    Terms and Conditions

    Vodacom (Pty) Ltd (“Vodacom”) is running the Vodacom Tsamaya Pre-Season Fan Tour 2025 in collaboration with Orlando Pirates and Kaizer Chiefs, where a total of ten (10) Vodacom customers each stand a chance to win the opportunity to travel internationally with either team as part of the 2025 Pre-Season Fan Tour, (the “Competition”), as advertised/promoted on Vodacom’s official social media and digital platforms and any third-party partner social media and digital platforms.

    These are the Standard Competition Terms and Conditions. By entering and/or participating in this Competition, entrants/participants opt into, agree to, and consent to be bound by the Terms and Conditions stated below.

    Competition Terms and Conditions

    Competition Duration

    1. The Competition period/duration is from:
      • Start Date: 15h00, Saturday, 3 May 2025.
      • End Date: 23H59, Sunday, 15 June 2025.
      • The Competition and its duration may be extended, curtailed, or cancelled at the discretion of Vodacom, as may be communicated/published on its social media platforms.
    2. The Prize Draw will be done shortly after the End Date or as may be communicated/published on its social media platforms.

    Competition Prize/s

    1. The Competition Prize comprises:
      • Five (5) Vodacom customers each stand a chance to win the opportunity to join the Orlando Pirates Pre-Season Fan Tour to be hosted in Spain; and
      • Five (5) Vodacom customers each stand a chance to win the opportunity to join the Kaizer Chiefs Pre-Season Fan Tour to be hosted at a destination in Europe (location to be confirmed),

    as may be specified/promoted on Vodacom’s official social media and digital platforms and any third-party partner social media and digital platforms, and which 2025 Pre-Season Fan Tour is likely to take place over the course of seven (7) days during July 2025, but which dates are still to be determined.

    1. Total number of Prizes: 10 (ten) winners in total.
    2. Value of the Prize(s) (per Prize): approximately and a maximum of R100,000 (one hundred thousand Rand), which is not transferable, not exchangeable, and/or not refundable.
    3. The Prize includes: necessary travel, transport, accommodation, and meal arrangements that form part of the Pre-Season Fan Tour 2025, as arranged, booked, and/or provided at Vodacom’s discretion (and in line with budgetary, operation, and/or practical considerations and/or limitations) and which may include:
      • Return economy international flights to and from the Pre-Season Fan Tour destination, from OR Tambo International Airport;
      • Return economy domestic flights within South Africa to/from OR Tambo International Airport, if applicable;
      • Support and assistance with the process of applying for a South African passport (if needed);
      • Visa application support and management for travel;
      • Accommodation on a bed and breakfast basis;
      • Transport to and from official activities during the Pre-Season Fan Tour;
      • Meals provided as part of the Pre-Season Fan Tour itinerary;
      • Opportunities for team interaction and attendance at a pre-season warm-up match (subject to team availability);
      • Additional activities and/or gifts provided at Vodacom’s discretion.
    4. The Prize excludes:
      • Any and all items or costs that are not directly related to the Pre-Season Fan Tour’s itinerary (as determined at Vodacom’s discretion), including necessary travel, accommodation, and meals;
      • Items of a personal nature, including cell phone reception coverage / international roaming and data;
      • Meals and drinks outside of the official itinerary;
      • Clothing, souvenirs, and personal shopping;
      • Additional hotel costs such as laundry, room service, minibar, and phone calls;
      • Medication and medical expenses.

    Eligibility

    1. The Competition is open to Vodacom customers who have been Vodacom customers for an uninterrupted period of 24 (twenty-four) months or longer and who entered via Vodacom and/or other third-party social media and digital platforms, who completed the competition form, or other stipulated requirements for entry as specified for the Competition.
    2. Vodacom Customers can enter the Competition in one of two ways, by either:
      • Entering through the Competition platform during the Competition Period by completing all the required prompts, and limited to one entry per day; or
      • By purchasing a qualifying Vodacom product during the Competition Period to the value of R49.00 (forty-nine Rand) (being data, airtime, or a combination of both) or more, a Vodacom customer will automatically receive a Competition entry. Products are available on USSD by dialling Dial *123# or available on VodaPay. Every time such a product is purchased, a qualifying entrant receives a Competition entry, not limited to one entry per day.
    3. The Competition is open to South African Residents over the age of 18 who are in possession of a valid identity document.
    4. An entrant is not eligible to enter this Competition if they have a criminal record. Should it emerge that an entrant (who is selected as a winner) has a criminal record (with or without their knowledge), they will be disqualified and the Prize forfeited.
    5. Only entries received during the Competition period will be eligible entries.
    6. The Competition is only open to natural persons. Entries received from business accounts held by legal persons (amongst other Corporates and SMEs, etc.) are excluded and not eligible to participate in the Competition.
    7. Only entrants/participants who are using SIM cards that have been RICA (Regulation of Interception of Communications and Provision of Communication-Related Information Act) registered are eligible to win the Competition. Each owner of a SIM card(s) is responsible for complying with South African law by RICA registering their SIM cards.
    8. Employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates, and any person directly involved with the sponsoring, devising, production, management, or marketing of this Competition are not eligible to participate in this Competition.
    9. Entrants/participants must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid for the Competition duration, and provide a copy of such an identity document to Vodacom on request - failing which eligibility to win is forfeited.
    10. Entrants/participants are only eligible if they have not won a Vodacom competition during 6 (six) months preceding this Competition. The 6 (six) months calculation will start from the date that Vodacom fulfilled the Prize in the preceding Competition.
    11. In the event that the user of the mobile phone (i.e., the entrant/participant in the Competition) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the Prize will be awarded to the person that is responsible for payment of the participating mobile phone account/ charges.
    12. Vodacom customers who are not in good standing with Vodacom, or are involved in any legal process with Vodacom, or are in arrears with their accounts are not eligible for this Competition.

    Valid Entry

    1. A Valid Entry must comply with the Competition requirements as stated or described above or on the platforms (social media or other – as selected by Vodacom in its discretion), and which competition requirements may include qualifying criteria, participation prompts or instructions.
    2. Qualifying entrants/participants must complete all the required information on the Competition entry form, platform, or prompts, which can be found via Vodacom’s social media platforms during the period of this Competition.
    3. Responses directly or via direct messages on any social media platform will not be considered valid entries.
    4. Only correct answers or a correct sequence of answers will be accepted and eligible to be selected as a winner at Vodacom’s discretion.
    5. There are no additional charges for participating in the Competition.
    6. Standard costs apply as per the user’s Service Provider and existing price plan, including for data usage and are subject to the applicable Terms and Conditions of that service.
    7. Vodacom shall not be liable for any costs incurred by the winners for entering the Competition or claiming any prizes. 
    8. Data transfer speeds are not guaranteed and are dependent on network availability and utilisation.
    9. Vodacom (or its Agent) retains the right to determine, at its discretion, if entrants/participants meet the stipulated eligibility criteria, criteria for a valid entry, competition requirements, and may be eligible to win a prize based on the Competition requirements.
    10. Vodacom (or its Agent) is entitled to, in its discretion, disqualify any entrant/participant from the Competition for any reason and will not be obliged to notify entrants/participants of such disqualification.

    Prize Draw and/or winner selection

    1. The winners of the Prize will be randomly selected from all eligible entries that meet all the requirements set out in these Terms and Conditions. Eligible entries will be put into the draw, and the winner will be selected through the process of a randomiser (selected at random).
    2. If a winner is selected and it emerges that he/she was ineligible to participate, the Prize will be forfeited.
    3. The Prize Draw will be done under the management and/or oversight of an independent accountant, registered auditor, attorney or advocate oversees and certifies the conducting of the competition and must report this through Vodacom’s internal audit reporting or other appropriate validation or verification procedures.
    4. The verified winners will be notified on the number (MSISDN) through which they entered the Competition or purchased the qualifying Vodacom Product within two (2) days after he/she has been selected and verified as a winner. Winners can choose not to receive/claim/collect their prize.
    5. The decision of the judges (who draw the prizes or decide the winners, as appointed by Vodacom at its sole discretion) on any aspect of the Competition, including eligibility and the award or allocation of the Prizes, will be final and binding and no correspondence will be entered into.

    Winner Validation

    1. All the information provided or related to this Competition shall be managed, captured, and approved by Vodacom.
    2. Vodacom will share personal details of the respective winners, such as name and contact number, with a Vodacom-approved third-party agency, Openfield Marketing, who will notify the respective winners that they have won in the Competition, and by participating in the Competition, entrants/participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
    3. Vodacom and Openfield Marketing will use reasonable efforts to contact the winners via direct messaging on their social media profile, email, or telephonically as may be applicable on the contact details provided by the entrants/participants to participate in the Competition.
    4. Vodacom and Openfield Marketing shall attempt to contact the winners for a period of 2 (two) normal working weekdays after their names have been drawn and verified as winners. The winners will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winners will be advised of arrangements in respect of Prizes at the time of contacting the selected winners.
    5. Should an entrant/participant not be available, or should Vodacom or its Agent be unable to reach that participant for any reason whatsoever, on the contact details provided during the timeframe stipulated above or of the Participant rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived and forfeited. Vodacom reserves the right at is sole discretion to then award the Prize to the next randomly drawn entrant/participant.
    6. The claim for any Prize will be subject to security and validation, and Vodacom reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winners must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants/participants to the Competition and have to comply with the required validation procedure, determined by Vodacom, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
    7. Notwithstanding the fact that the Prizes vest in the winners immediately upon the determination of the results, in the event that the required information, documentation or verification from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winners to make special arrangements to meet the deadline set by Vodacom, such Prize will be forfeited. Vodacom then reserves the right to award the Prize to the finalist that is next in line/next randomly selected winner.
    8. The winners’ name and location may be displayed on www.vodacom.co.za/competition_winners after a period of 2 (two) working days subsequent.
    9. Vodacom shall request the winner’s/winners (as may be applicable) consent in writing to their image and/or likeness being used and published by Vodacom in connection with the Competition for a period of 12 (twelve) months after they have been announced as the winner. The winner may decline the use of their image and/or likeness by Vodacom.

    Prize Delivery and forfeiture

    1. Based on the nature of the Prize for this specific Competition – being the 2025 Pre-Season Fan Tour Package, delivery of the different elements of the Prize may take different forms. Vodacom and/or its Agent will determine the mode of delivery of the Prize Package or the elements thereof at its discretion and will communicate it accordingly. Aspects may require electronic and/or physical delivery and/or physical collection (e.g. flight tickets, accommodation vouchers, etc.). This will be communicated to the winner, who must take note of and respond to the relevant communications, requests, requirements, and/or instructions timeously and as stipulated in/required/within the timeframes required by correspondence/communications from Vodacom or its agent. Failure to do so will result in disqualification or Prize forfeiture.
    2. Failure to provide any and all information required by Vodacom or its agents, in relation to the necessary arrangements for the Pre-Season Fan Tour, or to provide such required information within any stipulated timeframes may result in the forfeiture of the Prize.
    3. If a selected winner does or omits to do anything that results in them not receiving the necessary travel documents in time, their Prize will be forfeited and no alternative offered.
    4. If a selected winner does not for any reason receive their passport or the required travel documents or visa in time, or should a passport or visa application be declined (with or without any fault on the winner’s or Vodacom’s or its Agent’s part), the Prize will be forfeited and no alternative/replacement prize offered.
    5. Should Vodacom or its agent/Openfield not be able to fulfil their obligation in delivering the Prize to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s), the winner(s) inability to receive the Prize, lack of cooperation by the Winner, delays in providing necessary information, or the failure of the winner to adhere to requests related to the arrangements for the Pre-Season Fan Tour, the Prize will be forfeited – which will be determined at Vodacom’s or its Agent’s discretion.
    6. In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Vodacom will share personal details of the respective winners, such as name and surname, and contact number, with a Vodacom-approved third agency, Openfield Marketing, for distribution of the Prize items, and by participating in the Competition, entrants/participants agree to such disclosure as is necessary to effect Prize fulfilment.
    7. If a winner cannot accept a Prize for any reason whatsoever, or if Vodacom or Openfield are unable to deliver the Prize for whatsoever reason (including the reasons mentioned above), the Prize will be awarded to the next selected eligible entrant.
    8. Insofar as relevant, all risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Vodacom’s obligations regarding the Competition and Prizes shall terminate on delivery.

    Additional Competition-specific Conditions

    1. Should a winner be arrested, detained in any way, or subject to any investigation, or legal action during the Pre-Season Fan Tour, Vodacom or its Agent will not be held responsible for any associated costs or actions taken. All costs resulting from such incidents (legal, travel, accommodation changes, etc.) will be borne by the individual who indemnifies Vodacom and its Agents against any loss or harm.
    2. Winners may not alter, amend, adjust, or extend the pre-determined itinerary or travel arrangements. At the end of the Pre-Season Fan Tour, should the winner wish to extend their stay, they will be liable for all and any associated costs, including the costs of amending existing travel arrangements.
    3. No additional guests may accompany the winner. Participation is non-purchasable and strictly for selected winners.
    4. Winners must arrange for their own leave from their place of employment or related arrangements to be available to join the 2025 Pre-Season Fan Tour at the determined dates. If a winner is unable to arrange leave, unavailable, or unable to attend during those dates for any reason the Prize will be forfeited.
    5. If a winner cancels or wishes to return within seven (7) days of departure (for any reason), they will forfeit the Prize and be liable for the full cost of the Pre-Season Fan Tour. By accepting these Terms and Conditions, Winners indemnify Vodacom and its Agents accordingly.
    6. If a winner loses their passport or any necessary travel documents during the Pre-Season Fan Tour and it requires replacement, the winner will be liable for all related and consequential costs, including any changes to flights, accommodation, and transport.
    7. Code of Conduct
      • The selected Winners agree and undertake to sign an indemnity and a formal Code of Conduct that will be issued to all winners and must be signed before departure and when requested to do so by Vodacom/ its Agent.
      • Refusal to sign the Code of Conduct or required indemnity within the requested time will result in the forfeiture of the Prize. The terms of the Code of Conduct may include the below aspects:
        • Respectful Representation: Winners are expected to behave respectfully at all times during the Pre-Season Fan Tour, including in transit and during their stay in the foreign country/ies. Any inappropriate, offensive, or disruptive behaviour will not be tolerated.
    • Compliance with Laws and Regulations: All winners must adhere to the applicable laws and regulations, including those of South Africa, the host country, and applicable during transit, at all times. This includes, but is not limited to, customs, drug and alcohol laws, and travel protocols.
    • Alcohol Consumption and Substance Use: Excessive alcohol consumption, public intoxication, and any use of illegal substances are strictly prohibited and will result in immediate removal from the Pre-Season Fan Tour, at the winner’s own cost.
    • Team and Staff Interaction: Winners must engage with Orlando Pirates and Kaizer Chiefs players and staff respectfully and within the limits set by the Pre-Season Fan Tour organisers. Any inappropriate requests, harassment, or breach of boundaries will result in immediate removal from the Pre-Season Fan Tour.
    • Confidentiality and Media Sharing: Winners must not disclose any confidential information they may be exposed to during the Pre-Season Fan Tour. Social media posts must align with Vodacom’s brand guidelines and should not include offensive or misleading content.
    • Punctuality and Participation: Winners are expected to attend and be punctual for all scheduled activities.
    • No Guests Allowed: Only the selected winners are allowed to participate in the Pre-Season Fan Tour. No guests or companions are permitted, even at the winner’s own expense.
    • Vodacom (including its Agents or Partners in respect of the Pre-Season Fan Tour) reserves the right to have a winner removed from an event or the Pre-Season Fan Tour at any time should the behaviour or language of such winner, at the discretion of Vodacom (its Agent’s or Partners), be considered inappropriate or should it constitute harassment or offensive behaviour, including behaviour or language that is discriminatory or hateful on grounds such as race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth.
    • Vodacom (including its Agents or Partners) reserves the right to remove any winners from an event or the Pre-Season Fan Tour at any time should their behaviour be considered to be dangerous to themselves or any other person or contravening any applicable health and safety or other legal requirements.
    • Any contravention or breach of any of the above aspects, these Terms and Conditions, or the terms of the signed Code of Conduct or related documents, will result in the forfeiture of the Prize, disqualification from any further participation or activities as part of the Pre-Season Fan Tour, and immediate removal from the Pre-Season Fan Tour at the winner’s own cost.

    Prizes are not transferable and right of admission is reserved

    1. No Prize is transferable or exchangeable and may not be redeemed by, transferred, or given to another person.
    2. No Prize can be redeemed for cash and may not be sold.
    3. Vodacom will not transfer, allocate, or assign a Prize to someone else if requested by the winner.
    4. Where a Prize is for an event(s) and / or experience(s):
      • It is restricted to the winner(s) of the Prize only. No additional guests will be allowed to enter or have access to the event(s) and / or experience(s);
      • Right of Admission to the event(s) and experience(s) is reserved by Vodacom, its Agents or Partners in respect of the event or experience;
      • Vodacom (including its Agents or Partners in respect of the event or experience) reserves the right to have a winner (and their partner and / or guest – only when applicable) removed from an event at any time should the behaviour or language of such winner or guest, at the discretion of Vodacom (its Agent’s or Partners in respect of the event or experience), be considered to constitute harassment or be inappropriate, including behaviour or language that is discriminatory or hateful on grounds such as race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth; and
      • Vodacom (including its Agents or Partners in respect of the event or experience) reserves the right to remove any winners (and their partner and / or guest– only when applicable) from an event at any time should their behaviour be considered to be dangerous to themselves or any other person or contravening any applicable health and safety requirements.

    Undertakings, limitation of liability, and indemnification

    1. Event(s) and/or experience(s), to which the Competition Prize relates, may be hosted by third parties (for example, at sport stadia, theatres, convention or other centres, hotels, or modes of transport owned by other entities). Winner(s) agree to comply with the rules and regulations applicable to events held at such premises upon entry, and as may be stipulated by the owners of such premises.
    2. Entry to any events, experiences, and venues (including hotels and transport services) in respect of which Vodacom may give away prizes as part of competitions on its platforms, are bound and regulated by specific event or venue-related rules and regulations, which may be determined by event or venue owners or relevant governing bodies. By participating in this competition, Competition Participants:
      • acknowledge and agree that they are bound by such event, experience, or venue rules upon entry to such premises, event or experience;
      • undertake to adhere to and comply with any and all reasonable event, experience, or venue rules and/or regulations; and
      • indemnify Vodacom, its agents, or employees from any liability associated with Competition participants/winners failure to adhere to such rules and regulations and any damages that occur as a result.
    3. Vodacom, its associated companies, partners, agents, contractors, sponsors, and personnel involved in or associated with the Competition, or a related event or experience shall not be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition, from claiming the Prize, or attending an event or experience forming part of the Prize.
    4. Vodacom (including its Agents or Partners in respect of the event or experience) is not liable for any technical failures affecting participation and/or Prize redemption process of the Competition. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participation in and/or the Prize redemption process of the Competition.
    5. Vodacom (including its Agents or Partners in respect of the event or experience) cannot and will not be held liable should it be impossible for it to deliver the Prize or to fully perform, execute or fulfil the Prize. Should the Prize be linked to a specific fixture, match, event or experience, and should that specific fixture, match, event, or experience be cancelled, interrupted, postponed, or otherwise affected by events or factors outside of Vodacom’s control or at Vodacom’s discretion, Vodacom cannot be held liable for the fulfilment of the Prize or be required to provide an equivalent or replacement Prize.
    6. Vodacom retains the discretion to cancel the Competition at any time, including after winners have been selected, for any reason, be it practical, budgetary, operational, or other reasons. In such an event, Vodacom will not be liable and will not offer any replacement prize.
    7. Vodacom, its directors, employees, agents and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any Prize nor in respect of any warranties, guarantees or undertakings given by any person other than Vodacom itself.

    Personal information and permission to receive marketing and promotional information

    1. User data collected via the Competition will not be used for any other purpose than for the execution of the Competition, delivery of the Prize, and/or for the sharing of related marketing and promotional information.
    2. User data collected via entry for this Competition will be stored for as long as it is legally required to and in accordance with Vodacom’s Privacy Policy, http://www.vodacom.co.za/vodacom/terms/privacy-policy.
    3. By entering this Competition, entrants/participants give Vodacom permission to send them information and instructions regarding the Prize and related arrangements, marketing or promotional information about Vodacom products, services and other Competitions, and consent to their name, contact number, and/or email address being shared with official Partner/s in the campaign to which the Competition relates, for Prize delivery, marketing or promotional purposes.
    4. The entrant(s) will be given the option to opt out of receiving marketing or promotional information via the platform from which they receive such information.

    General

    1. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant/participant or the promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
    2. In the event of a dispute in regard to any aspect of the Competition and/or the Terms and Conditions, Vodacom’s decision will be final and binding, and no correspondence will be entered into.
    3. Vodacom may, at its discretion, refuse to award a Prize if entry procedures or these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices.
    4. If Vodacom is required to alter or cancel any aspect of the Competition or to terminate it by law, as a result of changes in legislation, or for any reason whatsoever, it has the right to terminate the Competition, with immediate effect and without notice. In such event, all entrants/participants waive any rights they may have against Vodacom and its associated companies, agents, contractors, official Partners and/or sponsors.
    5. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

    Vodacom Golf Day Experiences Competition

    Terms and Conditions

    Vodacom (Pty) Ltd (“Vodacom”) is running the Vodacom Golf Day Experience(s) (the “Competition/s” as relevant), on Vodacom’s official social media and digital platforms and any third-party partner social media and digital platforms.

    These are the Standard Competition Terms and Conditions and comprise Part A (which contains the Competition-specific information) and Part B (which contains general terms and conditions that apply to all competitions). In the event of any conflict, the terms and conditions of Part B prevail.

    By entering and/or participating in this Competition, entrants/participants opt into, agree, and consent to be bound by the Terms and Conditions (comprising Part A and Part B) stated below.

    Part A: Competition-Specific Terms and Conditions

    Competition Duration

    1. The Competition period/duration is from:
      • Start date: 09h00, Tuesday 1 July 2025
      • End date: 23h59, Tuesday 30 June 2026.
    2. Prize Draws are specific golf day and date related and will be done before the relevant match for each Competition or as communicated via social media platforms.

    Competition Prize/s

    1. The Competition Prize comprises of is: 1 (one) playing spot in the specified golf day as specified on Vodacom’s official social media and digital platforms and any third-party partner social media and digital platforms
      • Total number of Prizes: The total number to be determined per competition; and the Total number of prize winners may vary based on Vodacom’s discretion.
      • Value of the Prize(s) (per Prize): a maximum value R 3000 (three thousand Rand) per person (not transferable and not exchangeable or refundable).
      • The Prize includes a Golf round at the specified golf course, any gifts as provided either by Vodacom or the organisers of the event, any food and beverage as provided either by Vodacom or the organisers of the event at the discretion of Vodacom or the organisers.
      • The Prize excludes any and all travel to attend the event/golf day and any other costs which may be incurred by the winner to attend the event that falls outside elements provided as part of the prize.

    Eligibility

    1. The Competition is open to Vodacom Red customers (at a postpaid package price point, i.e. entry can only occur after more than one billing cycle as a Red customer), who have been Vodacom customers for an uninterrupted period of 24 (twenty-four) months or longer and who entered via Vodacom and/or other third-party social media and digital platforms, who completed the competition form, or other stipulated requirements for entry as specified for the Competition. 
    2. Eligible entries will be put into the draw and through the process of a randomiser (selected at random), the winner will be selected.
    3. Participants are allowed to enter a Competition once per day during the Competition period or as specified in the relevant social media campaign posts.

    Prize Delivery

    1. The general provisions of Part B, in clauses 33 to 45 below, will apply.

    Part B: General Competition Terms and Conditions

    In addition to the Specific Competition Terms and Conditions outlined in Part A above, the following General Terms and Conditions apply to the Competition.

    Duration

    1. The duration of the Competition (as stipulated in Part A above) may be extended, curtailed or cancelled at the discretion of Vodacom.

    Prize

    1. Vodacom has the right to change the type and quantity of prize/s (described in Part A above) to determine the value of the Prize/s or to substitute it at their discretion.

    Eligibility

    1. Only entries received during the Competition period (as stipulated in clause 1 in Part A above) will be eligible entries.
    2. The Competition is only open to natural persons. Entries received from business accounts held by legal persons (amongst other Corporates and SMEs, etc.) are excluded and not eligible to participate in the Competition.
    3. The competition is open to South African Residents over the age of 18 who are in possession of a valid identity document.
    4. Only entrants/participants who are using SIM cards that have been RICA (Regulation of Interception of Communications and Provision of Communication-Related Information Act) registered are eligible to win the Competition. Each owner of a SIM card(s) is responsible for complying with South African law by RICA registering their SIM cards.
    5. Unless otherwise stipulated, employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates, and any person directly involved with the sponsoring, devising, production, management, or marketing of this Competition are not eligible to participate in this Competition.
    6. Entrants/participants must reside in South Africa and be in possession of a valid South African identity document or permanent residence permit or temporary residence permit valid for a period exceeding 3 (three) months for the Republic of South Africa and valid for the Competition duration, and provide a copy of such an identity document to Vodacom on request - failing which eligibility to win is forfeited.
    7. Entrants/participants are only eligible if they have not won a Vodacom competition during 6 (six) months preceding this Competition. The 6 (six) months calculation will start from the date that Vodacom fulfilled the Prize in the preceding Competition.
    8. In the event that the user of the mobile phone (i.e., the entrant/participant in the Competition) is not the person that is responsible for payment of the participating mobile phone account/ charges, then the Prize will be awarded to the person that is responsible for payment of the participating mobile phone account/ charges.
    9. Vodacom customers who are not in good standing with Vodacom, or are involved in any legal process with Vodacom, or are in arrears with their accounts are not eligible for this Competition.

    Valid Entry

    1. A Valid Entry must comply with the Competition requirements as stated or described, including as above or on the platforms (social media or other – as selected by Vodacom in its discretion), and which competition requirements may include prompts or instructions for participating in the Competition, (e.g., voting for something, selecting or identifying something or other stated requirement), and/or by completing any required entry forms.
    2. Qualifying entrants/participants must complete all the required information on the Competition entry form or platform, which can be found via Vodacom’s social media platforms during the period of this Competition.
    3. Responses directly or via direct messages on any social media platform will not be considered valid entries.
    4. Only correct answers or a correct sequence of answers will be accepted and eligible to be selected as a winner at Vodacom’s discretion.
    5. Unless otherwise stipulated in or required by the entry requirements, there are no additional charges for participating in the Competition. In respect of online entries, standard data costs may apply to uploading a valid entry online, as may be applicable. Standard data costs apply as per the user’s Service Provider and existing price plan for data usage and are subject to the applicable Terms and Conditions of that service.
    6. Vodacom shall not be liable for any costs incurred by the winners for entering the Competition or claiming any prizes. 
    7. Data transfer speeds are not guaranteed and are dependent on network availability and utilisation.
    8. Vodacom (or its Agent) retains the right to determine, at its sole discretion, if entrants/participants meet the stipulated eligibility criteria, criteria for a valid entry, competition requirements, and may be eligible to win a prize based on the Competition requirements.
    9. Vodacom (or its Agent) is entitled to, in its sole discretion, disqualify any entrant/participant from the Competition for any reason and will not be obliged to notify entrants/participants of such disqualification.

    Prize Draw and/or winner selection

    1. The winners of the Prize will be randomly selected from all eligible entries who meet all the requirements set out in these Terms and Conditions, and will be selected at Vodacom’s discretion.
    2. The verified winners will be notified within (2) two days after he/she has been selected and verified as a winner or within one (1) hour after being selected and verified as a winner.
    3. The decision of the judges (who draw the prizes or decide the winners, as appointed by Vodacom at its sole discretion) on any aspect of the Competition, including the award or allocation of the Prizes, will be final and binding and no correspondence will be entered into.

    Winner Validation

    1. All the information provided or related to this Competition shall be managed, captured, and approved by Vodacom.
    2. Vodacom will share personal details of the respective winners, such as name and contact number, with a Vodacom-approved third-party agency, Openfield Marketing, who will notify the respective winners that they have won in the Competition, and by participating in the Competition, entrants/participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
    3. Vodacom and Openfield Marketing will use reasonable efforts to contact the winners via direct messaging on their social media profile, email, or telephonically as may be applicable on the contact details provided by the entrants/participants to participate in the Competition.
    4. Vodacom and Openfield Marketing shall attempt to contact the winners for a period of 2 (two) normal working weekdays after their names have been drawn and verified as winners. The winners will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winners will be advised of arrangements in respect of Prizes at the time of contacting the selected winners.
    5. Should an entrant/participant not be available, or should Vodacom or its Agent be unable to reach that participant for any reason whatsoever, on the contact details provided during the timeframe stipulated above or of the Participant rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived and forfeited. Vodacom reserves the right at is sole discretion to then award the Prize to the next randomly drawn entrant/participant.
    6. The claim for any Prize will be subject to security and validation, and Vodacom reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winners must be able to identify themselves, in a manner determined by Vodacom, as the qualifying entrants/participants to the Competition and have to comply with the required validation procedure, determined by Vodacom, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
    7. Notwithstanding the fact that the Prizes vest in the winners immediately upon the determination of the results, in the event that the required information, documentation or verification from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winners to make special arrangements to meet the deadline set by Vodacom, such Prize will be forfeited. Vodacom then reserves the right to award the Prize to the finalist that is next in line.
    8. The winners’ name and location may be displayed on www.vodacom.co.za/competition_winners after a period of 2 (two) working days subsequent.
    9. Vodacom shall request the winner’s/winners (as may be applicable) consent in writing to their image and/or likeness being used and published by Vodacom in connection with the Competition for a period of 12 (twelve) months after they have been announced as the winner. The winner may decline the use of their image and/or likeness by Vodacom.

    Prize Delivery

    1. The following general conditions apply to the delivery of Prizes.
    2. Vodacom and/or its Agent will determine the mode of Prize delivery at its discretion.
    3. If the method of Prize delivery is identified in Part A above, the clause applicable to that method of delivery as detailed more fully below will apply:
    4. In the event of a Prize requiring physical delivery - delivery will take place via courier at dates, times and places arranged between Openfield and the winner(s). The winner must provide a correct address for delivery. Delivery may only be possible during weekdays (Monday – Friday) between 09h00 – 17h00, and not on Saturdays, Sundays, and public holidays. If the winner is not home for courier or delivery, or the address cannot be found, the winner will be offered one more opportunity to provide an accessible address for delivery and to be available for such delivery; if delivery is still not possible or Vodacom’s Agent is unable for any reason whatsoever not to effect delivery, the Prize will be forfeited.
    5. In the event of a Prize requiring physical collection – Vodacom or Openfield Marketing will communicate the address and location where and hours when the Prize can be collected by the winner(s). Neither Vodacom nor Openfield shall be held liable should the winner(s) be unable to collect the Prize. Prize/s must be collected by the winner/s within 10 (ten) working/business days from the announcement and notification of the winners, failing which the Prize will be forfeited.
    6. In the event that a Prize can be sent electronically via email, a valid email address must be provided by the winner. If Vodacom or Openfield has sent the email containing the electronic Prize to the email address provided, delivery thereof will be deemed to have taken place. Neither Vodacom nor Openfield will be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.
    7. In the event of data and/or airtime Prizes, all data Prizes will be allocated to the winners within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the Vodacom MSISDN (cell phone number) that the data and/or airtime must be transferred to.
    8. In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification to the satisfaction of Vodacom or its Agents in their sole discretion.
    9. In the event of a Prize being an award on the VodaPay App, the winner must download the App and register on the App. Vodacom can only transfer money into the VodaPay wallet if the the winner has downloaded the App and registered on it. The cash Prize will be transferred into the winner’s VodaPay wallet within seven (7) working days after confirmation by the winner of their VodaPay details. Should the winner fail to meet the criteria for a period of ten (10) working days, the Prize will be forfeited.
    10. Should Vodacom or Openfield not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited – which will be determined at Vodacom’s or its Agent’s sole discretion.
    11. In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Vodacom will share personal details of the respective winners, such as name and surname, and contact number, with a Vodacom-approved third agency, Openfield Marketing, for distribution of the Prize items, and by participating in the Competition, entrants/participants agree to such disclosure as is necessary to effect Prize fulfilment.
    12. If a winner cannot accept a Prize for any reason whatsoever, or if Vodacom or Openfield are unable to deliver the Prize for whatsoever reason (including the reasons mentioned above), the Prize will be awarded to the next selected eligible entrant.
    13. All risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Vodacom’s obligations regarding the Competition and Prizes shall terminate.

    Prizes are not transferable and right of admission is reserved

    1. No Prize is transferable or exchangeable and may not be redeemed by, transferred, or given to another person.
    2. No Prize can be redeemed for cash and may not be sold.
    3. Vodacom will not transfer, allocate, or assign a Prize to someone else if requested by the winner.
    4. Where a Prize is for an event(s) and / or experience(s):
      • It is restricted to the winner(s) of the Prize only. No additional guests will be allowed to enter or have access to the event(s) and / or experience(s);
      • Right of Admission to the event(s) and experience(s) is reserved by Vodacom, its Agent’s or Partners in respect of the event or experience;

    This privacy supplement explains how VODACOM and OnMobile processes your personal information for the Dr Tumi Celebrity Connect subscription service hosted on https://drtumi.celebrityconnect.co.za (the "Service").     • VODACOM and OnMobile will collect and process personal information when you subscribe to the Service. In this regard and notwithstanding the rest of this privacy supplement, Vodacom will process your MSISDN in order for your subscription to be added to your bill issued by Vodacom.
    • We may also collect anonymous analytics information on how potential customers use the Service in order to improve the Service and troubleshoot. We use a variety of analytics methods including what is commonly referred to as "Big data analytics". Big data analytics are mathematically driven analysis techniques on large and varied data sets (that is why it is "big" data) to uncover hidden patterns and hitherto unrevealed trends. 
    • We use our analytics to, for example:
      • Conduct market research and to carry out research and statistical analysis, including to monitor how customers use our networks, products and services; and
      • Frame our marketing campaigns and determine how we might personalise those.
    How we use your personal information

    VODACOM and OnMobile processes and discloses your personal information for specific and limited purposes. These include:
     

    • Processing MSISDN / account details to facilitate the subscription to the Service.
    • Processing of personal information to assess and handle any customer queries, to develop and improve our products, services, communication methods and the functionality of the Service.
    • Once registered on the Service, we may contact you to keep you informed about new and existing products and services, competitions, prize draws and other promotions and we may use your personal information to run those competitions, prize draw, events and promotions, only to the extent that you have not, at any stage, objected to receiving such marketing communications.  We will provide you with an opportunity to Opt-Out of any further direct marketing activities at each instance you are contacted. 
    • If you have given your permission, we will also contact you to let you know about products and services of Vodacom Group companies including Vodacom, Vodacom Insurance Company Limited and Vodacom Life Assurance Company Limited products and services and those of other companies which we think may interest you.
    Where applicable, VODACOM and / or OnMobile will share information about you with:

    VODACOM and/or OnMobile may also transfer and disclose your personal information to third parties who may process information on our behalf:

    What about the security of your personal information?
    • VODACOM and OnMobile takes the security of your personal information very seriously. We takes every effort to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure.
    • Our measures include implementing technology, policies and processes aimed at protecting the confidentiality, integrity and availability of your personal information. We will update and refine these measures on an ongoing basis. 
    • Access to your personal information is only permitted among our employees and agents on a need-to-know basis and subject to strict contractual confidentiality obligations when processed by third parties.
    How long we keep your personal information for?

    We may not retain your personal information any longer than is necessary for achieving the purpose for which your personal information was collected or subsequently processed.  We will keep the personal information for a period which enables us to handle or respond to any complaints, queries or concerns relating to the Service, unless:

    • The retention of your personal information is required or authorised by law.
    • We reasonably require your personal information for lawful purpose related to our function or activities.
    • The retention of your personal information is required by a contract that we enter into with you.

    Communications over the internet (such as emails) aren't secure unless they've been encrypted. Your communications may go through a number of countries before being delivered, as this is the nature of the internet.

    We cannot accept responsibility for any unauthorised access or loss of personal information that is beyond our control.
    We’ll never ask for your secure personal or account information by an unsolicited means of communication. You're responsible for keeping your personal and account information secure and not sharing it with others.

    Our website and / or the Service may provide links to third-party websites or services. We cannot be responsible for the security and content of such third-party websites or services. You are therefore required to make sure you read that company's privacy and cookies policies before using or putting your personal information on their site or service.

    The same applies to any third-party websites or content you connect to using our products and services.

    You have the right, in certain circumstances, to object to VODACOM / OnMobile processing your personal information.     Under certain circumstances, you have the right to object to certain types of processing, including processing for direct marketing (i.e., receiving emails or SMS from us notifying you or being contacted with varying potential opportunities).     The Fuse Privacy Supplement

    The FUSE is a free news and information based service that is provided by Vodacom (Pty) Ltd ("Vodacom"; "us"; "we"; "our") in conjunction with its appointed service provider Njuice AB (T/A SQUID), a Swedish company with company registration number 556801-9201, ("Njuice") that is based in Stockholm. 

    This Privacy Supplement aims to inform you about what kind of personal data that might be processed when you use the THE FUSE News App (the "App Service"), the THE FUSE Web Service (the "Web Service") or THE FUSE News Feed (the "News Feed Service") (together the "Services") and the purpose therefore. This Privacy Supplement is intended to supplement and / or enhance Vodacom's existing Privacy Policy available on its website.     Performance of a Contractual Obligation:

    We process your personal data to the extent necessary as a part of our contractual obligation to provide you with the Services. For example, providing you with news within your selected topics of interest.

     

    Legitimate interests:

    In limited instances, we may process some of your personal data to fulfil both our and your legitimate interests. In this regard, certain sets of personal data will be processed to analyze user behavior to improve and optimize the Services and / or your use thereof. However, in any instance where 'legitimate interests' are used as a lawful basis for processing personal data, we will analyse the impact that such a processing activity may have on you and your rights under POPIA or another applicable law. For example, we have made efforts to minimize the collection and storage of any information derived from your usage of the Services. Vodacom and its appointed service providers do not track the activities taken of a device with a certain IP-address. Instead, each user is assigned a pseudonymized ID which is used to deliver the Services.

     

    Consent:

    To the extent that you have provided your consent for the use and storage of your personal data, we rely on your consent for such use and storage of your personal data.

     

    Legal obligation:

    We may process your data if it is necessary for us to comply with a legal obligation, for example complying with a court order to disclose certain information.

    Types of information collected and for what purpose

    Purpose of the processing

    In order for the Services to work effectively and to constantly improve same, we will be collecting different kinds of personal data from you to enable us to: (a) administer the Services, (b) help us understand how to improve and optimize the Services in future updates, (c) customize the Services to your interests and needs, (d) reply to you if you contact us with feedback, comments or concerns, (e) provide maintenance and technical support and (f) provide advertising based on your preferred news topics, (g) provide you with more information if we think it necessary.

    We collect the following information from you:

    • Your preferred settings in the Services, such as information concerning the type of news feeds you selected and subsequent amendments. This information is stored dynamically, so as soon as you adjust any settings, the information stored is changed.

    • Any personal data, such as your name, e-mail address, phone number etc. that you provide to us by using the Services' feedback functions.

    Information collected via technology

    Some information is provided to us by your device when you use the Services. We also collect information on how you interact with the Services.

    Information we collect from your device is information such as:

    • Date and time that you downloaded the Services

    • Type of device that you are using and the operating system of that device (i.e., what Android or IOS version you are using)

    • Country and language settings on your device

    • Network type used (including information on network provider or wifi)

    • Application type, i.e., what service you are using, such as browser or widget.

    • What articles you read, save, and share.

    • Time spent when visiting our services and reading articles.
    • When you access our Services for the first time, we use the IP-address or other type of identifiers assigned to your device to create an anonymous ID. This ID is used for communication with the Services and tracking of your usage of the Services, which includes what news topics you are interested in.
    Disclosure of personal data

    Where applicable, we may share information about you with:

    • Companies in the Vodacom and Vodafone Group, located across the globe, including but not limited to in the European Economic Area (EEA), Egypt, India and the US, for reporting purposes and where they are involved in providing products and services that you have signed up for

    • Companies who are engaged to perform services for, or on behalf of, Vodacom Group Limited, Vodafone Limited, or Vodafone Group which companies may be located outside of the borders of South Africa

    • Law enforcement agencies, government bodies, regulatory organisations, courts or other public authorities if we have to, or are authorised to by law

    • A third party or body where such disclosure is required to satisfy any applicable law, or other legal or regulatory requirement

    • Third parties that we advertise with, in order to serve you advertisements online (e.g. Facebook, Google). You can opt-out of this by managing your account / cookie permissions

    Social Network Services ("SNS")

    Some of the features the Service offers require the connection to SNSs (e.g., Facebook, Twitter, etc.). If you decide to use these features and share an article on any of the SNS connected to the Services, we will provide the requested article to the selected third party SNS provider. Please note that when you share an article on an SNS, terms of use and privacy policies of that particular SNS apply.
     

    Transfer of personal data

    Our processing of identifiable personal data is primarily carried out within the borders of South Africa.
    However, if such transfer is necessary, we will ensure that a similar or materially similar degree of protection is afforded to you as may be provided for under POPIA and or the applicable data protection legislation.

    Data Retention

    We will not retain personal data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable law or regulations. Information which has been anonymized may be stored for a longer time. Yet, some information in non-personally identifiable form may still be available for the Services in the archives. Personal data that you provide to us by using the Services feedback function will be erased following a period after the matter has been completed.

    Note about children

    It is not our intention to collect personal information from users who are under the age of 18. However, if personal information of a child under 18 is collected in our Services and we learn about it, we will attempt to delete all information about the child as soon and effectively as possible.
