in Part A above) may be extended, curtailed or cancelled at the discretion of Vodacom.

Prize

  1. Vodacom has the right to change the type and quantity of prize/s (described in Part A above) or to substitute it at their discretion, and Vodacom has the right to determine the value of the Prize/s.

Eligibility

  1. Only entries received during the Competition period (as stipulated in clause 1 in Part A above) will qualify as potential winners.
  2. The Competition is only open to natural persons. Entries received from business accounts held by legal persons (amongst other Corporates and SMEs, etc.) are excluded and disqualified from participating and winning in the Competition.
  3. Any entrant/participant under the age of 18 shall present their parent/guardian’s written consent to enter the Competition at Vodacom’s request.
  4. Only entrants/participants who are using SIM cards that have been RICA registered are eligible to win the Competition. Each owner of a SIM card(s) is responsible for complying with South African law by RICA registering their SIM cards.
  5. Unless otherwise stipulated, employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates, and any person directly involved with the sponsoring, devising, production, management, or marketing of this Competition are not eligible to participate in this Competition.
  6. Entrants/participants must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid for the Competition duration.
  7. Entrants/participants are only eligible if they have not won a Vodacom competition during 6 (six) months preceding this Competition. The 6 (six) months calculation will start from the date that Vodacom fulfilled the Prize in the preceding Competition.
  8. In the event that the user of the mobile phone (i.e., the entrant/participant in the Competition) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the Prize will be awarded to the person that is responsible for payment of the participating mobile phone account/ charges.
  9. Vodacom customers who are not in good standing with Vodacom, or are involved in any legal process with Vodacom, or are in arrears with their accounts are not eligible for this Competition.

Valid Entry

  1. A Valid Entry must comply with the stipulated Competition requirements, including following the stated prompts (including on social media or other platforms) or completing the required entry forms.
  2. Qualifying entrants/participants must complete all the required information on the Competition entry form or platform, which can be found via Vodacom’s various social media platforms during the period of this Competition.
  3. Responses directly or via direct messages on any social media platform will not be considered valid entries.
  4. Only correct answers or a correct sequence of answers will be accepted and eligible to be selected as a winner at Vodacom’s discretion.
  5. Unless otherwise stipulated in or required by the entry requirements, there are no additional charges for participating in the Competition. In respect of online entries, standard data costs may apply to uploading a valid entry online, as may be applicable. Standard data costs apply as per the user’s Service Provider and existing price plan for data usage and are subject to the applicable Terms and Conditions of that service.
  6. Vodacom shall not be liable for any costs incurred by the winners for entering the Competition or claiming any prizes. 
  7. Data transfer speeds are not guaranteed and are dependent on network availability and utilisation.
  8. Vodacom (or its Agent) retains the right to determine, at its sole discretion, if entrants/participants meet the stipulated eligibility criteria, criteria for a valid entry, competition requirements, and are eligible to win a prize based on the Competition requirements.

Prize Draw

  1. The winners of the Prize will be randomly selected from all eligible entries who meet all the requirements set out in these Terms and Conditions, and will be selected at Vodacom’s discretion.
  2. The verified winners will be notified within (2) two days after he/she has been selected and verified as a winner / within one (1) hour after being selected and verified as a winner.

Winner Validation

  1. All the information provided or related to this Competition shall be managed, captured, and approved by Vodacom.
  2. Vodacom will share personal details of the respective winners, such as name and contact number, with a Vodacom-approved third-party agency, Openfield Marketing, who will notify the respective winners that they have won in the Competition, and by participating in the Competition, entrants/participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
  3. Vodacom and Openfield Marketing will use reasonable efforts to contact the winners via direct messaging on their social media profile, email, or telephonically as may be applicable on the contact details provided by the entrants/participants to participate in the Competition.
  4. Vodacom and Openfield Marketing shall attempt to contact the winners for a period of 2 (two) normal working weekdays after their names have been drawn and verified as winners. The winners will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winners will be advised of arrangements in respect of Prizes at the time of contacting the selected winners.
  5. Should an entrant/participant not be available on the contact details provided during the timeframe stipulated above or rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived, and the Prize will be forfeited. Vodacom reserves the right to then award the Prize to the next randomly drawn entrant/participant.
  6. The claim for any Prize will be subject to security and validation, and Vodacom reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winners must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants/participants to the Competition and have to comply with the required validation procedure, determined by Vodacom, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
  7. Notwithstanding the fact that the Prizes vest in the winners immediately upon the determination of the results, in the event that the required documentation from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winners to make special arrangements to meet the deadline set by Vodacom, such Prize will be forfeited. Vodacom then reserves the right to award the Prize to the finalist that is next in line.
  8. The winners’ name and location may be displayed on www.vodacom.co.za/competition_winners after a period of 2 (two) working days subsequent.
  9. Vodacom shall request the winner’s/winners (as may be applicable) consent in writing to their image and/or likeness being used and published by Vodacom in connection with the Competition for a period of 12 (twelve) months after they have been announced as the winner. The winner may decline the use of their image and/or likeness by Vodacom.

Prize Delivery

  1. The following general conditions apply to the delivery of Prizes, unless otherwise indicated in Part A above.
  2. Vodacom and/or its Agent will determine the mode of Prize delivery at its discretion.
  3. In the event of a Prize requiring physical delivery - delivery will take place via courier at dates, times and places agreed to between Openfield and the winner(s). The winner must provide a correct address for delivery. Delivery may only be possible during weekdays (Monday – Friday) between 09h00 – 17h00, and not on Saturdays, Sundays, and public holidays. If the winner is not home for courier or delivery, or the address cannot be found, the winner will be offered one more opportunity to provide an accessible address for delivery and to be available for such delivery; if delivery is still not possible, the Prize will be forfeited.
  4. In the event of a Prize requiring physical collection – Vodacom or Openfield Marketing will communicate the address and location where and hours when the Prize can be collected by the winner(s). Neither Vodacom nor Openfield shall be held liable should the winner(s) be unable to collect the Prize. Prize/s must be collected by the winner/s within 10 (ten) working/business days from the announcement and notification of the winners, failing which the Prize will be forfeited.
  5. In the event that a Prize can be sent electronically via email, a valid email address must be provided by the winner. If Vodacom or Openfield has sent the email containing the electronic Prize to the email address provided, delivery thereof will be deemed to have taken place. Neither Vodacom nor Openfield will be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.
  6. In the event of data and/or airtime Prizes, all data Prizes will be allocated to the winners within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the Vodacom MSISDN (cell phone number) that the data and/or airtime must be transferred to.
  7. In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification.
  8. In the event of a Prize being an award on the VodaPay App, the winner must download the App and register on the App. Vodacom can only transfer money into the VodaPay wallet if the the winner has downloaded the App and registered on it. The cash Prize will be transferred into the winner’s VodaPay wallet within seven (7) working days after confirmation by the winner of their VodaPay details. Should the winner fail to meet the criteria for a period of ten (10) working days, the Prize will be forfeited.
  9. Should Vodacom or Openfield not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited.
  10. In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Vodacom will share personal details of the respective winners, such as name and surname, and contact number, with a Vodacom-approved third agency, Openfield Marketing, for distribution of the Prize items, and by participating in the Competition, entrants/participants agree to such disclosure as is necessary to effect Prize fulfilment.
  11. If a winner cannot accept a Prize for any reason whatsoever, or if Vodacom or Openfield are unable to deliver the Prize (including for the reasons mentioned above), the Prize will be awarded to the next selected entrant.
  12. All risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Vodacom’s obligations regarding the Competition and Prizes shall terminate.

Prizes are not transferable

  1. No Prize is transferable or exchangeable and may not be redeemed by, transferred, or given to another person.
  2. No Prize can be redeemed for cash and may not be sold.
  3. Vodacom will not transfer, allocate, or assign a Prize to someone else if requested by the winner.

Personal information and permission to receive marketing and promotional information

  1. User data collected via the Competition will not be used for any other purpose than for the execution of the Competition and/or for the sharing of related marketing and promotional information.
  2. User data collected via entry for this Competition will be stored for as long as it is legally required to and in accordance with Vodacom’s Privacy Policy, http://www.vodacom.co.za/vodacom/terms/privacy-policy.
  3. By entering this Competition, entrants/participants give Vodacom permission to send them marketing or promotional information about Vodacom products, services and other Competitions, and consent to their name, contact number, and/or email address being shared with official Partner/s in the campaign to which the Competition relates, for marketing or promotional purposes.
  4. The entrant(s) will be given the option to opt out of receiving marketing or promotional information via the platform from which they receive such information.

General

  1. Vodacom may be bound by specific event-related rules and regulations that are determined by relevant governing bodies. These rules will be communicated to the competition entrant/participant and with which the competition entrant/participant agrees to comply.
  2. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant/participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
  3. The decision of the judges (who decide the winners, as appointed by Vodacom at its sole discretion) on any aspect of the Competition, including the allocation of the Prizes, will be final and binding and no correspondence will be entered into.
  4. In the event of a dispute in regard to any aspect of the Competition and/or the Terms and Conditions, Vodacom’s decision will be final, and binding, and no correspondence will be entered into.
  5. Vodacom may, at its discretion, refuse to award a Prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
  6. Vodacom (or its Agent) is entitled in its entire discretion to disqualify any entrant/participant for any reason and will not be obliged to notify entrants/participants of such disqualification.
  7. Vodacom and/or any other person or party associated with the Competition, their associated companies, partners, agents, contractors and sponsors and any of its personnel involved in the Competition shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition or from claiming the Prize.
  8. Vodacom is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.
  9. Vodacom cannot and will not be held liable should it be impossible for it to deliver the Prize or to fully perform, execute or fulfil the Prize. Should the Prize be linked to a specific fixture, match or event, and should that specific fixture, match or event be cancelled, interrupted, postponed, or otherwise affected by events or factors outside of Vodacom’s control, Vodacom cannot be held liable for the fulfilment of the Prize or be required to provide an equivalent or replacement Prize.
  10. Vodacom, its directors, employees, agents and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.
  11. If Vodacom is required by law to alter or cancel any aspect of the Competition or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Competition being offered, with immediate effect and without notice. In such event, all entrants/participants waive any rights they may have against Vodacom and its associated companies, agents, contractors, official Partners and/or sponsors.
  12. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

Terms and Conditions

1. GENERAL

  1. Pepkor Personalised Bundles is a consumer product and may only be used by an end-user (that is a natural person) to make calls, use data or send SMS messages to another end-user (that is a natural person), with the intention to facilitate a personal communication between such end-users.
  2. Pepkor Personalised Bundles may not be used for commercial purposes or as part of any bulk SMS sending service. Any use of this offer outside of what is considered reasonable for private, non-commercial use, and in instances through mechanisms and means not intended for personal use or the anticipated purpose of the offer, will be considered as abuse.
  3. Vodacom reserves the right to suspend the service in the event of suspected abuse where non-compliant devices as specified by the regulating body ICASA are being used on the Vodacom network.
  4. Pepkor Personalised bundles are available to Pepkor customers only who have purchased a SIM card from a Pepkor store . Enterprise customers and M2M contracts are specifically excluded from purchasing Pepkor Personalised bundles.
  5. Customers can purchase Pepkor Personalised bundles at any time by dialling *130*7371#.
  6. Customers may purchase multiple Pepkor personalised bundles at a time.
  7. Vodacom reserves the right to vary offers as deemed necessary.
  8. Bundles with the shortest validity / earliest expiry may deplete first. If you have bought more than one Bundle, the Initial Bundle will be depleted first
  9. All Pepkor personalised bundles are subject to the validity of the offer/bundle purchased, as specified at the time of purchase. Validity refers to the period of time the bundle will be active for and available to be used. If a Bundle reaches the Expiry Date and expires before the Bundle is depleted, data usage will continue at the Out of Bundle rate, applicable to the tariff.
  10. To check your Vodacom Bundle Balance dial *135# and select Balances.
  11. Vodacom reserves the right to amend these Terms and Conditions and where such change is material, Vodacom will provide you with reasonable prior written notice before implementing any such change.

Prepaid Customers

  1. Purchase of bundles/offers will be from your airtime balance. If you have insufficient balance you will not be able to purchase an offer.
  2. Customers who recharge with R12 or more will continue to receive the Night Shift recharge advancement for 7 days. (Customers will not receive the Night Shift SMS notifying them of advancement)
  3. Vodacom4Less customers will not receive V4L discounts while they are using a Just4You voice bundle. C2 General

Top Up & uChoose customers

  1. Purchase of bundles/offers will be from your airtime balance or subscription airtime allocation. If you have insufficient airtime the purchase will not be successful.
  2. uChoose Smart customers will have to recharge before they can purchase offers.

Migrations

  1. Prepaid & Top Up customers converting to Contract or vice versa will lose their allocated Integrated bundles.
  2. Prepaid customers converting to Top Up or vice versa will keep their allocated Integrated bundles.

2. VOICE OFFERS

  1. Product validity is as specified per bundle/offer, and there will be no carry-over of minutes beyond the expiry. There is no carry-over of unused bundles after expiry.
  2. If the bundle is depleted before expiry, calls will deplete from other available voice bundles and then from airtime.
  3. If a voice bundle runs out while on a call the rest of the call will be billed at the applicable rate.

3.1 Vodacom to Vodacom (on-net voice) Voice Bundles

  1. On-net voice bundles can be used for Vodacom to Vodacom calls only, and will deplete per minute.
  2. The following are qualifying and non-qualifying Call Types for On-net bundles:

3.2 Any-network Voice Bundles

  1. Any-network voice bundles can be used for Vodacom to Vodacom calls as well as calls to other South African networks, and will deplete per minute.

3. DATA OFFERS

  1. You will be charged for the volume of data sent and received, and not the time spent connected.
  2. Data speeds are not guaranteed and are dependent on network availability.
  3. Bundles and tariffs only apply to standard APNs.
  4. Data bundles do not apply to data roaming.
  5. Transfer of Pepkor Personalised data bundles to another applicable Vodacom number is possible. For more information please visit www.vodacom.co.za/vodacom/terms/data-bundle-transfer-terms-and-conditions
  6. Customers can extend the validity of their data bundle by purchasing another bundle of the same validity and size before the initial bundle has expired. This will extend the validity of the initial bundle to that of the second bundle purchased. C2 General
  7. Once an Pepkor Personalised data bundle has been depleted, data usage will stop unless the customer has another data bundle or has opted in to accept out of bundle charges. If a data bundle expires before the allocation is depleted, data usage will continue at 49c/MB.
  8. Data bundles will be utilised in the order they were purchased. Please note that in the instance when shorter validity bundles are bought after longer validity data bundles, Vodacom may allow these bundles to be depleted first, depending on which bundle expires first.

Vodacom (Pty) Ltd (“Vodacom”) is running the Kids Takeover Rugby Competition for the Vodacom Bulls vs Glasgow Warrior rugby match to be held at Loftus Versfeld, Pretoria on 11 May 2024 (the “Competition”) on Vodacom’s official social media and digital platforms and any third-party partner social media and digital platforms.

These are the Standard Competition Terms and Conditions that apply to the Competition and comprise Part A (which contains the Competition-specific information and terms and conditions) and Part B (which contains general terms and conditions that apply to all competitions). In the event of any conflict, the terms and conditions of Part B prevail.

All Competition participants agree to be bound by the following Terms and Conditions (comprising Part A and Part B).

Part A: Competition-Specific Terms and Conditions

Competition Duration

  1. The Competition period/duration is from:
    • Start date: 09h00, Monday, 15 April 2024
    • End date: 23h59, Sunday, 5 May 2024

Competition Prize/s

  1. The Competition Prize is: 1 (one) spot for Vodacom customers to have their child run out with the Vodacom Bulls team onto the field for the match – as a ‘Child Mascot’ as well as assist with the official coin toss prior to the match as well as handover the Vodacom Man of the Match post-match.
    • Total number of Prizes: 1 (one) run out spot for the match. One spot can be won by one entrant/customer. The child mascot will also be assisting with the coin toss prior to the match as well as handing over the medal to the Vodacom Man of the Match post-match.
    • Value of the Prize(s) (per Prize): approximately R 1000 (one thousand rand) (non-exchangeable or refundable as the prize relates to the experience that can be won)
    • Inclusions: 4 (four) stand tickets, 1 (one) T-shirt, 1 (one) white short and a pair of socks, will be provided to each winning customer/their child who runs out with the team.
    • Prize exclusions: All travel related to attending this event. Any expenses of a personal nature related to attending this event. Tekkies / sneakers for the child to run in.

Eligibility

  1. The Competition is open to Vodacom customers on a contract, who have been a customer with Vodacom for a tenure of over 24 (twenty-four) months, uninterrupted.
  2. The Competition is only open to Vodacom customers who have entered via Vodacom and other third-party social media and digital platforms and completed the competition form.
  3. The age of children who can win an opportunity to participate in the Child Kids Takeover Rugby Competition is restricted to the ages between six (6) and thirteen (13) years old. Vodacom reserves the right to ask for the birth certificates of the winning child and the parent or legal guardians’ identification (or confirmation of the parent/guardian – child relationship) for verification purposes.

Child Mascot Specific Terms and Conditions

  1. By entering this Competition, the Vodacom customer entering and participating in this Competition (as the parent or legal guardian of a potential participating Child Mascot) accepts the terms and conditions of this Competition and accepts the application of such terms and conditions to their child who they wish to enter to participate as a Child Mascot.
  2. By accepting the Prize, and by virtue of the nature of the Prize, the parent or legal guardian agrees (on behalf of their child) that the image of the child will be displayed on multiple media, social and digital platforms in relation to the event and that there will be no compensation related to the child and/or parent / legal guardian for the usage of the image of the child.
  3. The child and his/her parent or legal guardian will be required to meet at a specific time and venue on 11 May 2024. All details will be provided by Vodacom. Should the child and his/her parent or legal guardian not be able to be at the stadium at this time, the Prize will be forfeited.
  4. The child will run out with the HollywoodBets Sharks team onto the field as a Child Mascot and will accompany and run out with the captain, by holding the captains’ hand. By entering this Competition, the Vodacom customer accepts and consents to all activities and requirements reasonably necessary for the Child Mascot to run out with a team, as well as the coin toss and hand over of the Man of the Match medal.
  5. Vodacom or its Agent retains the discretion to decide with which of the participating teams the Child Mascot will run out with, and their decision is final. If the parent or legal guardian does not agree with that decision, the prize will be forfeited.
  6. Vodacom or its Agent will communicate all other practical requirements applicable to the day of the event to the parents or legal guardian (e.g., collection of the child after the run out), which the parents or legal guardian agree to follow by accepting these terms and conditions.
  7. The child will be provided with a shirt, shorts, and a pair of socks, that he /she is required to wear during the run out. The parents or legal guardian must supply the child with tekkies / sneakers for the child to run out in.
  8. The parent or legal guardian that accompany the child will be required to sign a Vodacom indemnity form prior to the event taking place. Should the parent or legal guardian fail to provide Vodacom with a signed indemnity form, the Prize will be forfeited. The Vodacom indemnity form shall be provided 3 (three) days prior to the event.
  9. By entering this Competition, and/or by signing the required indemnity form, the Vodacom Customer/entrant warrants their authority to sign any such indemnity and warrants that he/she is the parent or legal guardian of the child.
  10. Vodacom, or its Agents, retains the sole discretion - should there be any reason whatsoever that the child cannot or should not run out with the participating teams - to not let the child run out with the team (for example, due to any misbehaviour or anxiety or if it is deemed not to be in the child’s best interest). Vodacom or its Agent will not be liable for any replacement prize in this event.
  11. Vodacom are bound by all rules and regulations that are determined by SA Rugby, United Rugby Championship, Vodacom Bulls and Glasgow Warrior related to this fixture. These rules will apply to all the child, parent, legal guardian or other chaperones/attendees (attending with the child and his/her parent or legal guardian who will be attending which will be communicated by Vodacom to the parties.

Valid Entry

  1. The Competition is only open to Vodacom customers who have entered via Vodacom and other third-party social media and digital platforms and completed the competition form.
  2. Qualifying entrants must complete all the required information on the Competition entry form, which can be found via Vodacom’s various social media platforms during the period this Competition is running.
  3. Responses directly or via direct messages on any of the social media platforms will not be considered as a valid entry.
  4. Only correct answers or sequence of answers will be accepted.
  5. Participants are allowed to enter only once.

Prize draw

  1. The winners of the Prize will be randomly selected from all eligible entries who meet all the requirements set out in these Terms and Conditions.
  2. The verified winners will be notified within (2) two days after he/she has been selected.

Prize Delivery

If no specific delivery methods are stipulated, the general provisions of Part B, in clauses 23 to 34 below, will apply.

Part B: General Competition Terms and Conditions

In addition to the Specific Competition Terms and Conditions outlined in Part A above, the following General Terms and Conditions apply to the Competition.

Duration

  1. The duration of the Competition (as stipulated in Part A above) may be extended or curtailed at the discretion of Vodacom.

Prize

  1. Vodacom has the right to change the type and quantity of prize/s (described in Part A above) or to substitute it at their discretion, and Vodacom has the right to determine the value of the Prize/s.

Eligibility

  1. Only entries received during the Competition period (as stipulated in clause 1 in Part A above) above will qualify as potential winners.
  2. The Competition is only open to natural persons. Entries received from business accounts held by legal persons (amongst other Corporates and SMEs, etc.) are excluded from participating and winning in the Competition.
  3. Any participant under the age of 18 shall present their parent/guardian’s written consent to enter the Competition at Vodacom’s request.
  4. Only entrants who are using SIM cards that have been RICA registered are eligible to win the Competition. Each owner of a SIM card(s) is responsible for complying with South African law by RICA registering their SIM cards.
  5. Unless otherwise stipulated in Part A, employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates, and any person directly involved with the sponsoring, devising, production, management, or marketing of this Competition are not eligible to participate in this Competition.
  6. Participants must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid for the Competition duration.
  7. Participants are only eligible if they have not won a Vodacom competition during 6 (six) months preceding this Competition. The 6 (six) months calculation will start from the date that Vodacom fulfilled the Prize in the preceding Competition.
  8. In the event that the user of the mobile phone (i.e., the participant in the Competition) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the Prize will be awarded to the person that is responsible for payment of the participating mobile phone account/ charges.

Valid Entry

  1. Unless otherwise stipulated in or required by the entry requirements in Part A, there are no additional charges for participating in the Competition. In respect of online entries, standard data costs may apply to uploading a valid entry online, as may be applicable. Standard data costs apply as per the user’s Service Provider and existing price plan for data usage and are subject to the applicable Terms and Conditions of that service.
  2. Vodacom shall not be liable for any costs incurred by the winners for entering the Competition or claiming any prizes. 
  3. Data transfer speeds are not guaranteed and are dependent on network availability and utilisation.

Winner Validation

  1. All the information provided or related to this Competition shall be managed, captured, and approved by Vodacom.
  2. Vodacom will share personal details of the respective winners, such as name and contact number, with a Vodacom-approved third-party agency, Openfield Marketing, who will notify the respective winners that they have won in the Competition, and by participating in the Competition, participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
  3. Vodacom and Openfield Marketing will use reasonable efforts to contact the winners via direct messaging on their social media profile, email, or telephonically as may be applicable on the contact details provided by the participants to participate in the Competition.
  4. Vodacom and Openfield Marketing shall attempt to contact the winners for a period of 2 (two) normal working weekdays after their names have been drawn and verified as winners. The winners will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winners will be advised of arrangements in respect of Prizes at the time of contacting the selected winners.
  5. Should a participant not be available on the contact details provided during the timeframe stipulated above or rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived, and the Prize will be forfeited. Vodacom reserves the right to then award the Prize to the next randomly drawn participant.
  6. The claim for any Prize will be subject to security and validation, and Vodacom reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winners must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants to the Competition and have to comply with the required validation procedure, determined by Vodacom, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
  7. Notwithstanding the fact that the Prizes vest in the winners immediately upon the determination of the results, in the event that the required documentation from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winners to make special arrangements to meet the deadline set by Vodacom, such Prize will be forfeited. Vodacom then reserves the right to award the Prize to the finalist that is next in line.
  8. The winners’ name and location may be displayed on www.vodacom.co.za/competition_winners after a period of 2 (two) working days subsequent.
  9. Vodacom shall request the winner’s/winners (as may be applicable) consent in writing to any further use of his/her image and/or likeness or the image and likeness of their child being used and published by Vodacom in connection with the Competition (other than and in addition to what is contemplated in Part A, clause 7 above) for a period of 12 (twelve) months after he/she has been announced as the winner. The winner may decline the use of his/her image and/or likeness by Vodacom.

Prize Delivery

  1. The following general conditions apply to the delivery of Prizes, unless otherwise indicated in Part A above.
  2. Vodacom and/or its Agent will determine the mode of Prize delivery at its discretion.
  3. In the event of a Prize requiring physical delivery - delivery will take place via courier at dates, times and places agreed to between Openfield and the winner(s). The winner must provide a correct address for delivery. Delivery may only be possible during weekdays (Monday – Friday) between 09h00 – 17h00, and not on Saturdays, Sundays, and public holidays. If the winner is not home for courier or delivery, or the address cannot be found, the winner will be offered one more opportunity to provide an accessible address for delivery and to be available for such delivery; if delivery is still not possible, the Prize will be forfeited.
  4. In the event of a Prize requiring physical collection – Vodacom or Openfield Marketing will communicate the address and location where and hours when the Prize can be collected by the winner(s). Neither Vodacom nor Openfield shall be held liable should the winner(s) be unable to collect the Prize. Prize/s must be collected by the winner/s within 10 (ten) working/business days from the announcement and notification of the winners, failing which the Prize will be forfeited.
  5. In the event that a Prize can be sent electronically via email, a valid email address must be provided by the winner. If Vodacom or Openfield has sent the email containing the electronic Prize to the email address provided, delivery thereof will be deemed to have taken place. Neither Vodacom nor Openfield will be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.
  6. In the event of data Prizes, all data Prizes will be allocated to the winners within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the Vodacom MSISDN (cell phone number) that the data must be transferred to.
  7. In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification.
  8. In the event of a Prize being an award on the VodaPay App, the winner must download the App and register on the App. Vodacom can only transfer money into the VodaPay wallet if the the winner has downloaded the App and registered on it. The cash Prize will be transferred into the winner’s VodaPay wallet within seven (7) working days after confirmation by the winner of their VodaPay details. Should the winner fail to meet the criteria for a period of ten (10) working days, the Prize will be forfeited.
  9. Should Vodacom or Openfield not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited.
  10. In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Vodacom will share personal details of the respective winners, such as name and surname, and contact number, with a Vodacom-approved third agency, Openfield Marketing, for distribution of the Prize items, and by participating in the Competition, participants agree to such disclosure as is necessary to effect Prize fulfilment.
  11. If a winner cannot accept a Prize for any reason whatsoever, or if Vodacom or Openfield are unable to deliver the Prize (including for the reasons mentioned above), the Prize will be awarded to the next selected entrant.
  12. All risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Vodacom’s obligations regarding the Competition and Prizes shall terminate.

Prizes are not transferable and right of admission is reserved

  1. No Prize is transferable or exchangeable and may not be redeemed by, transferred, or given to another person.
  2. No Prize can be redeemed for cash and may not be sold.
  3. Vodacom will not transfer, allocate, or assign a Prize to someone else if requested by the winner.
  4. Where a Prize is for a Vodacom event(s) and / or experience(s):
    • it is restricted to the winner(s) of the Prize only - no additional guests will be allowed to enter or have access to the event(s) and / or experience(s), unless specifically stated otherwise;
    • Right of Admission to the event(s) and experience(s) is reserved by Vodacom;
    • Vodacom reserves the right to have a winner (and their partner and / or guest) removed from an event at any time should the behaviour or language of such winner or guest, at the discretion of Vodacom, be considered to constitute harassment or be inappropriate, including behaviour or language that is discriminatory or hateful on grounds such as race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth; and
    • Vodacom reserves the right to remove any winners (and their partner and / or guest) from an event at any time should their behaviour be considered to be dangerous to themselves or any other person or contravening any applicable health and safety requirements.

Undertakings, limitation of liability and indemnification

  1. Event(s) and/or experience(s), to which Competition Prize relates, may be hosted by third parties (for example, at sport stadia, theatres, convention or other centres owned by other entities) and all winner(s) will comply by the rules and regulations applicable to events held at such premises upon entry of such premises, and as may be stipulated by the owners of such premises.
  2. Entry to any events, experiences, and venues in respect of which Vodacom may give away prizes as part of competitions on its platforms, are bound and regulated by specific event or venue-related rules and regulations, which may be determined by event or venue owners or relevant governing bodies. By participating in this competition, Competition Participants:
    • acknowledge and agree that they are bound by such event, experience, or venue rules upon entry to such premises, event or experience;
    • undertake to adhere to and comply with any and all reasonable event, experience, or venue rules and/or regulations; and
    • indemnify Vodacom, its agents, or employees from any liability associated with Competition participants/winners failure to adhere to such rules and regulations and any damages that occur as a result.
  3. Vodacom and/or any other person or party associated with the Competition, their associated companies, partners, agents, contractors and sponsors and any of its personnel involved in the Competition, or a related event or experience shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition, from claiming the Prize, or attending an event or experience forming part of the Prize.
  4. Vodacom is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.
  5. Vodacom cannot and will not be held liable should it be impossible for it to deliver the Prize or to fully perform, execute or fulfil the Prize. Should the Prize be linked to a specific fixture, match, event or experience, and should that specific fixture, match, event, or experience be cancelled, interrupted, postponed, or otherwise affected by events or factors outside of Vodacom’s control or at Vodacom’s discretion, Vodacom cannot be held liable for the fulfilment of the Prize or be required to provide an equivalent or replacement Prize.
  6. Vodacom, its directors, employees, agents and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.

Personal information

  1. User data collected via the Competition will not be used for any other purpose than for the execution of the Competition.
  2. User data collected via entry for this Competition will be stored for as long as it is legally required to and in accordance with Vodacom’s Privacy Policy, http://www.vodacom.co.za/vodacom/terms/privacy-policy.

Permission to receive marketing information from Vodacom

  1. By entering this Competition, you give Vodacom permission to send you marketing or promotional information about their products, services and other Competition.
  2. The entrant(s) will be given the option to opt out of receiving this information via the platform from which they receive the information.

General

  1. Vodacom customers who are not in good standing with Vodacom, or are involved in any legal process with Vodacom, or are in arrears with their accounts are not eligible for this Competition.
  2. Vodacom may be bound by specific event-related rules and regulations that are determined by relevant governing bodies. These rules will be communicated to the competition participant and with which the competition participant agrees to comply.
  3. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
  4. The judges’ decision on any aspect of the Competition, including the allocation of the Prizes, will be final and binding and no correspondence will be entered into.
  5. In the event of a dispute in regard to any aspect of the Competition and/or the Terms and Conditions, Vodacom’s decision will be final, and binding, and no correspondence will be entered into.
  6. Vodacom may refuse to award a Prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
  7. Vodacom is entitled in its entire discretion to reject any participant for any reason and will not be obliged to notify participants that they are rejected.
  8. Vodacom and/or any other person or party associated with the Competition, their associated companies, agents, contractors and sponsors and any of its personnel involved in the Competition shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition or from claiming the Prize.
  9. Vodacom is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating in and/or the Prize redemption process of the Competition.
  10. Vodacom cannot and will not be held liable should it be impossible for it to deliver the Prize or to fully perform, execute or fulfil the Prize.   11. Vodacom, its directors, employees, agents and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.
  12. If Vodacom is required by law to alter or cancel any aspect of the Competition or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Competition being offered, with immediate effect and without notice. In such event, all entrants waive any rights they may have against Vodacom and its associated companies, agents, contractors and/or sponsors.
  13. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

  1. If you do a price plan migration, whilst you have an existing active Service, such Service shall be carried over to the new price plan.
  1. If you do a price plan upgrade, you will be able to add the Service to your upgraded price plan.
  1. You cannot deactivate the Service before it expires.
  1. In the event that any of your user data is collected whilst using Service, the user data will be stored for as long as Vodacom is legally required to and in accordance with Vodacom's Privacy Statement, www.vodacom.co.za/vodacom/terms/privacy-policy. If there is no legal requirement, the collected information will only be stored for as long as it is needed for Vodacom to be able to provide the Service and has a legitimate interest in processing such user data.
  1. Vodacom reserves the right to terminate the Services immediately and without notice to you in the event that the Service is held to be or becomes unlawful in terms of applicable laws. In such event you hereby waive any rights which you may have against Vodacom and acknowledge that you will have no recourse or claim of any nature whatsoever against Vodacom.

    VAT Credit/Debit Note

    Are you registered with SARS for Value Added Tax (VAT)? If yes, then this information is for you.

    You would have received an SMS from Vodacom about your VAT credit/debit note. In the previous month you used prepaid airtime to buy or subscribe to some of our content services (for example, Google, Apple and Microsoft). In line with a South African Revenue Services ruling, we are required to provide you with a VAT credit/debit note for some of these purchases.

    • A VAT credit note is a document issued to update the assignment of VAT. It can be used by VAT-registered Prepaid or Hybrid (Top Up) customers to declare and pay the amount of VAT to SARS - within the applicable period to the extent that a VAT input was claimed on the relevant Prepaid Voucher. This is because the content services were bought with a prepaid voucher and the content provider’s invoice is the relevant VAT invoice document for this purchase
    • A VAT debit note: this is a document issued to correct the assignment of VAT. It can be used by VAT-registered Prepaid and Hybrid (Top Up) customers to claim VAT - within the applicable period - if VAT was declared and paid on a VAT credit note if the content services were refunded.

    A VAT credit/debit note ensures you are submitting an accurate VAT return and that you are not paying too much or too little for the Vodacom content services that you have purchased.

    Note: You will not receive any money from Vodacom as part of this VAT credit/debit note, instead it should be submitted as part of your VAT return.

    You will only see the detail of the Vodacom content services you bought which are applicable to the SARS requirement on the VAT credit/debit note.

    If you are on an Airtime Hybrid package - such as RED Flexi - you'll be able to see the invoice number of the content services you bought, deducted from your monthly allocated airtime.

    Any airtime discounts applied on your Airtime Hybrid account will also be shown on the VAT credit/debit note.

    Follow the 4 quick steps below to request your VAT credit/debit note, this should only take a few minutes. Once you’ve done this, you can contact your tax advisor for more information on how to include this document as part of your VAT submission.

    Are you registered with SARS for Value Added Tax (VAT)? Do you have a Hybrid/TOPUP Vodacom package? If yes, then please proceed.

    STEP 1

    Log in to your account on the Vodacom Portal by clicking here. If you have not yet registered on the Vodacom Portal, you will need to first register an account.

    If you do not have a VAT Registration number on record with Vodacom, you will need to enter your VAT Registration number to be able to request a VAT Credit/Debit note. If you are not registered for VAT the VAT Credit/Debit note is not applicable to you.

    Now, complete your VAT registration number and select the date that you want the document for. Next, input the email address and complete the disclamer. Click "submit"  to receive the VAT credit/debit note.

    Airtime Advance Terms and Conditions

    Introduction

    1. Vodacom Payment Services (Pty) Ltd (“VPS”) and Vodacom South Africa (Pty) Ltd (“VSA”) (collectively “Vodacom”) have worked together to jointly provide the Vodacom Airtime, Data, and Voice Advance service (“the Service”) to you.
    2. The Service enables you to receive airtime, voice or data when you request it and pay for the airtime or data when you recharge with airtime, data bundles or voice bundles.
    3. The terms and conditions set out herein (the “Terms and Conditions”) specifically apply to the Service, and the Service shall at all times be subject to these Terms and Conditions.
    4. The Service is provided to you by Vodacom in conjunction with our appointed third-party service providers.
    5. It is important that you read through these Terms and Conditions carefully before using the Service.
    6. By using the Service, you agree to be bound by these Terms and Conditions and understand that this shall constitute a binding agreement between you and Vodacom.
    7. Vodacom may amend these Terms and Conditions at its sole discrection and at anytime. Vodacom will bring material changes to these Terms and Conditions to your attention. It remains your responsibility to ensure that you familiarise yourself and understand any changes made to these Terms and Conditions 

    Qualification

    1. You will be eligible to use the Service if you:
      • are a VSA prepaid or TopUp/uChoose customer;
      • have been an active VSA customer for a period of 3 months or longer;
      • have a minimum cumulative recharge of R29 per month for at least 3 consecutive months;
      • are a TopUp/uChoose customer and your account is up to date; and
      • are a qualifying Vodacom Business TopUp/uChoose customers subject to the Corporate Administrator giving you access to the Service.

    The Service

    1. You may access the Service through:
      • USSD *135*082#;
      • My Phone menu (*111# or *135#);
      • the vodacom.co.zawebsite; or
      • the MyVodacom Application or any other channel made available to you by Vodacom from time to time.
    2. As part of the Service, you may elect to either to recharge your account with data (“Data Advance”), voice (“Voice Advance”) or airtime (“Airtime Advance”).
    3. You can use the Service to purchase any personalised offers, as provided on any Vodacom channel from time to time. The bundles offered may differ from the standard bundles available through the other Vodacom channels.
    4. Vodacom may set a limit for the Service limit (“Limit”) depending on your specific profile.
    5. You can use the Services up to your total Limit in the available denominations.
    6. You will receive an SMS notification if the Airtime Advance, Voice Advance or Data Advance has been allocated to your account.
    7. If you reach your total Limit, you will not be able to take additional advances until you have recharged to the value equal to a portion or all of the Airtime Advance, Voice Advance or Data Advance you’ve used.
    8. You are required to recharge at least once a month in order to continue using the Service. If you fail to do this:
      • Vodacom may suspend you from using the Service until you recharge; and/or
      • Vodacom may decrease your Limit.
    9. Vodacom also gives you access to the “Max Option”. The Max Option allows you to receive your total Limit in one or multiple Airtime Advance transactions at the highest denomination available to you. By way of example, if your Limit is R100, and you select the Max Option, you will receive your R100 Limit in 10 Airtime Advance transactions of R10 each.
    10. In addition to the Max Option, you may be given the option to take 25%, 50% or 75% of the “Max Option”, (rounded up to the nearest R10)  in  multiple Airtime Advance transactions at the highest denomination available to you.  By way of example, If your limit is R100 you may be presented with the option to take R50 allocated in 5 Airtime Advance Transactions of R10 each.
    11. If you are a TopUp/uChoose customer, you may at any time contact Vodacom customer care via email on [email protected]to request for the Service to be deactivated or removed from your profile.  In such an instance, you will continue to be liable for any outstanding advances (including the applicable access fee) up to the point where the Service has been deactivated from your profile. To have the Service reactivated/reinstated onto your profile, you will need to contact Vodacom.

    Airtime Advance

    1. Airtime Advance can be taken in denominations of R5, R10 and R20 (VAT Inclusive) or as displayed on the appropriate Vodacom channel from time to time.
    2. Airtime Advance can be used for any transaction available on the Vodacom network i.e., Voice, Data, and SMS. 
    3. You will be allowed to transfer Airtime from their Airtime Advance as per the current Airtime Transfer business rules. 
    4. Airtime Advance will be seen as a normal recharge in your account. 
    5. No recharge benefits/incentives such as Night Shift, Talking Points or Extra Airtime will be allocated for an Airtime Advance. These benefits/incentives will be triggered once a recharge is made to pay the airtime advance.

    Data Advance

    1. You may take Data Advances in the following denominations:
      • 20MB valued at R3.00;
      • 50MB valued at R7.00;
      • 100MB valued at R12.00; and
      • 250MB valued at R18.00
    2. These data allocations will be standard data allocations and will be valid until 23h59 (i.e., midnight) on the day of allocation
    3. You may not use the Data Advance for data roaming.
    4. Data Advance will not trigger any recharge or bundle purchase promotions/incentives (e.g., Talking Points, Night Shift, etc.).
    5. Should you be using Facebook Flex (FREE mode), it may be presented with a Data Advance bundle offers from Vodacom through the Facebook App.

    Voice Advance

    1. You may take Voice Advances in the following denominations:
      • 10Min On-net (Vodacom to Vodacom) valued at R3.00
      • 30Min On-net (Vodacom to Vodacom) valued at R5.00
      • 60Min Any-net (Vodacom to any network) valued at R12.00
    2. Voice Advance allocations will be valid until 23h59 (i.e. midnight) on the day of allocation.
    3. You may not use the Voice Advance for roaming.
    4. Voice Advance will not trigger any recharge or bundle purchase promotions/incentives (e.g., Talking Points, Night Shift, etc.).

    Auto Advance

    1. Auto Advance is a Service that automatically triggers an Airtime Advance if your airtime balance is less, equal to or less than R1.50.
    2. You may opt in to Auto Advance by dialing *135*082#.
    3. Auto Advance is limited to a maximum of 3 Airtime Advances per day, subject to your available Limit and you will be offered the highest Airtime Advance denomination you qualify for, limited to a maximum of R10.00 for each Auto Advance.
    4. You can opt out of the Auto Advance at any time by dialing *135*082#.

    Access Fee and Recharges

    1. For each Airtime Adavance, Data Advance, Voice Advance and/or Auto Advance, Vodacom shall deduct an access fee of R1.10 (VAT inclusive) (the “Access Fee”) from the airtime recharge following any advance. The Access Fee shall be over and above the value of the Airtime Advance or Data Advance that you may need to repay. By way of example:

    If you take a R10 Airtime Advance and recharge with R20, only R8.90 will be left due to:

    The R10 (Airtime Advance) + R1.10 (access fee) = R11.10 will be deducted, leaving you with a balance of R8.90. 

    1. For the avoidance of doubt, if you select the Max Option or any variant thereof, you will be charged an Access Fee for each transaction.
    2. The Access Fee is deducted from your airtime for:
      • bearer costs;
      • third-party costs; and
      • costs of deploying, operating, and maintaining the airtime advance infrastructure and a special algorithm developed to ensure the sustainable provision of the product.
    3. Outstanding Airtime Advance, Voice Advance or Data Advances will be deducted from ANY recharges, including Airtime Transfers, CRM recharge incentives. For the avoidance of doubt, outstanding Airtime Advance, Voice Advance or Data Advances will not be deducted from any Advance taken within the Limit, and only actual recharges.
    4. Should you recharge with a lower denomination than that of the full value of the payable Airtime Advance, Voice Advance or Data Advance, the full recharge will be deducted until the total cumulative value of the payable Advance amount has been paid.
    5. If you are a TopUp/uChoose customer, the Airtime Advance, Voice Advance and Data Advance value must be paid within 30 days from the date that you received such advance. If you do not recharge and/or the full value is not paid within the calendar month, the outstanding advance amount will be added to your monthly bill for that calendar month which will become due and payable on their next payment date. You will receive an SMS notification to advise you if any Airtime Advance, Voice Advance or Data Advance has been added to your monthly invoice.
    6. If you are a prepaid customer with an Airtime Advance, Voice Advance or Data Advance and you migrate to a TopUp/uChoose or a postpaid plan, the Airtime Advance or Data Advance value plus Access Fee will be added to your first month’s invoice. 
    7. You will receive an SMS notification to advise you if any deduction has been made to your airtime recharge value.

    Personal Information

    1. Your personal information will be stored, processed, and only used by our appointed administrative partners. This may include your MSISDN number and information regarding your airtime payment history.
    2. These Terms and Conditions are subject to Vodacom’s Privacy Notice which you can find here and which is incorporated to these Terms and Conditions by reference.

    Scope

    This Privacy Notice applies to customers who take Airtime Advance. Unless context dictates otherwise, the Vodacom Payment Services (Pty) Ltd  Privacy Notice shall also apply to interactions with you regarding any collection, use or other processing of personal information.

    Responsible Parties and Right to Information

    Vodacom Payment Services (Pty) Ltd (“VPS”) and Vodacom (Pty) Ltd (“Vodacom”) are joint responsible parties in terms of the Protection of Personal Information Act 4 of 2013, in respect of Airtime Advance.

    Further, VPS is reliant on Vodacom to share your personal information with it to allow for the provision of Airtime Advance as part of the services offered to You in terms of Your pre-paid or hybrid terms and conditions.

    Personal Information Collected

      • VPS only collects personal information from Vodacom about customers required to enter into an agreement for Airtime Advance.
      • The personal information collected is your MSISDN data which contains your recharge records, airtime advance and subscriptions records.

    Uses and Sharing

      • Vodacom shares the personal information collected with VPS, in order for it to process the personal information and to provide your Airtime Advance as per agreement and may use your information to provide you with information on related products;
      • VPS will use your personal information for purposes consistent with the reason Vodacom has collected it for;
      • VPS will share your information with our Supplier/s to conduct Airtime Advance scoring. If you do not provide your consent to share the information, VPS will not be able to provide you with Airtime Advance;
      • VPS will require our Supplier to handle your personal information in accordance with our full Privacy Notice, as well as applicable privacy legislation.

    Your Rights

      • You may access personal information that VPS holds about you. You may also ask us to correct any errors or delete the personal information VPS has about you, under certain circumstances;
      • You may opt-out of any marketing messages or further contact from us;
      • To protect your privacy, VPS may have to verify your identity before VPS can give you access to, or change, personal information about you.

    2.2  The Promotion Gift is limited to the first 3500 Promotion Participants that comply with the requirements set out at clause 2.

      1. The duration of the Promotion may be extended or curtailed at the discretion of the Organiser.

     

     

    1. Who may enter:

     

      1. All participants must:
        1. be citizens of the Republic of South Africa and/or legal residents of the aforesaid country;
        2. be currently residing in the Republic of South Africa at the date of the commencement of the Promotion Period;
        3. be a natural person and be at least eighteen (18) years old at the date of the commencement of the Promotion Period;
        4. be in the possession of a valid South African identity document.
        5. have made a valid purchase of a Samsung Galaxy Z Flip4 device with a valid IMEI number, purchased within the Republic of South Africa from a Vodacom Shop, Vodacom Online, Vodacom World, Vodacom 4U, ChatzConnect, Cellucity, Game, Makro and TechnoMobi.
        6. be in the possession of a valid Proof of Purchase with verifiable details such as IMEI number, outlet from which the device was purchased from, and in certain cases, the name of the purchaser.
        7. Participation in this promotion does include the Organiser, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services, if they personally purchased a Samsung Galaxy Z Flip4 for their own personal use. Proof of purchase will be verified at the Promoter's discretion.
        8. Misrepresentation of participants or in store sales representatives will result in the disqualification of the claim and possible legal action.

     

     

    1. How to qualify for the Promotion: 

     

      1. The participant must purchase a Galaxy Z Flip4, within the Promotion Period:
    1. Be a participant as set out in 3 above;
    2. After purchase of Galaxy Z Flip4 device, the customer will be required to complete the redemption steps outlined in a trigger email after registering for the promotion. 
    3. Data charges may be incurred by the participant and the Organiser will not be responsible for any such costs. Network rates apply.

     

     

    1. Can I qualify more than once for the Promotion:

     

      1. The participant shall qualify for the Offer for each valid purchase of the Galaxy Z Flip4 device (identifiable by the unique IMEI number).
      2. Should there be any dispute in this regard, the Organiser shall be sole adjudicator of the dispute and the Organiser's decision shall be final

     

     

    1. Offer:

     

      1. The Promotion will afford the participant the opportunity to receive one (1) Galaxy Tab A8 wifi per purchase of the Galaxy Z Flip4 device ("Offer").
      2. The Offer is not transferable. No substitution, cash redemption, or assignment of  the Offer is permitted.
      3. The Offer may differ from that shown on the promotional material with regard to colour and specs and same shall be subject to availability and in the Organizer's sole discretion to select same.
      4. The Offer is available on a "first come first serve" & "while stocks last" basis and the Organiser cannot be held accountable once the stock of the promotional Offer has been depleted.

     

    1. Redemption

     

      1. To redeem your Offer, the participant must follow the following steps and/or instructions: 

      

          1. Step 1: Purchase and activate the Galaxy Z Flip4 device, which must be purchased from a Vodacom Shop, Vodacom Online, Vodacom World, Vodacom 4U, ChatzConnect, Cellucity, Game, Makro and TechnoMobi, within the Republic of South Africa during the Promotion Period.
          2. Step 2: Download Samsung Members Application from the Samsung Galaxy Store or Google Play Store on his/her Z Flip4 device.
          3. Step 3: Register for a Samsung Members account, then click on "Galaxy Z Flip4, Free Galaxy A8 (wifi)" promotional banner in the "Benefits" section of the Samsung Members Application and follow the prompts.
          4. Step 4: Upload the proof of purchase of Galaxy Z Flip4 device and complete and submit an online form with participant’s details and contact information.
          5. Step 5: Upon submitting the online form (referred to in clause (b) the participant will receive an e-mail confirming their submission of the online form was successful. In the same email, the participant will receive a Reference number that must be used by the participant to escalate any queries pertaining to their submission.  
          6. Step 6: Once the Organiser has validated the participant's online form and proof of purchase of the Galaxy Z Flip4 device, the participant will receive a congratulatory message by way of email.
          7. Step 7:  The Organiser will then arrange for delivery of the Offer according to the delivery details provided by the participant. The participant will be required to provide the Organiser with a day, time and address to enable delivery of the promotional Offer.

     

      1. A participant must redeem the Offer within the Redemption Period.
      2. Participants who encounter any technical issues when redeeming the Offer, must  contact the Organizer for assistance by telephone at the following telephone  number: +27 (0) 87 65550512.
      3. Should the participant fail to supply valid proof of purchase through the Samsung Redemption Form, the Offer will be forfeited.
      4. One time use policy - once redeemed there will be no returns, no exchanges and no cancellations allowed. 
      5. Sales representatives employed at participating stores may not claim the Offer on behalf of a purchasing customer. Participants must redeem the Offer on their own behalf.
      6. The Organizer accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these Terms and Conditions will be disqualified.
      7. Errors and omissions may be accepted at the Organizer's sole discretion. Failure by the Organizer to enforce any of its rights at any stage does not constitute a waiver of those rights.
      8. It is the participant's responsibility to ensure that any information provided to the Organizer is accurate, complete and up to date.
      9. The Galaxy Tab A8 (wifi) can only be redeemed through the Samsung Members Application, for those applicable purchases.
      10. The Organiser will not be responsible for any costs associated with the redemption process of the Offer.

     

     

    1. Limitation of Liability:

     

      1. To the extent permitted by Consumer Protection Act No 68 of 2008 and any other applicable law:
        1. The participant and/or winner(s) hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the

    law of contract or delict or otherwise, because of the participant's entrance to the Promotion.

        1. The Organiser excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

     

     

    1. General:

     

      1. In accordance with the confidentiality policies and practices of the Organizer, none of the entry details of any participant in this Promotion will be disclosed or used by the Organizer for any purposes other than for entry into the Promotion and in accordance with clause 9.3 below. 
      2. Participants acknowledge and accept that the Organizer shall utilise a third party (the "Organizer's authorized agent/s") to contact the participant, in the event that the participant qualifies for the Promotion, and to arrange delivery of the Offer, where applicable. In order to affect the contacting and delivery process, the Organizer's shall provide the participant's information to such third party. 
      3. By participating in the Promotion, the participants agree that the Organizer and its affiliates may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Organizer for such purpose. The Organizer may also use the personal data collected from the participants as described in the Privacy Policy accessible at www.samsung.com and that such use may include transfers to the Organizer's affiliates and third party service providers in any country.  Details of participants will not be used by the Organizer for Samsung related communication should the participants opt-out to receive further communication from the Organizer.
      4. The Organizer may require the Participant to be identified and photographed.  Photographs may be published in printed media, or the Participant may be required to appear on radio and television when accepting their Offer and/or after having received their Offer.  The Participant will be given the opportunity to decline to the publication of their images and to participate in the Organizer's marketing material in so far as it relates to the Promotion.
      5. Information regarding the Promotion that is published on authorized advertising material will also form part of the terms and conditions of the Promotion.
      6. The Organizer's may in their sole discretion amend these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions on the Organizer's website www.samsung.com/za/promotions . The onus rests on the participant to constantly check the website for updates to the terms and conditions.
      7. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organizer, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organizer reserve the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.
      8. Save as permitted by Law, the Organizer reserves the right to cancel, suspend or terminate this Promotion, without notice at any time, and such cancellation, termination or termination shall be deemed to have taken effect from the date of publication on the Organizer's website www.samsung.com/za/promotions .No liability shall lie against the Organizer in favor of any participant, Participant(s) and/ or third party arising from such cancellation, suspension or termination. Therefore the participant waives his/her right which they may have against the Organizer and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organizer.
      9. This Promotion is governed by these terms and conditions, as well as those of the relevant authorized participating stores, associated with this Promotion.
      10. Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa. 
      11. The Organizer accepts no liability or responsibility, whether occasioned by any circumstance not foreseeable and not within its reasonable control for late or delayed delivery of the Offer owing to, but not limited to, stock unavailability, strike, lock out, destruction of Offer on route by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earth quake or other acts of God.
      12. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:
    1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;

    Traffic Fines Application Terms and Conditions

    1. Introduction
    • Vodacom Payment Services (Pty) Ltd, a company registered in terms of South African law with registration number: 2007/010688/07 (hereinafter referred to as "VPS") provides an application within its VodaPay Super Application (hereinafter referred to as the "VodaPay App”) that enables you to pay your traffic fines with participating local authorities (the “Service”).
    • You and your refers to you as the user of the fine payment functionality and we, us and our, refers to VPS.
    • The word “Tenant” will refer to any partner and/or subsidiary that uses this service to service their clients as a value-added product or refer any client to VPS.
    • The word “Agent” will refer to any service provider and/or partner and/or subsidiary that works in conjunction with VPS to provide the services as discussed herein.
    1. Qualification
      • The Service is available to holders of a South African ID only.
      • You must be at least 18 years of age to use this Service. By using this Service and by agreeing to these terms and conditions you warrant and represent that you are at least 18 years of age.
    2. Acceptance
      • By using the Service you accept these Traffic Fines App Terms and Conditions. You acknowledge you have read and understood these Traffic Fines App Terms and Conditions relating to the Traffic Fines App and agree they will be binding on you. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use the Traffic Fines App.
    3. Term and Termination
    • These terms and conditions will commence on use of the Service and continue indefinitely, as amended by us from time to time, for so long as the Service is available.
    • We retain the right to amend or terminate these Traffic Fine App Terms and Conditions and/or terminate the Service.
    • We may amend these Traffic Fine Terms and Conditions at our sole discretion and at anytime. VPS will bring material changes to these Traffic Fine App Terms and Conditions to your attention. It remains your responsibility to ensure that you familiarise yourself and understand any changes made to these Traffic Fine App Terms and Conditions.  By continuing to use the Service, you consent to the amended terms and conditions.
    1. The Service
      • This Service is integrated with third party service providers who are authorised to access information relating to road and traffic infringements issued by the relevant participating local issuing authority.
      • All fine information that is furnished to you is received by us from such service providers who in turn obtain it from the local issuing authorities. Alternatively, VPS may retrieve this information directly from the relevant local issuing authority.
        All licensing and vehicle data is retrieved by us from third-party service providers or agents.
      • As VPS is reliant on the information received by it from third parties or the issuing local authority, and has no way of verifying this information independently, VPS is not liable or responsible for any inaccurate information received from or by service providers and/or agents and/or issuing local authority.
      • By using this Service, you expressly authorise us to obtain and/or retrieve the relevant traffic fine information/ data and licensing and vehicles data pertaining to yourself or your company (in case of a proxy), from each issuing local authority (either directly or by way of our service providers) in order to provide this Service to you. Insofar as may be required in law, you hereby authorise us to act on your behalf to make payment of the fines that are available for purposes of the Service.
      • You will only use the Service for your own purposes and not on behalf of any other person or entity. You and all payments initiated by you will comply with all laws, rules, and regulations as may be applicable. You will not use the Service, directly or indirectly, for any fraudulent undertaking or in any manner so as to interfere with the functionality of the Service.
    1. Use
       
      • You must not use this Service in any way that causes, or may cause:
        • damage to the VodaPay App, impairment of the availability or accessibility of the VodaPay App; or
        • in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
      • You must not use this service to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
      • You must not use this service to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
      • You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this service without VPS express written consent. You must not use this service to transmit or send unsolicited commercial communications. You must not use this service for any purposes related to marketing without VPS express written consent. You may not use this service to collect fines and vehicle administration service data to perform these functions yourself.
      • VPS may at any time disable your username and password on the VodaPay App at its sole discretion without notice or explanation.
    1. Warranties
      • This service is provided “as is” without any representations or warranties, express or implied. VPS makes no representations or warranties in relation to this service or the information and materials provided on this service.
        Without prejudice to the generality of the foregoing paragraph, VPS does not warrant that:
        • this service will be constantly available, or
        • available at all;
        • nothing on this service constitutes, or
        • is meant to constitute, advice of any kind.
    • You warrant that:
      • you own or otherwise control all rights required to any and all content / personal information that you may submit to the Service;
      • any use of such content / personal information will not cause injury or harm to any person or entity, including VPS; and
      • you will indemnify VPS and / or its affiliates, directors, officers and employees, for any and all claims of whatever nature resulting from the submitted content / personal information.
    1. Fees, Payments and Discounts
      • VPS shall furnish you with a quotation reflecting a fixed amount which VPS will charge you to procure that your liability in respect of the fine with the relevant the local issuing authorities is discharged inclusive of the fine itself and the services provided by VPS to procure such discharge (“Settlement Amount”). The Settlement Amount quoted is valid for 7 days only. Once the quotation is accepted by you and the amount is paid by you to VPS, VPS undertakes to procure that your liability in respect of the fine in question is discharged. If the settlement amount is more or less than the actual cost incurred by VPS to procure that your liability in respect of the fine is discharged, then such shortfall or surplus, as the case may be, shall be for the cost or benefit of VPS.
      • During the process of providing the services to procure such discharge, but prior to the actual discharge of your liability for the fine, a portion of the settlement amount, as determined by VPS acting reasonably, shall be deemed earned by VPS, as and when VPS completes each step in its process to procure such discharge.
      • Notwithstanding any provision herein, any portion of the settlement amount not already earned as aforesaid, shall, upon discharge of your liability for the fine for any reason (whether through the services of VPS or by operation of law) be deemed fully earned by VPS.
      • By accepting the quotation and making payment of the settlement amount to VPS, you authorise a representative of VPS to act on your behalf in relation to the fine, including to communicate with any relevant person, and to deal with the fine in any manner which VPS deems fit for purposes of having your liability in respect of such fine discharged.
      • Payment of the settlement amount may be made via credit or debit card , coupons’ issued by VPS or cash from your VodaPay wallet.
    1. Intellectual Property
      • The contents of the Service, including any material, information, data, software, icons, text, graphics, lay-outs, images, sound clips, advertisements, video clips, trade names, the word or mark "Vodacom", “Vodacom Payment Services” and "Voda", logos, trade-marks, designs and service marks which are displayed on or incorporated in this Service (“Intellectual Property”) are protected by law, including but not limited to copyright and trade mark law. The Intellectual Property is the property of VPS, its advertisers and/or sponsors and/or is licensed to VPS.
      • You will not acquire any right, title or interest in or to the Service or the Intellectual Property.
      • Any use, distribution or reproduction of the Intellectual Property is prohibited unless expressly authorised in terms of these Traffic Fine App Terms and Conditions or otherwise provided for in law.
      • Where any of the Intellectual Property has been licensed to VPS or belongs to any third party, your rights of use will also be subject to any terms and conditions which that licensor or third party imposes from time to time and you agree to comply with such third party terms and conditions.
    1. No Admission of Guilt
      VPS does not provide assistance with NAG fines. As you may be obliged to appear in court to determine the amount of a NAG fine, we suggest that you seek advice from an attorney.
    1. Liability

    PLEASE READ THIS SECTION CAREFULLY SINCE IT LIMITS THE LIABILITY OF VPS TO YOU. EACH OF THE SUBCLAUSES BELOW ONLY APPLIES TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW. NOTHING HEREIN IS INTENDED TO LIMIT ANY RIGHTS YOU MAY HAVE WHICH MAY NOT BE LAWFULLY LIMITED.

    • VPS will not be liable to you (whether under the law of contact, the law of delict or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this Service: for any indirect, special or consequential loss; or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
    • VPS will not be liable for any incorrect information, data and/or fine-data. VPS will not be liable for any loss or damages suffered by you due to fines that you are unaware of or which do not appear in any quotation or statement provided to you.
    • VPS in no way guarantees complete and national coverage. VPS will not be liable for any act and/or omission by a Tenant and/or Agent.
    • These limitations of liability apply even if VPS has been expressly advised of the potential loss. By using this Service, you agree that the exclusions and limitations of liability set out in these terms and conditions are reasonable.
    • You accept that, VPS has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against VPS officers or employees in respect of any losses you suffer in connection with the Service. You agree that the limitations of warranties and liability set out in these terms and conditions will protect VPS officers, employees, agents, subsidiaries, successors, assigns and sub-contractors.
    • Without prejudice to VPS other rights under these terms and conditions, if you breach these terms and conditions in any way, VPS may take such action as they deems appropriate to deal with the breach, including suspending your access to the Service, prohibiting you from accessing the Service, blocking computers using your IP address from accessing the Service, contacting your internet service provider to request that they block your access to the Service and/or bringing court proceedings against you.
    • Your sole and exclusive right and remedy in case of dissatisfaction with the service, or any other grievance in connection with your use of the Service, shall be your termination and discontinuation of access to, or use of, the Service.
    • Nothing in these terms and conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or VPS in terms of the Consumer Protection Act, 68 of 2008.
    1. Regarding Companies
      The contact person and/or representative of the company warrants that he/she has the full authority to operate the account of the company. The company representative operating this system on behalf of the company warrants that the company agrees to these terms and conditions.
    2. Cession and Assignment

      VPS may transfer, sub-contract or otherwise deal with VPS’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
    3. Severability
      If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
    4. Governing Law

    These Traffic Fines App Terms and Conditions and the Service   is governed by the laws of South Africa. The South African courts shall have exclusive jurisdiction in regard to any dispute arising out of this Service.

    1. Miscellaneous
      • Main Municipality receipts may take up to 30working days to reflect. Outside Municipalities can take up to 12 weeks to reflect due to additional procedures. Warrants can take up to a further 30 working days depending on the relevant court. If you are aware that you have an Admin Block against your ID then please advise us so that we can get this cleared off your name. All time period referred to herein are estimates only. VPS does not guarantee and will in no way be held liable for the duration in which it takes to discharge any fine.
      • These terms and conditions together with notices within the service and the applications constitute the entire agreement between you and VPS in relation to your use of this service and any application, and supersedes all previous agreements in respect of your use of this service.
      • When you register on the VodaPay App, you consent to us using your personal information for purposes of sending to you marketing and promotional materials in relation to our products or services. You may manage these communication permissions on the VodaPay App.
