Important to note: Your use of the Website and Mobile App is subject to these Website and Mobile App terms and conditions, as amended from time to time. You must read these terms and conditions carefully before using this Website and Mobile App as your continued use of this Website and Mobile App will signify that you have accepted them.

Pay special attention to parts in bold as they bear consequences to you using our Website and Mobile App.

Introduction

  1. Thank you for visiting our Website and Mobile App. Whether you are a guest or a registered e-wallet user, these terms and conditions will apply to you. The use of our Website and Mobile App includes assessing, browsing, linking or downloading any information made available on our Website and Mobile App and using any of our services made available on our Website and Mobile App. 

  2. Ithuba Holdings (RF) (Proprietary) Limited ("ITHUBA"), being the third official National Lottery Operator in South Africa, brings you, the Participant, a range of various National Lottery games that can be purchased from our authorised Retailers, via www.nationallottery.co.za and other digital platforms, such as the internet and cellular technology, in accordance with these terms and conditions (the "Terms and Conditions"). Without limitation, these Terms and Conditions shall be read together with all applicable South African legislations, such as the Protection of Personal Information Act No. 4 of 2013, Electronic Communications and Transactions Act No. 25 of 2002, Financial Intelligence Center Act No. 38 of 2001 ("FICA"),Consumer Protection Act No. 68 of 2008, Lotteries Act No. 57 of 1997 (the "Act"), each National Lottery game rules and regulations (the "Rules") and the General terms and conditions applicable to each National Lottery game, in force from time to time (collectively referred to as the "T's & C's"). The T's & C's constitute the entire agreement between you and ITHUBA with respect to the use of the Website and Mobile App, services and its content. 

  3. If these Terms and Conditions (or any document referred to therein) or the services provided and/or made available on the Website and Mobile App are regulated by or subject to the Consumer Protection Act, as may be amended from time to time, it is not intended that any provision of these Terms and Conditions contravene any provision of the Consumer Protection Act. Therefore, all provisions of these Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the provisions of the Consumer Protection Act are complied with. 

  4. For the purposes of obtaining information on the National Lottery and ITHUBA in terms of the Electronic Communications and Transactions Act No. 25 of 2002 and the Promotion of Access to Information Act No. 2 of 2000, please see our contact details on our Website, Mobile App and at www.ithubalottery.co.za

  5. The Rules and the general terms and conditions applicable to each National Lottery game are available on https://www.nationallottery.co.za/ (the "Website" or "Site") and Mobile App and it is important that you understand that when you participate in the National Lottery, you concordantly agree to abide by the T's & C's. Each e-wallet user needs to accept the T's & C's, failing which he/she may not register and/or use any of the services provided by ITHUBA.

  7. You may not access the Website and Mobile App or use any of our services if you are younger than 18 years old and/or do not have legal capacity to conclude legally binding contracts. 

  8. The Website and Mobile App is not targeted at children under the age of 18. We will not knowingly collect information from persons in this age group. We encourage parents to talk to their children about the use of the Internet and information they disclose on the websites. Furthermore, we encourage parents to be the ones that use our Website (being of and above 18 years). 

  9. The T's & C's constitute the entire agreement between you and ITHUBA with respect to the use of the Website and Mobile App, services and its content. By accessing our Website and Mobile App or using our services, you are regarded as having read and agreed to these T's & C's. 

Exclusion of Liability/Disclaimer 

  1. ITHUBA shall endeavor to provide accurate and up to date information on the Website and Mobile App. However, it is important to note that neither ITHUBA, the National Lotteries Commission ("NLC") nor any of their employees, agents, contractors, directors, assigns and associates (collectively referred to as "Representatives") make any representations or give any warranties, whether expressly, tacitly or implied, as to the operation of the Website and Mobile App, the information, content, materials and products that are included and available on the Website and Mobile App. 

  2. The information provided on the Website and Mobile App is provided "as is" and your use of and reliance on the information on the Website and Mobile App (including its online/e-wallet services) is entirely at your own risk. 

  3. ITHUBA, the NLC or their Representatives shall not be liable for any loss or damage of whatsoever nature and howsoever occurring, arising or resulting from the use of or inability to use the Website and Mobile App or the information contained herein, including but not limited to direct, indirect, incidental, punitive and consequential loss or damage. ITHUBA reserves its right, in its sole and absolute discretion, to add or correct any errors or omissions in any portion of the Website and Mobile App without any notice of any kind been given to you. 

  4. ITHUBA shall have no liability of whatsoever nature for any breach of these Terms and Conditions due to any cause beyond its reasonable control including but not limited to: an act of nature (including inter alia weather, lack of electric supply, flood and lightning), technical issues (including inter alia server operation interruption, telecommunication interruptions, breakdowns, power failures and other interruptions), fire, industrial action, act or omission of Government, or other competent authority, riot, war or act or omission of any third party. 

  5. To the fullest extent permissible pursuant to applicable law, ITHUBA disclaims any and all warranties, whether express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. ITHUBA does not warrant the accuracy, completeness or usefulness of any information contained on the Website and Mobile App. ITHUBA does not warrant that the functions contained in the materials available through the Website and Mobile App will be uninterrupted or error-free, that defects will be corrected, or that the materials, Website and Mobile App or the server that makes them available are free of viruses or other harmful components. Under no circumstances, including, but not limited to, negligence, shall ITHUBA be liable for any special or consequential damages that result from the use of, or the inability to use the Website and Mobile App or any transferred funds and playing the National Lottery games, even if ITHUBA or their Representatives have been advised of the possibility of such loss or damage. In any event and as may be ordered by a competent court, ITHUBA's total direct liability to you for any and all damages, losses, and causes of action (whether in contract, delict or otherwise) shall be limited to the amount that you have paid to play the particular National Lottery game or the amount that you have deposited into ITHUBA's bank account, if any, for the National Lottery games purchased on the Website and Mobile App. 

National Lottery Game Rules 

  1. In addition to the T's & C's, you must be at least 18 years of age to purchase any National Lottery game and to qualify for any prize resulting therefrom. 

  2. In order to participate in the National Lottery game, you may purchase such at any of our retail outlets, available alternate channels or you can register on https://wallet.nationallottery.co.za/ or our Mobile App. 

Online Play - Registration 

  1. To register online, we require you to provide the following information:
    • First Name;

    • Surname;

    • South African identity number; and

    • South African cellphone number. 

  2. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration process. ITHUBA will therefore place reliance on the information that you have provided as true, accurate, current and correct. As a result, it is your responsibility to ensure that you maintain and promptly update your information, from time to time, to keep it true, accurate, current and complete, and to acquaint yourself and to comply with the relevant laws and Rules for playing the National Lottery games, in force from time to time. ITHUBA reserves the right to verify the eligibility of all entrants. Should you provide any information that is untrue, inaccurate, not current or incomplete, or ITHUBA suspects that such information is untrue, inaccurate, not current or incomplete, ITHUBA will in its sole discretion exercise its right to remove and discard any information gathered from you, and refuse you any and/or all current or future use of the Website and Mobile App (or any portion thereof). Any person supplying false or misleading information, including but not limited to, telephone number, identity number, fax, email, postal or street address, name, bank information or the like, will forfeit any prize/s won through the National Lottery without notification. All ITHUBA's rights are hereby strictly reserved. 

  3. Players are only permitted one account and are specifically prohibited from opening multiple accounts in the name of or on behalf of other persons. 

  4. Personal details required to be provided during the registration process will be kept confidential and shall not be disclosed to any third party, without your prior consent. By providing personal information, you agree that we may electronically store, process and use the information for purposes stated therein when you opt-in to receive any communication from us. 

  5. When you access the Website or Mobile App, certain usage details may be automatically collected and recorded by us from your system by using different types of tracking technology. We may use the information to monitor the aggregate website and Mobile App usage metrics such as the total number of visitors and pages accessed as well as track your entries, submissions and status in any promotions or other activities in connection with your usage of the Website and Mobile App. ITHUBA may, in its absolute and sole discretion, refuse or cancel your registration or refuse to permit any further participation in https://wallet.nationallottery.co.za/ for any reason whatsoever. 

Online Play - E-wallet users 

  1. Once you have successfully registered your profile on the Website or Mobile App, your 'virtual wallet' will be created in which you will store your National Lottery game funds. You will be required to create a Personal Identification Number (PIN) in order to access your profile and the National Lottery wallet. You will be required to deposit your money into any of the bank account/s as per the details provided on our Website, our Mobile App or USSD. 

  2. It is important to note that the reference number for all deposits must be your registered South African cellphone number with no spaces e.g. 0820000000. In the event of a change in your registered cellphone number, please contact our call center on 0800 484 822 to update your details. 

  3. You are responsible for ensuring that we have your correct South African cellphone number and email address. ITHUBA will not be held responsible if an SMS or email is sent to the wrong number or address that you have supplied on your wallet. 

  4. The funds loaded will be credited to your virtual wallet thereafter. No National Lottery game entries will be purchased and/or processed unless there are sufficient funds in your virtual wallet. 

  5. ITHUBA will use a service provider for the processing of funds between the virtual wallet and the recipient bank account. You, as the e-wallet user, have an option to directly deposit funds into your e-wallet by making a direct deposit through your bank to your e-wallet account or make direct deposits using the services of our partner/s through our website. ITHUBA is not a registered financial service provider and shall not be responsible in any way or manner for any incorrect allocation of funds and the like that you may suffer as a result. You will only be permitted to play the National Lottery games once confirmation has been received from the relevant financial institution and/or the Payment Provider/s that funds have been successfully transferred to your virtual wallet. You will only be permitted to play any of the National Lottery games once we have sent confirmation of your payment to your registered South African cellphone number or your Mobile App messages folder. 

  6. Always ensure that you have sufficient funds in your virtual wallet to play any of the available National Lottery games. Should you not have sufficient funds, we reserve the right to deny you the right to participate in any of the National Lottery game/s. 

  7. A confirmation SMS sent to your South African cellphone number for each transaction/s completed will be charged at R0.20 (twenty cents) per transaction (or as may be amended from time to time). If transacting from the Mobile App a confirmation message will be sent to your messages folder for each transaction/s completed at no charge. 

  8. There may be other websites that are linked on our Website. Links used to access other third party websites are subject to their own terms and conditions. When using our e-wallet service to purchase any of our National Lottery games, you agree that we may also electronically collect, store and use, without limitation, your name, surname, birth date, identity number, gender, country of residence, nationality, email address and mobile number. When using the services of a third party to make deposits into your e-wallet account, you agree to abide by the terms and conditions of that service provider as may be applicable. Any content, information and materials on any third party websites are provided "as is". Your use of such third party websites is entirely at your own risk and we are not responsible to you for such use in any manner whatsoever. To the extent permissible in law, ITHUBA will not be responsible for any loss, expense, claim or damage, whether direct, indirect, consequential, and arising from your use of such third party websites or your reliance on any information provided on such third party websites. 

Online Play - General 

  1. By using the Website or Mobile App to participate in the National Lottery game/s, you understand, agree and confirm that your purchased entries into a particular Draw/s for specified amount/s and particular date/s constitutes a binding agreement in law with ITHUBA. 

  2. You may use our Website or Mobile App only for lawful purposes only. 

  3. Tickets purchased from mobi, USSD, Mobile App and the Website shall not be cancellable. 

  4. Should there be an error of any kind when using our Website or Mobile App, you are encouraged to contact our Call Centre (details on our Website, Mobile App). ITHUBA may refund an e-wallet account, should there be any error of a technical nature; provided however that there was no purchase of the ticket into our National Lottery games. ITHUBA, however, reserves the right to investigate any query or complaint made in this regard and whether or not to refund an e-wallet account. 

  5. To the extent that ITHUBA offers participation in competitions or promotions, the terms and conditions pertaining to those competitions and promotions will be available on the Website and Mobile App. Those terms and conditions shall be read together with the T's & C's. By entering or participating in the relevant competition or promotion, you agree to be bound by those relevant terms and conditions. Notwithstanding any specific terms and conditions, we specifically retain the right, at any time and without notice, to remove, alter or add to competitions or promotions on the Website without any liability to you. 

  6. When playing any National Lottery games, you do so with the acceptance and understanding that you are playing responsibly. Excessive play is prohibited and will be monitored. The maximum playing value per ticket for all National Lottery games available via the Website and Mobile App is R1,000 (one thousand rand) with the exception of:

    • LOTTO game with maximum playing value of R2, 000.00 (two thousand rand) per ticket;

    • PowerBall game with maximum playing value of R2, 000.00 (two thousand rand) per ticket;

    • SPORTSTAKE 8 with maximum playing value of R2, 000.00 (two thousand rand) per ticket;

    • SPORTSTAKE 13 with maximum playing value of R2, 000.00 (two thousand rand) per ticket; and

    • DAILY LOTTO with a maximum playing value of R150.00 (one hundred and fifty rand) per ticket.

    • For the RAFFLE game- please refer to the specific terms and conditions of the RAFFLE game.

    • For the EAZiWIN game - please refer to the Rules pertaining to the game. 

  7. It is your sole responsibility to ensure that all the details shown on the relevant electronic page (internet or cellphone) are confirmed to be true and correct before proceeding to confirm your purchase of any National Lottery game. 

Online Cash Out  

You have 2 options to redeem the funds from your virtual wallet:-

   Standard Bank ATM; or

   Transfer into a South African bank account. 

  1. Standard Bank ATM: You will be charged at the applicable transaction fee, currently of R7.00 (seven rands) or as may be amended from time to time for any 'cash out' requests conducted through any Standard Bank ATM:-

    The 'cash out' option via any Standard Bank ATM is available from Monday to Friday during the hours of 08h30 to 16h30 exclusively; 

    Once you have received the pin/token number from Standard Bank pertaining to the request, it will only be valid for a period of 7 (seven) days; 

    Cash out limits via an Standard Bank ATM are:- 

    •  Minimum amount of R50.00 (fifty rands) per transaction; and 

    • Maximum amount of R4, 900.00 (four thousand and nine hundred rands) per day. 

    • Payment may take up to 2(two) working days from receipt of request. 

  2. South African Bank Account: You will be charged a transaction fee, currently of R4.74 (four rands and seventy four cents) for a normal bank transfer. 

    The account holder of the bank account is to be the same person as the virtual wallet holder requesting the cash out. 

    In terms of the provisions of FICA it will be necessary for you to furnish ITHUBA with a copy of your identity details (i.e. a valid identity document - RSA ID or Driver's License) and stamped proof of bank account details (not older than 3 months). Should you have failed to comply with the provisions of FICA then ITHUBA shall be prohibited from paying out any credit balance in your wallet. 

    Bank transfer limits to a South African Bank account are:- 

    • Minimum amount of R50.00 (fifty rands) per transaction; and 

    • Maximum amount of R49,999.99 (forty nine thousand nine hundred and ninety nine rands and 99 cents) per day. 

    • Payment may take up to 2 (two) working days from receipt of all required documentation. 

    • Normal banking transfer periods will be applied to the transfer of funds by the applicable bank once the cash out has been processed, e.g. funds may reflect within 72 (seventy two) hours of transfer, depending on the bank's rules. 

  3. You are responsible for maintaining the confidentiality of your password and are fully responsible for all activities that occur under your password and the virtual wallet. 

  4. You acknowledge that if a third party (including any members of a syndicate on whose behalf you might act) becomes aware of your password, such person will have access to all of the services and features associated with the operation of your virtual wallet, including but not limited to, the choosing of National Lottery numbers, transfer of funds, pay-outs and payments into your virtual wallet. 

  5. ITHUBA will, under any circumstance, not be held liable for any loss, claim and/or damage you may suffer or incur, howsoever arising, including but not limited, from and/or as a result of the use (authorised or unauthorised) of your password and/or virtual wallet. 

  6. You indemnify ITHUBA, the NLC and their Representatives against any loss, expense, claim or damage of whatsoever nature and howsoever arising from the use of the Website, or arising from any delay or failure by ITHUBA to send an email or SMS to you. ITHUBA makes no representation or warranty, whether express or implied, as to the operation and functionality of the Website. 

Purchasing Times 

On any draw day for LOTTO, LOTTO PLUS 1 and LOTTO PLUS 2, PowerBall and PowerBall PLUS, DAILY LOTTO the closing time is 20h30. 

  1. You can only buy LOTTO, LOTTO PLUS 1 and LOTTO PLUS 2 boards during the times prescribed below: 

    • On draw days (Wednesdays & Saturdays) - 06h00 to 20h30.

    • On Sundays between 06h00 and 17h30.

    • On other days (Monday, Tuesday, Thursday and Friday) between 06h00 and 22h30.

    • LOTTO, LOTTO PLUS 1 and LOTTO PLUS 2 draw days are Wednesday and Saturday. 

  2. You can only buy PowerBall and PowerBall PLUS boards during the times prescribed below: 

    • On draw days (Tuesdays & Fridays) - 06h00 to 20h30.

    • On Sundays between 06h00 and 17h30.

    • On other days (Monday, Wednesday, Thursday and Saturday) between 06h00 and 22h30

    • PowerBall and PowerBall PLUS draw days are Tuesday and Friday. 

  3. SPORTSTAKE 13 fixture lists are offered twice a week as per the below: 

    • Midweek Fixture List opens Sundays, 06h00 until 30 minutes before the start of the first fixture on Wednesday.

    • Midweek Fixture results are published on Friday mornings.

    • Weekend Fixture List opens Thursday, 06h00 until 30 minutes before the start of the first fixture on Wednesday.

    • Weekend Fixture results are published Monday mornings.

    • SPORTSTAKE 13 fixture results are considered as the final score after 90 minutes of play or after extra time where applicable, however these excludes penalty shoot-out. 

  4. SPORTSTAKE 8 fixture lists are offered three times a week as per the below: 

    • Midweek List

    • Tuesday List - From Sunday, 06:00 am until 30 minutes before the start of the first fixture on the list. 

    • Tuesday's Fixture Lists results are published Wednesday mornings.

    • Thursday/Friday List - From Wednesday, 06:00 am until 30 minutes before the start of the first fixture list.

    • Thursday/ Friday List results are published Friday/Saturday mornings. 

    • Midweek List

    • Sunday List - From Friday/Saturday, 06:00 am until 30 minutes before the start of the first fixture on the list.

    •  Sunday's List results are published Monday mornings.

    • SPORTSTAKE 8 results are considered as the final score at the end of each 45 minute half in a soccer match and it excludes extra time and penalty shoot-outs. 

  5. You may purchase DAILY LOTTO daily, except on Christmas Day, unless otherwise determined by ITHUBA during the times prescribed below: 

    On a daily basis between 06h00 to 20h30. DAILY LOTTO draw days are held daily at 21h00. 

  6. For the RAFFLE game - please refer to the specific terms and conditions of the RAFFLE game. 

  7. For the EAZiWIN game - please refer to the Rules pertaining to the game. 

Intellectual Property 

  1. You acknowledge and agree that the Website and any necessary software used in connection with the provision of the Website contain proprietary and confidential information that is protected by applicable intellectual property and other laws. 

  2. You further acknowledge and agree that all trademarks, logos and content contained in advertisements or information presented to you through our Website whether protected or not by copyrights, trademarks, service marks, patents or other proprietary rights and laws shall not be used by you. Except as expressly authorized by ITHUBA or the NLC, you agree not to modify, use, rent, lease, loan, sell, distribute or create derivative works based on the Website, in whole or in part. 

  3. The National Lottery trademarks, logos and product names are the intellectual property and trademarks of the NLC (the "National Lottery Marks"). Without ITHUBA's or the NLC's prior written permission, you agree not to refer to, copy, distribute, display or use in any manner, the National Lottery Marks. 

  4. ITHUBA, the ITHUBA logos and slogans, and product and service names are the intellectual property and trademarks of ITHUBA (the "ITHUBA Marks"). Without ITHUBA's prior written permission, you agree not to refer to, copy, distribute, display or use in any manner, the ITHUBA Marks. 

  5. For the avoidance of doubt, the rest of the content of this Website which includes, but is not limited to, the text, graphics, icons, designs, colours, layout are the intellectual property of ITHUBA and its associates. All the intellectual property rights referred to herein are governed by the South African and international intellectual property laws. 

  6. In the case of any disputes regarding these Terms and Conditions, the decision of ITHUBA will be final and binding, and no further correspondence will be entered into. 

  7. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any content or enforce limitations on the use of the website or its content. All rights are herein reserved by ITHUBA. 

  8. Any reproduction modification, creation or derivative works from or redistribution of the Website and Mobile App its content is expressly prohibited. Copying or reproducing the Website or Mobile App or any of its content or any portion thereof to any other server or location for further reproduction or redistribution is expressly prohibited. 

Termination 

  1. These Terms and Conditions apply to the use of the National Lottery Website, Mobile App (including the wallet) until your online access is terminated by you or ITHUBA. 

  2. You may terminate these Terms and Conditions at any time by ceasing to use the Website, Mobile App or the content contained therein and destroying all materials received or downloaded from the Website and Mobile App. 

  3. ITHUBA reserves the right to delete accounts (i.e. your profile and your virtual wallet) that are inactive for a continuous period of 6 (six) months (or such period as ITHUBA may determine) with immediate effect. 

  4. ITHUBA reserves the right to suspend or close your virtual wallet at any time on notice and the balance of such virtual wallet funds shall be remitted to you unless ITHUBA is required to do otherwise by law. ITHUBA reserves the right, at any time, and/or from time to time, to modify or discontinue, temporarily or permanently, www.nationallottery.co.za (or any part thereof) on notice to National Lottery players via our Website - www.nationalottery.co.za

  5. Neither ITHUBA, the NLC nor any of their Representatives shall be held liable to you or to any third party for any modification, suspension or discontinuance of the Website and Mobile App. 

  6. Upon termination of your online play registration and/or the subsequent close of your account, you consent to our retention of the information we have already collected from you for record-keeping purposes only and in accordance with applicable law. 

  7. The termination of any contract created by these Terms and Conditions will be without prejudice to any other rights or remedies that you or we may be entitled to under the agreement or at law, and will not affect any of our or your accrued rights or liabilities nor the coming into or continuance in force of any provision of these Terms and Conditions which is expressly or by implication intended to come into or continue in force on or after such termination. 

General 

  1. Prize winners at www.nationallottery.co.za agree that, if and to the extent that ITHUBA is legally obliged to provide a third party with details of any prize claimed by or on behalf of, or paid to the prize winner, ITHUBA shall be entitled to do so.

  2. The following representations and warranties are material to ITHUBA and have been relied upon by ITHUBA to accept your registration and entry into the National Lottery game/s:

    • ou have read and fully understand, and will continue to understand and comply with the T's & C's in which you purchase the National Lottery game through the Website;

    • You are at least 18 years of age;

    • You will play responsibly and not excessively according to the set limitations. 

  3. You may opt to receive communication via email or SMS. The communication costs for all transactions are clearly stated clause 28 and these rates are subject to change from time to time at the sole discretion of ITHUBA. Payment for tickets must be completed before the purchase cut off time for the ticket to be valid and entered for the selected draw. You are responsible to ensure that the National Lottery game ticket purchases are completed on time for a draw. 

  4. It is your responsibility to check and ensure that your National Lottery game ticket has been entered into the selected draw should you fail to receive a confirmatory sms or message. If no valid ticket is received then the entry into that draw is not valid. 

  5. All fees incurred for the transfer of winnings, including but not limited to bank fees for opening a new bank account or a cash deposit fee, are for your account. Likewise bank charges applied by your bank pertaining to any purchase made via your virtual wallet will be for your account. 

  6. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Website and Mobile App or any service provided therein. 

  7. The instructions on how to register and use the Website and Mobile App service forms part of these Terms and Conditions. 

  8. The failure of ITHUBA to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of any such right or provision to do so at any time and in any appropriate forum. 

  9. Save as otherwise provided, no provision of these Terms and Conditions constitutes a stipulation for the benefit of a third person, which if accepted by the person, would bind any party in favour of that person. 

  10. You may not cede, assign or otherwise transfer your rights and obligations in terms of these Terms and Conditions to any third party. 

  11. Whilst we take all reasonable steps and precautions to ensure the accuracy of all the content we make available on our Website and Mobile App, the content provided is intended for general information purposes only. As far as the law allows, you agree to defend, indemnify us and hold us and our officers, directors, affiliates, service providers, officers, agents, suppliers and employees harmless from and against any and all claims, damages, obligations, losses liabilities, costs or debt and expenses (including but not limited to attorney's fees) arising from:

    • Your use of and access to the Website and Mobile App;

    • Your breach of any terms of the T's & C's;

    • Any violation of any third party right, including without limitation any copyright, trademark, trade secret or other property or privacy right;

    • Any claim that your content caused damage to a third party. 

  13. This defense and indemnification obligations will survive termination, modification or expiration of these terms and conditions and your use of the Website and Mobile App. 

  14. If any provision of these Terms and Conditions is found by a South African Court of competent jurisdiction to be invalid, the other provisions will remain in full force and effect. 

  15. ITHUBA reserves the right to alter or amend these Terms and Conditions at any time. Any revisions made will be effective from the time of posting the revised document on the Website. In such an event, you agree to abide by the revised Terms and Conditions and understand that you will not have any claim against ITHUBA, the NLC or their Representatives in respect of any change so effected. It is therefore your responsibility to ensure that you review these Terms and Conditions in case of any update or amendments made thereto. 

  16. All amounts specified herein are in South African Rand (ZAR) and any payments made to winners will also be in ZAR. 

  17. These Terms and Conditions and the relationship between us shall be governed and construed in accordance with the South African law.

  1. The Vodacom offers found on the Vodapay app  (URL) are applicable to Prepaid, Hybrid and Post Paid customers

  2. These can be purchased through payment by linked bank card or money deposited into your Vodapay wallet

  3. Voice bundles consist both of Vodacom mins and Any Network minutes and can be found within the "minutes" menu

  4. Voice bundles can be used within the borders of South Africa and do not apply to international calls or international roaming.

  5. Voice bundles will be deducted per second during a call, whilst the call remains active.

  6. Voice bundles can be used for the following types of calls (GSM Voice, Voice over LTE and Wi-Fi calling) the bundles do not apply to VoIP calls.

  7. Where multiple Voice bundles are purchased, the order of consumption will be Last In First Out, within the month of purchase.

  8. Usage SMS messages will be sent to the customer at thresholds of 70% usage, 90% usage and 100% usage.

  9. At the time of either expiry, or depletion of a Voice bundle; all further calls will be charged for at the applicable Out Of Bundle rate per minute/second of the prevailing price plan type. The only tariffs that these bundles are not applicable are the IOT tariffs

  10. Combo bundles found under the Voice menu may contain a combination of anytime data, WhatsApp data, Night Owl and Vodacom voice minutes. See menu for prices and bundle sizes

  11. Night Owl data is applicable between midnight and 5am any day of the week

  12. WhatsApp data will deplete only from usage on WhatsApp messenger

  13. Everyday (voice menu) and Everyday-ta (data menu)  are offers that give the relevant daily allocation upon a once off up front purchase

  14. Everyday-ta bundles are LTE bundles, with 3G fall-back.

  15. The first of the daily bundle allocations will be loaded on the date of purchase of the bundle. Customers will receive an SMS confirming the allocation of the Everyday-ta bundles.

  16. All unused bundles will expire every day at 23:59 on the day of allocation.

  17. Data Transfer is available on Everyday-ta bundles. The transfer is applicable on the data allocated for a particular day - once-off. Data Transfer rules apply.

  18. Data Rollover does not apply to Everyday-ta bundles.

  19. It is possible to purchase other additional once-off bundles when an Everyday-ta bundle is active.

  20. Bundles with the shortest validity will be consumed first, with the exception of URL bundles which will be consumed on the specific URL stated upon purchase e.g. a YouTube bundle.

  21. Data limit lock rules apply.

  22. When a customer migrates from Prepaid/Hybrid to Post-paid the customer will forfeit the Everyday-ta bundles.

  23. When a customer migrates between Prepaid and Hybrid or within Prepaid and Hybrid plans customer will keep the Everyday-ta bundle.

  24. Vodacom reserves the right to suspend the Service in the event of suspected abuse or fraudulent usage, outside of what is considered reasonable for private, non-commercial use.

  25. Vodacom reserves the right to limit the Service in regions or areas where there is limited network capacity (high congestion) in order to maintain consistent quality of service. 

  26. Vodacom reserves the right to alter or terminate the Service in order to prevent a catastrophic impact on the network. 

  27. While Vodacom will use its reasonable endeavors to provide the Service, it does not commit to the uninterrupted supply of the Service, due to potential capacity limitations on the network. 

  28. Vodacom reserves the right to suspend, cancel or convert the Service with reasonable notice. 

  29. Vodacom reserves the right to change and/ or expand on these terms and conditions and will provide reasonable notice of any material changes prior to such change as and when the circumstances permit.

A. These Terms and Conditions highlight the limitation of rights for both the end customer and Vodacom South Africa.

B. These Terms and Conditions highlight that a purchase or use of any of the products outlined as “network locked dual sim” devices constitutes an acceptance of these Terms and Conditions.

C. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (the "Consumer Protection Act"), no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.

1. Introduction

1.1 The Vodacom Dual SIM Network Locked Devices are applicable to all Vodacom Customers who purchase any Dual SIM Locked Device on the Vodacom Network, for a period of 12/24/30/36 months, from the date of purchase, dependant on your device plan type .

1.2 The offer is available from April 2022 until Vodacom in its sole and absolute discretion elects to discontinue these dual sim devices (the “Offer Period”).

1.3 Notwithstanding the Offer Period, Vodacom may, in its sole and absolute discretion, amend the duration of the Offer Period to a shorter or longer period, or withdraw the Offer in its entirety, without any prior notice to customer. 2. Qualifying Customers

2.1 The Offer is available to all New and Existing Vodacom Customers who purchases any Dual SIM locked device during the Offer Period:

2.1.1   All new customers who successfully activate their devices, in terms of the Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2002 as amended and any regulations thereto (“RICA”). RICA may be done at any approved Vodacom vendor or store (the “Qualifying Customers”);

2.1.3   New and existing customer who elect to purchase a qualifying dual sim network locked device.

3. The Offer

3.1 The Vodacom Dual SIM Network Locked Device offering allows customers to purchase any Dual SIM Network locked device on the network.

3.2 The device will be locked on Vodacom's network for a period of 12/24/30/36 month’s dependant on your device plan type.

3.2.1 Prepaid customers can however request an unlock code from Vodacom only after 24 months from activating a network locked device

3.3 Customers will not be charged for an unlock code, however customer need to request and unlock code from Vodacom via 082135.  

3,3. Unlocking of devices may take up-to 48 hours from the unlock code request time

3.4 An active Vodacom SIM must be inside the device at all times.

3.5 Primary sim slot will be locked on the Vodacom network and can only use active Vodacom SIMs.

3.6 Secondary sim slot can be used for other network SIMs.

Subsidised devices:

3.7 During the locking in period the Secondary sim slot can only be used as a voice SIM on 2G technology if the device is subsidised by Vodacom

3.7.1 If the device is subsidised and the Secondary sim slot has a Vodacom sim card, the device will be open to all voice and data technologies.

Unsubsidised devices:

3.7.2 During the locking in period the Secondary Sim slot on unsubsidised devices will be open to all device technologies subject to an active VODACOM sim card

3.7.3 Once a device has been unlocked, both Secondary and Primary slots will have access to both Voice and Data technology

3.8 The Secondary sim slot cannot function independent of the primary sim slot having an active Vodacom sim, therefore at all times primary sim slot should have an activated Vodacom SIM. This condition is applicable for both subsidised and unsubsidised devices

4. Terms of Use

4.1 Vodacom reserves the right, in its sole and absolute discretion, to terminate or suspend customers from using this product or the network services where Vodacom suspects abuse of its network, the service, any of its services, fraud, criminal activity or where the customer’s use of the service is placing an unreasonable constraint on the Vodacom network which may impact the experience of other Vodacom Customers.

5. RICA

5.1 In terms of RICA, customers are obliged to provide proof of your full names, surname, Identity Document number and residential address to a RICA officer when purchasing a SIM card.

5.2 Failure by any person holding/using a SIM card to comply with RICA is an offence. Contact your service provider or see https://www.vodacom.co.za/vodacom/terms/terms-and-conditions for details.

6. Cancellation

6.1 Customers may cancel their service contract by contacting the Vodacom call centres during the 24/30/36 month’s contract period.

6.1.1 However, post the cancellation of a service contract, customers can only request a unlock code only after month 24/30/36  of the activation of the device on the Vodacom network

6.2 Customers are bound to the cancellation provisions contained in their Vodacom Customer Contract Terms and Conditions, which includes, but is not limited to, cancellations not being requested prior to completion of the contractual period https://www.vodacom.co.za/vodacom/terms/contract-terms-and-conditions

7. Modification of Terms and Conditions

7.1 Vodacom reserves the right, to change, vary, amend or replace these Terms and Conditions and any rules relating to this offer at any time as required by law,

8. Limitation of Liability

VodaPay Enhanced Wallet Terms and Conditions

  1. General Information

    1. These terms and conditions relate to the registration and use of any of the Lite, Pro or Essential Wallets (jointly referred to as the "Enhanced Wallets").

    2. The Enhanced Wallets are incorporated by reference to the Platform Terms and Conditions. By using the Enhanced Wallets, you indicate that you agree to the Enhanced Wallet Terms and Conditions. (the "Terms and Conditions").

    3. All capitalised terms not defined herein shall have the meaning given in the Platform Terms and Conditions.

    4. The Enhanced Wallet capability is owned and operated by Vodacom Payment Services (Pty) Ltd, a company registered in terms of South African law with registration number: 2007/010688/07 (hereinafter referred to as "VPS").

    5. These Terms and Conditions shall commence from the date on which they are published and continue indefinitely, as amended by VPS from time to time, for so long as Enhanced Wallet exists and is operational, VPS being entitled to amend or terminate these Terms and Conditions and/or shut down the Enhanced Wallet at any time in accordance with these Terms and Conditions.

    6. You agree that the information you have provided upon registration to the Enhanced Wallet is true and accurate. You agree to inform VPS immediately if the information provided becomes incorrect.

    7. You may not change any of the Terms and Conditions.

    8. You may not cede your rights or delegate your obligations in terms of the Terms and Conditions.

    9. The Terms and Conditions will be governed by the laws of the Republic of South Africa.

    10. In the event that there are bank system error corrections including but not limited to incorrect double crediting of your Enhanced Wallet, you consent that VPS or Bidvest Bank, shall have the right to debit your Enhanced Wallet. Notification of such correction or debit shall be provided to you.

    11. No multiple Enhanced Wallets are allowed, and you may upgrade from one Wallet type to another, being from a Lite to an Essential and finally to a Pro Wallet.

    12. Once you register, your Enhanced Wallet does not expire it only becomes inactive or dormant, however your Enhanced Wallet may be terminated in accordance with these Terms and Conditions.

    13. If you suspect that your Enhanced Wallet has been compromised please contact VPS on the Fraud Hotline details in clause 20.

  2. Registration/Application for an Enhanced Wallet

    1. Your registration for the Enhanced Wallet is subject to the approval criteria and may be declined at the sole discretion of VPS.

    2. VPS will request certain information from you before your registration can be completed successfully i.e. information in respect of your identity.

    3. You must provide complete, accurate information.

    4. If you cannot provide satisfactory proof of identity and/or other supporting documentation then VPS may decline your application for an Enhanced Wallet.

    5. VPS may, in order to meet its regulatory obligations, request additional information and documentation from you after the approval of your Enhanced Wallet application.

    6. By applying for the Enhanced Wallet, you agree to accept and be bound by these Terms and Conditions

    7. You will be prompted to choose your PIN or enter biometrics  for you to be able to access the Enhanced Wallet.

    8. Your PIN to the Enhanced Wallet is confidential and must be kept safe at all times.

    9. VPS and Bidvest Bank will not be held liable for a lost/or compromised PIN or any related losses due to your negligence.

  3. Payments using the Enhanced Wallet 

    1. As part of the Services, you may elect to make payments on the VPS Platforms using a digital Wallet that stores value.

    2. To register for a Wallet and use the Enhanced Wallet, you must register using your South African mobile number.

    3. Access to an Enhanced Wallet is subject to compliance with anti-money laundering legislation including but not limited to Financial Intelligence Centre Act No 38 of 2001 as amended ("FICA") and successful fraud and risk control checks.

    4. If you do not provide the requested information for the purposes of FICA at the point of registration or after receiving a request at any time after registration you will not be able to transact on your Enhanced Wallet.

    5. Access to an Enhanced Wallet shall be at VPS' and Bidvest Bank's sole discretion.

    6. The features of each type of Wallet are set out in Annexure A below.

  4. Transferring/Depositing money into Your Enhanced Wallet

    1. You may deposit funds into your Enhanced Wallet by:

      1. Transferring funds from your bank account to your Enhanced Wallet using Electronic Funds Transfer ("EFT") or instant EFT;

      2. VPS will only allocate funds in near real-time on the payment notifications received from your bank. Should you not specify your email address funds will only be allocated by following the standard EFT settlement rules.

      3. EFT payments are final and irrevocable in nature and you will be unable to lodge disputes to reverse a transaction once it has been successfully processed by VPS and/or Bidvest Bank.

  5. Electronic payment instruction transactions

    1. You should not store your PIN on your cellphone handset in any form whatsoever.

    2. If your cellphone automatically stores your PIN, the onus is on you to delete it. This will ensure that no one can transact using your Enhanced Wallet, as they will need your PIN to access and authorise transactions.

    3. You will be responsible for paying the relevant network or wireless and data service charges that you incur when using the Enhanced Wallet for this purpose.

  6. Limits on your Enhanced Wallet

    1. Certain limits may apply for in respect of the value of the transaction you may make and the balance you may hold in your Enhanced Wallet. 

    2. There are different transactional limits applicable to different types of Enhanced Wallets, which you may view in Annexure A below.

    3. The daily and monthly limits that may be applied to your Enhanced Wallet include:

      1. the total value of any goods and services you may purchase;

      2. cash withdrawals, payments and transfers you can make from your Enhanced Wallet.

    4. All transaction limits applicable to each Enhanced Wallet type are displayedin Annexure A below. VPS and Bidvest Bank reserve the right to amend such transaction limits at their sole discretion, and will provide you with such notice 30 days prior to implementing same.  

  7. Monthly Fees and Charges

    1. You can view the fees and charges in Annexure A below.

    2. No activation fee or charges apply

    3. Any fee/charges will be notified to you 30 days before they come into effect via your preferred communication method.

  8. Interest

    1. You will not earn interest on the amount held in your Enhanced Wallet.

  9. Dormancy 

    1. Your Enhanced Wallet will be deemed to be dormant after a period of 6 consecutive months of non-use.

    2. If after the end of month 3, you still do not use your Enhanced Wallet, then:

      1. You will still be able to receive funds into your Enhanced Wallet but to mitigate the risk of fraud, you will not be able to transact from it ("Soft Lock"). You can re-activate your Enhanced Wallet by requesting a system OTP or contacting VPS via the instant chat on the VPS Platform.

      2. Should your Enhanced Wallet remain in a Soft Locked state for a period in excess of 3 months and:

        1. no further action is taken for a period of 12 months, VPS shall terminate your Enhanced Wallet and retain your transactional data for a maximum period of 5 years;

        2. you have funds in your Enhanced Wallet, then VPS shall transfer such available funds to a VPS Wallet Dormancy Account. You are aware that no interest will be earned on funds retained in the VPS Wallet Dormancy Account;

      3. VPS will notify you of the 30 days before any inactivity/dormancy status or termination.

      4. No charges will be applied while your Enhanced Wallet is in dormant/inactivity status.

  10. Termination/Deactivation of your Enhanced Wallet

    1. VPS endeavours to prevent criminal activity including money laundering and terrorist financing.

    2. Accordingly, if VPS considers it necessary, or if applicable South African or international laws, rules, regulations, restrictions or policies ("applicable law") require it to do so, VPS may, in its sole discretion:

      1. restrict the use of and/or terminate your Enhanced Wallet without notice to you, if it suspects that your Enhanced Wallet has been or is being used fraudulently, negligently or unlawfully for money laundering  activities, financing terrorist and related activities, or in contravention of applicable law; or 

      2. terminate the relationship, resulting in the closure of your Enhanced Wallet, and prevent you from using the Enhanced Wallet, at any time after the VPS gives you 30-day notice of such termination.

    3. VPS may at any time and at its sole discretion deactivate your Enhanced Wallet if you do not comply with these Terms and Conditions.

    4. VPS may at any time and at its sole discretion deactivate your Enhanced Wallet if your continued use thereof will cause or has caused reputational or potential reputational damage to VPS or Bidvest Bank.

    5. You may deactivate your Enhanced Wallet on 30 days' notice by contacting VPS via the instant chat on the VPS Platform.

    6. The deactivation of your Enhanced Wallet for any reason shall result in the termination of these Terms and Conditions.

    7. Upon termination of your Enhanced Wallet due to breach of these Terms and Conditions you will be advised to withdraw all your funds within 30 days and your Enhanced Wallet will be deactivated.

    8. However, should you not withdraw your funds before your Enhanced Wallet is deactivated, the Bank shall transfer the remaining funds into a non-bearing interest account where the funds will be held until such time that you request the funds. You may contact us via the instant chat on the VPS Platform to withdraw your funds.

  11.  Authorised Use

    1. You are the only person authorised to use your Enhanced Wallet.

  12. Change of your contact details and communication with you

    1. You can contact us via the instant chat on the VPS Platform to change your contact details. Supporting documentation may be requested where required.

    2. Failure to do so may result in your Enhanced Wallet being suspended.

    3. VPS will contact you mainly via the app or your preferred method of communication.

    4. You will need to inform VPS of any change to your contact details.

    5. If you do not inform VPS of the change in contact details, we will continue using the contact details we have on our data base.

  13. Electronic Communication Indemnity

    1. You acknowledge that all conversations with VPS or Bidvest Bank may be recorded, and you consent to such a recording.

    2. You agree that in any dispute between you and VPS or Bidvest Bank regarding electronic instructions and documentation given to VPS or Bidvest Bank, the contents of the electronic instructions, including telephone recording, or electronic document shall be final and binding on you.

    3. You shall have no claim against VPS or Bidvest Bank, and shall indemnify VPS or Bidvest Bank, for any losses, damage or costs you may suffer or incur as a result of  VPS or Bidvest Bank acting upon an electronic instruction, except if the VPS is grossly negligent.

  14. Prepaid airtime and electricity

    1. A prepaid electricity or airtime purchase or bill payment transaction cannot be reversed or refunded once you have completed a purchase.

  15. Deceased Estate Management 

    1. In the unfortunate event of your death, a letter from the executor or administrator of the estate or your legal representative is required to advise VPS of your death. The letter should include a copy of your death certificate and a copy of your ID or passport. 

    2. Upon receipt of the documentation referenced above, VPS will Soft Lock your Enhanced Wallet and any user platform on the VPS Platforms.

    3. If at the time of your death you have available funds in your Enhanced Wallet, VPS will pay-out such available funds to a nominated trust account as advised by the letter received from your executor.  Should no such account be indicated, VPS will contact your executor and request that such an account be provided.

    4. Once the aforementioned has been completed your Enhanced Wallet and profile on the VPS Platforms will be suspended to avoid any potential future use.

  16. Limitation of Liability

    1. Unless VPS or Bidvest Bank acted with gross negligence or fraudulently, and to the extent permissible by applicable law, VPS and Bidvest Bank shall not be liable for any direct, indirect, special, incidental or consequential loss or damage which you, or any third party, may suffer or incur by your use of the Enhanced Wallet, including but not limited to any

      1. instances where your Enhanced Wallet PIN is compromised and you fail to notify VPS timeously, which results in a loss to you;

      2. unlawful or unauthorised access to your Enhanced Wallet;

      3. suspension or cancellation of your Enhanced Wallet where VPS or Bidvest Bank suspects same is being used for fraudulent or criminal activity;

      4. third party refusing to process any transaction via your Enhanced Wallet;

      5. failure or delay caused by third party service providers or the malfunctioning of any system or network which is beyond VPS or Bidvest Bank's reasonable control;

      6. loss or corruption of your data; or

      7. circumstances beyond VPS or Bidvest Bank's reasonable control;

  17. Warranties, Acknowledgements and Confirmation

    1. You acknowledge and confirm that VPS or Bidvest Bank may request information from any person, or business, relevant to the services in which you are interested.

    2. You warrant that the information contained herein is correct, true and complete and that you have full capacity and authority to transact with VPS and Bidvest Bank.

    3. You acknowledge that you are required to provide documents to verify your identity in terms of anti-money laundering legislation.

    4. You warrant that you have complied with all applicable legislation and regulations governing your activities including anti-money laundering legislation and exchange control legislation.

    5. You acknowledge and confirm that VPS and Bidvest Bank may carry out identity, fraud prevention and other illegal activities checks and share information related to this application through the Southern African Fraud Prevention Service and other organisations involved in criminal activities prevention.

    6. You acknowledge and confirm that VPS and Bidvest Bank may process and share personal information as defined in the Protection of Personal Information Act, No 4 of 2013 with third parties whose services VPS and Bidvest Bank utilises in its ordinary course of business.

  18. Security and Risk

    1. Any act performed when using the Enhanced Wallet will be assumed to have been performed by you.

    2. We shall not be obliged to enquire into, or to prove the authority of any person who has obtained access to your PIN, or who has initiated any transaction using your Enhanced Wallet.

    3. For your protection and security, you must enter the correct PIN information to identify yourself when using your Enhanced Wallet.

    4. For your protection, we can refuse to act on any instructions you send us or cancel your access (temporarily or permanently) if you do not meet the verification requirements. This includes entering the wrong PIN.

    5. We are entitled to act on and accept all transactions done after your PIN has been entered or applied correctly.

    6. We will assume that you have authorised all such transactions, even if such transactions took place without your knowledge or consent or were not authorised by you. Should you feel aggrieved in respect of a transaction, you are entitled to follow the complaints process set out in clause 22 of these Terms and Conditions.

    7. You must take the necessary steps to protect your access information, electronic equipment and your cellphone.

    8. You should never give or show your access information to any person.

  20. Communication with VPS

    If you do not understand any part of these Terms and Conditions or how they apply to you, or you would like to get more information on the Services, please contact us through our instant chat on the VPS Platform. You will interact with our chat bot Tobi but should you wish to contact us for any queries or complaints you will be able to request a call back and our friendly call centre agent will call you back. In the event that you need to report fraud; please contact our Fraud line on 082 241 0016.

  21. Amendments of these Terms and Conditions

    1. VPS shall notify you via your preferred method of communication of any amendments to the Terms and Conditions in respect of the Enhanced Wallet. It is your responsibility to review the amended Terms and Conditions to ensure that you understand them. You may contact VPS should you have any query to the amended Terms and Conditions.

    2. We will inform you within 30 (thirty) days, in writing prior to any amendments.

    3. The amendments will be binding on you and will form part of these terms and conditions 30 (thirty) days after we have notified you

    4. You may not alter any of these terms and conditions.

  22. Customer Complaints

    1. Complaints can be directed to:

  23. Protecting Your Personal Information

    1. VPS and the Bank are responsible parties in terms of the Protection of Personal Information Act 4 of 2013, in respect of the Enhanced Wallet.

    2. VPS will share your personal information with the Bank for the purposes of enabling you to transact on the Enhanced Wallet.

    3. To understand how VPS collects, uses, protects and handles your personal information please visit www.vodacom.co.za.

    4. To understand how Bidvest Bank collects, uses, protects and handles your personal information please visit www.bidvest.co.za.

  24. Incorporation

    These Terms and Conditions must be read together with the VodaPay Platform Terms and Conditions.

VodaPay Platform Terms and Conditions

  1. Platform Terms and Condition

    1. The VodaPay Lifestyle services offered on the VodaPay application (collectively the "VPS Platforms") offers you the ability to pay for goods and services (the "Products") offered on the VPS Platforms without carrying cash (the "Services").

    2. You and your refers to you as user of the VPS Platform.

    3. In these Platform Terms and Conditions, we, us and our, refer to Vodacom Payment Services (Pty) Ltd and Vodacom (Pty) Ltd.

    4. By using the VPS Platforms, you indicate that you agree to the following terms and conditions (the "Platform Terms and Conditions").

    5. The VPS Platforms are jointly owned and operated by Vodacom Payment Services (Pty) Ltd, a company registered in terms of South African law with registration number: 2007/010688/07 (hereinafter referred to as "VPS") and Vodacom (Pty) Ltd, a company registered in terms of South African law with registration number: 1993/003367/07  (hereinafter referred to as "Vodacom"). As such you will become a customer of both VPS and Vodacom.

    6. To understand how VPS and Vodacom collect, use, protect and handle your personal information please visit www.vodacom.co.za.

  2. Term and Termination

    1. These Platform Terms and Conditions shall commence from the date on which they are published on the VPS Platforms and continue indefinitely, as amended by VPS and Vodacom from time to time, for so long as the VPS Platforms exists and are operational, VPS and Vodacom being entitled to amend or terminate these Platform Terms and Conditions and/or shut down the VPS Platforms at any time.

    2. VPS and Vodacom shall notify you of the amended Platform Terms and Conditions. It is your responsibility to go through the amended Platform Terms and Conditions to ensure that you understand them.

  3. Notice

    1. These Platform Terms and Conditions contain provisions which appear in a bold text style to this clause in order to draw your attention to such clauses because they:

      1. may limit the risk or liability of VPS, Vodacom or a third party; and/or

      2. may create risk or liability for you; and/or

      3. may compel you to indemnify the Vodacom Group or a third party; and/or

      4. serve as an acknowledgement, by you, of a fact.

    2.  If there is any provision in these Platform Terms and Conditions that you do not understand, it is your responsibility to ask VPS to explain it to you before you accept the Platform Terms and Conditions or continue using the VPS Platforms.

    3. These Platform Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the "CPA").

    4. Nothing in these Platform Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or VPS in terms of the CPA.

    5. VPS permits the use of the VPS Platforms subject to the Platform Terms and Conditions. By using this VPS Platforms in any way, you shall be deemed to have accepted all the Platform Terms and Conditions unconditionally. You must not use the VPS Platforms or any part thereof if you do not agree to the Platform Terms and Conditions.

  4. Registration Process

    1. To register and use the VPS Platforms, you must register using your South African mobile number.

    2. When you register, a One Time PIN ("OTP") will be sent to your mobile number. You will then be prompted to supply the OTP on the VPS Platforms.

    3. Once you have supplied the correct OTP, you will be required to set up a 5-digit pin to access the VPS Platforms. You will also be given an option to use biometrics on your mobile device as means to access the VPS Platforms.

    4. You agree and warrant that your 5-digit pin shall:

      1. be used for personal use only; and

      2. not be disclosed by you to any third party.

    5. For security purposes you agree to enter the correct 5-digit pin whenever attempting to use the VPS Platforms, failing which you will be denied access.

    6. You undertake to keep your 5-digit pin secure and warrant that no other person shall use the VPS Platforms utilising your 5-digit pin, and you acknowledge further that you are responsible for ensuring that no unauthorised access to the VPS Platforms is obtained using your 5-digit pin, and that you will be liable for all such activities conducted pursuant to such use, whether authorised or not.

    7. You agree to notify VPS immediately via the Fraud hotline number on 082 241 0016 upon becoming aware of or reasonably suspecting any unauthorised access to or use of your 5-digit pin and to take steps to mitigate any resultant loss or harm.

  5. Use of the VPS Platforms

    1. By using the VPS Platforms you warrant that you are 18 (eighteen) years of age or older and of full legal capacity.

    2. You may only use the VPS Platforms for lawful purposes and you warrant that you shall not use the VPS Platforms:

      1. to receive or transmit material which is in violation of any law or regulation, which is obscene, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property rights, or otherwise objectionable or unlawful;

      2. for the transmission of "junkmail", "spam", "chain letters", or unsolicited mass distribution of SMS;

      3. other than for your personal and non-commercial use.

    3. You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the VPS Platforms. In addition, you agree that you will not in any way use any robot, spider, other automatic device, or manual process to monitor, copy, distribute or modify the VPS Platforms or the information contained herein, without the prior written consent from an authorised VPS representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this VPS Platforms).

    4. You may not in any way display, publish, copy, print, post or otherwise use the VPS Platforms and/or the information contained therein without the express prior written consent of an authorised VPS representative.

  6. Payment Options

    For your convenience we have multiple payment options for you to purchase Products on the VPS Platforms as per below: 

    1. Bank Cards

      1.  You may choose to use your existing bank card for payment on the VPS Platforms. Only bank cards that are 3D secure enabled can be used on the VPS Platforms.

      2. Your bank's card, account, and online banking terms do not change and continue to apply to each transaction.

      3. Any applicable fees and charges that apply to your bank card will also apply when you use the VPS Platforms to pay for purchases.

      4. VPS may impose any limits on the frequency or amount of your card transactions. Furthermore, VPS reserves the right to block a card from use on the VPS Platforms at any time without notice.

    2. Wallet

      1. You may elect to make payments on the VPS Platforms using a digital wallet that stores value (the "Wallet"). There are different types of Wallets.

      2. You will automatically have an entry level wallet available to you when you successfully register on the VPS Platforms (the "Entry Wallet").  

      3. You may also apply for Wallets with more functionalities based on your transaction needs, such Wallets are the Lite, Pro or Essential Wallets (jointly referred to as the "Enhanced Wallets").

      4. On your election for activation of the Enhanced Wallet, you will be prompted to agree to the additional terms and conditions.

      5. In order to make use of any of the Wallets you agree to be bound by the terms and conditions of the relevant Wallet. 

    3. Entry Wallet

      1. You can only receive funds from other VPS Platform users who have successfully registered for the Enhanced Wallets. For the avoidance of doubt, you will not be able to transfer funds into an Entry Wallet.

      2.  All funds in the Entry Wallet shall automatically earn you a prepaid certificate of equal rand value to the funds that are in your Entry Wallet (the "Value Certificate").

      3. The Entry Wallet is capable of only storing the Value Certificate of up to R3,000.

      4. The Value Certificate shall be a representation of the equal rand value that has been transferred into your Entry Wallet at any given time.

      5. If there are additional funds that are transferred to your Entry Wallet, such funds will add to the balance of your Value Certificate.

      6. You may only receive a total of R5,000 a month in your Entry Wallet.

      7. You may only redeem the Value Certificate for products and services offered on the VPS Platforms. For the avoidance of doubt you may not cash out the Value Certificate.

      8. You may only redeem a maximum of R3,000 on a daily basis from your Entry Wallet.

      9. You will be able to purchase Products on the VPS Platforms that are less than the total value of the Value Certificate in which case such purchase amount shall be deducted from the balance of the Value Certificate.

      10. The Value Certificate shall remain valid for as long as you use the Entry Wallet.

      11. The balance of the Value Certificate shall be displayed to you on the VPS Platforms after you log in. The balance of your Value Certificate shall be updated real time.

      12. The Value Certificates shall be non-transferable.

      13. You may elect to apply for an Enhanced Wallet, upon which you offer to sell the value or balance of your Value Certificate back to VPS in which case if VPS accepts such offer, VPS shall transfer the monetary value of the Value Certificate to an Enhanced Wallet.

  7. Third Party Merchants

    1. VPS only provides the VPS Platforms to facilitate transactions between you and the third party that is selling goods or services on the VPS Platforms (the "Third Party Merchants"). VPS is neither the buyer nor the seller of the goods or services unless otherwise specified.

    2. All transactions are therefore solely between you and such Third Party Merchant. VPS is not a party to that transaction.

    3. Once you transact with the Third Party Merchants you will be bound by their relevant and separate terms and conditions.

    4. VPS does not take any liability for the delivery of, the quality of, the use of, or any other aspect relating to the goods or services from Third Party Merchant. 

    5. The Third Party Merchant is solely responsible for fulfilment of delivery of the Products. The Third Party Merchant is also responsible to provide an invoice to you if you require it.

    6. You remain a customer of the Third Party Merchant at all times, under no circumstances will VPS contact the Third Party Merchant on your behalf, including but not limited, obtaining information related to your account or details or request amendment of any details.

    7. Not all Third Party Merchants are registered VAT (Value-Added Tax) vendors. Only Third Party Merchants who are registered VAT vendors may charge VAT on goods or services sold and issue a tax invoice in respect thereof.

    8. All return of goods or services for any reason shall be subject to the Third Party Merchant's returns policy. VPS strongly advises that you familiarise yourself with the Third Party Merchant's return policy.

    9. Should any claim escalate into being a dispute, VPS is not obliged to get involved in such a dispute and any such disputes must be resolved between you and the relevant Third Party Merchant alone.

    10. These Platform Terms and Conditions do not in any way overrule, eliminate or adjust the terms and conditions entered into between you and a Third Party Merchant.

  8. VPS Coupons and Rewards

    1. VPS may reward you with coupons based on your use of the VPS Platforms.

    2. Coupons are issued at VPS' sole discretion and VPS is entitled at any time to correct, cancel or reject a coupon for any reason (including without limitation where a coupon has been distributed in an unauthorised manner). You do not have a right to coupons, and coupons cannot be earned. Coupons are issued under specific terms and conditions disclosed separately in the VPS Platforms Rewards section regulating when and how they may be used.

    3. A coupon can be redeemed in full if the coupon amount is the same as the transaction amount.

    4. A coupon cannot be redeemed for cash and is not transferable.

    5. A coupon can be redeemed in full if the coupon amount is less than the transaction amount; and in this case a bank card payment can be used to pay for the remaining balance of the transaction amount.

    6. A coupon can be redeemed partially if the coupon amount is more than the transaction amount; and in such a case you will forfeit the balance of the coupon.

    7. You may have multiple coupons, however only one coupon can be redeemed per transaction.

    8. Some coupons can only be redeemed for specific Products. 

    9. If a coupon redemption fails, you may contact VPS as specified in clause 20.

    10. If the transaction where you were attempting to redeem a coupon fails due to system failure and the transaction is not concluded, the coupon will be refunded to you.

    11. Where you have used a coupon to pay, and you or the merchant later cancels your order (or part thereof) prior to delivery of the relevant product(s), or you log a return of one or more products for a credit in accordance with the merchant's returns policy, VPS may provide you with a replacement coupon of the same value as that was redeemed during the payment. VPS may in its sole discretion impose restrictions on the use of the replacement coupon.

    12. VPS may reward you with cashback into your Wallet based on your use of the VPS Platforms issued under specific terms and conditions regulating when and how they may be used.

    13. If you qualify for a cashback reward and your Wallet is dormant, blocked or the balance limit on your Wallet has been breached, then you will not receive the reward.

    14. In the unfortunate event of your death, any coupons allocated to you will be cancelled and the funds will be repatriated to VPS.

  9. Marketing in the VPS Platforms

    1. As our customer, VPS will contact you to keep you informed about new and existing products and services, competitions, prize draws and other promotions available on the VPS Platforms and VPS or Vodacom may use your personal information to run those competitions, prize draw, events and promotions, only to the extent that you have not, at any stage, objected to receiving such marketing communications.

    2. VPS may send you marketing of all products or services provided in the VodaPay application unless you have opted out.

    3. VPS will contact you to let you know about products and services of Vodacom Group companies including Vodacom, Vodacom Insurance Company Limited and Vodacom Life Assurance Company Limited products and services and those of other companies which may interest you.

    4. You can control your marketing permissions at any time within the VodaPay application.

  10. Disclaimer

    1. Whilst every effort has been made by VPS and its suppliers of information, to ensure the proper performance of the VPS Platforms, the accuracy of the information/images and the reliability of the binary data on the VPS Platforms, VPS, its affiliated companies, suppliers, or any of their employees, do not, to the full extent permitted by law, guarantee the availability or accuracy of the services, content and/or information offered on the VPS Platforms.

    2. VPS makes no representations or warranties, whether express or implied, and assumes no liability or responsibility for the proper performance of the VPS Platforms and you thus use the VPS Platforms at your own risk. In particular VPS makes no warranty that the VPS Platforms will meet your requirements, be uninterrupted, complete, timely, secure or error free.

    3. VPS disclaims liability for any damage, loss or expenses, whether direct, indirect or consequential in nature, arising out of or in connection with your access to or use of the VPS Platforms and/or any content therein unless otherwise provided by law.

    4. The VPS Platforms and all information provided on the VPS Platforms is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.

    5. Any views or statements made or expressed on the VPS Platforms are not necessarily the views of VPS, its directors, employees and/or agents.

    6. In addition to the disclaimers contained elsewhere in these Platform Terms and Conditions, VPS also makes no warranty or representation, whether express or implied, that the information or files available on the VPS Platforms are free of viruses, spyware, malware, trojans, destructive materials or any other data or code which is able to corrupt, destroy, compromise, disrupt, disable, harm, jeopardise or otherwise impede in any manner the operation, stability, security functionality or content of your computer system, computer network, hardware or software in any way. You accept all risk associated with the existence of such viruses, destructive materials or any other data or code which is able to corrupt, compromise, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation or content of a computer system, computer network, any handset or mobile device, or your hardware or software, save where such risks arise due to the gross negligence or willful misconduct of VPS, its employees, agents or authorised representatives. VPS thus disclaims all liability for any damage, loss or liability of any nature whatsoever arising out of or in in connection with your access to or use of the VPS Platforms.

  11. Third Party Content/ VPS Platforms

    1. Third party information such as but not limited to, product catalogues, product description and specifications, lists of dealers, reports on news, entertainment, technology and features, advertisements including videos, images and photographs of the products, links to third party websites and other data from external sources is made available on the VPS Platforms ("Third Party Content"). The provision of Third Party Content is for general informational purposes only.

    2. You hereby acknowledge that the Third Party Content provided to you is obtained from sources believed to be reliable or provided by the sellers in the process of advertising, exhibiting and offering to sell the products on the VPS Platforms. All Third Party Content is provided on an 'As Is' basis. VPS does not own / have the rights and title to any such Third Party Content, VPS does not provide any guarantee or make any representations with regards to the accuracy, title, merchantability, non-infringement or fitness for a particular purpose of any Third Party Content. VPS shall not be held liable for any loss suffered by you in any way whatsoever based on your reliance on or use of such Third Party Content.

    3. This VPS Platforms may contain links or references to other websites ("Third Party Platforms") which are outside of our control, including those of advertisers. These Platform Terms and Conditions do not apply to those Third Party Platforms and VPS is not responsible for the practices and/or privacy policies of those Third VPS Platforms or the "cookies" that those sites may use.

    4. In the event any Third Party Content contains links to Third Party Platforms, and you visit any such external link, you agree to do so at your own risk, responsibility and liability. VPS makes no warranty or representation regarding, and does not endorse, any website linked to the VPS Platforms or the information appearing thereon or any of the products or services described thereon.

  12. Intellectual Property Rights

    1. The contents of the VPS Platforms, including any material, information, data, software, icons, text, graphics, lay-outs, images, sound clips, advertisements, video clips, trade names, the word or mark "VPS", and "Voda", logos, trade-marks, designs and service marks which are displayed on or incorporated in this VPS Platforms ("Intellectual Property") are protected by law, including but not limited to copyright and trade mark law. The Intellectual Property is the property of VPS, its advertisers and/or sponsors and/or is licensed to VPS.

    2. You will not acquire any right, title or interest in or to the VPS Platforms or the Intellectual Property.

    3. Any use, distribution or reproduction of the Intellectual Property is prohibited unless expressly authorised in terms of these Platform Terms and Conditions or otherwise provided for in law.

    4. Where any of the Intellectual Property has been licensed to VPS or belongs to any third party, your rights of use will also be subject to any terms and conditions which that licensor or third party imposes from time to time and you agree to comply with such third party terms and conditions.

  13. Warranties, Acknowledgements and Confirmation

    1. You acknowledge and confirm that the VPS may request information from any person, or business, relevant to the Services in which you are interested.

    2. You warrant that the information contained herein is correct, true and complete and that you have full capacity and authority to transact with VPS.

    3. You acknowledge that you are required to provide documents to verify your identity in terms of anti-money laundering legislation.

    4. You warrant that you have complied with all applicable legislation and regulations governing your activities including anti-money laundering legislation and exchange control legislation.

    5. You acknowledge and confirm that VPS may carry out identity, fraud prevention and other illegal activities checks and share information related to this application through the Southern African Fraud Prevention Service and other organizations involved in criminal activities prevention.

    6. You acknowledge and confirm that the VPS may process and share personal information as defined in the Protection of Personal Information Act, No 4 of 2013 with third parties whose services the VPS utilizes in its ordinary course of business.

  14. Security and Risk

    1. Any act performed when using the VPS Platform will be assumed to have been performed by you.

    2. We shall not be obliged to enquire into, or to prove the authority of any person who has obtained access to your credentials (including your password, PIN or any other information used to verify your identity), or who has initiated any transaction on the VPS Platform.

    3. For your protection and security, you must enter the correct credentials to identify yourself when using the Services.

    4. For your protection, we can refuse to act on any instructions you send us or cancel your access (temporarily or permanently) if you don't meet the verification requirements. This includes entering the wrong credentials.

    5. We are entitled to act on and accept all transactions done after your credentials have been entered or applied correctly.

    6. We will assume that you have authorized all such transactions, even if such transactions took place without your knowledge or consent or were not authorized by you.

    7. You must take the necessary steps to protect your access information electronic equipment and your cellphone).

    8. You should never give or show your access information or credentials to any person.

  15. Indemnification

    1. To the full extent permitted by law, you indemnify and hold VPS harmless against all and any loss, liability, actions, suites, proceedings, costs, demands and damages which arises directly or indirectly out of a breach of the terms of these terms and conditions by you or arising out of or in connection with the failure or delay in the performance of the Services or your  use of the Services, (including direct, indirect, special or consequential damages), and whether in an action based on contract, negligence or any other action, or the use of the Services, other than in respect of losses caused by VPS's gross negligence or intentional misconduct.

    2. Without affecting the generality of 15.1 above, VPS shall not be liable to you for any breach of these terms and conditions or failure to perform any obligations as a result of technical problems relating to its network, termination of any licence to operate or use the network, act of God, government control, restrictions or prohibitions or other government act or omission, whether local or national, act of default of any supplier, agent or sub-contractor, industrial disputes or any other cause beyond VPS's control.

  16. Limitation of liability

    1. VPS cannot be held liable for any inaccurate information published on the VPS Platforms including incorrect prices, save where such liability arises from the gross negligence or willful misconduct of VPS, its employees, agents or authorised representatives.

    2. VPS shall not be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from your use of, or reliance upon, the VPS Platforms or the content contained in the VPS Platforms; or your inability to use the VPS Platforms, and/or unlawful activity on the VPS Platforms and/or any linked Third Party VPS Platforms.

    3. You hereby indemnify VPS against any loss, claim or damage which may be suffered by yourself or any third party arising in any way from your use of this VPS Platforms and/or any linked Third Party VPS Platforms.

    4. You warrant that the information you provide on the VPS Platform in order to use any of the Services is true and accurate and that VPS shall not be held liable for any loss that you may suffer as a result of you providing information that is not true or accurate.

  17. Termination and variation

    1. VPS reserves the right to amend the Platform Terms and Conditions as and when VPS deems necessary or is required to do so by law. You shall be notified by SMS when changes are effected, however where the changes are required by law or relates to the addition of a new service, extra functionality to the existing Service or any other change which neither reduces your rights nor increases your responsibilities, these shall be effective immediately and will be made without prior notice

    2. If you do not accept any change to the Platform Terms and Conditions, you may immediately remove your cards from the VPS Platforms. 

    3. You may visit the VodaPay application by regularly for material notices, updates and/or changes to the Platform Terms and Conditions.

  18. Change of your Contact Details

    1. If you do not inform us of a change of contact details, we will continue to use the contact details you provided to communicate with you.

    2.  You will need to inform VPS of any changes to your contact details as soon as reasonably possible. VPS shall not be held liable for any losses you may suffer as a result of you not providing us with updated contact details.

    VPS nominates the address set out below as the address it will receive all communications required in terms of these Platform Terms and Conditions:

  20. Communication with VPS

    1. You agree to use the Services and cooperate with VPS in evaluating the Services and provide feedback with respect to the identification of any errors, problems or defects discovery by you and identifying additional uses and functions.

    2. If you do not understand any part of these Platform Terms and Conditions or how they apply to you, or you would like to get more information on the Services, please contact us through our instant chat on the VodaPay application. You will interact with our chat bot Tobi but should you wish to contact us for any queries or complaints you will be able to request a call back and our friendly call center agent will call you back. In the event that you need to report fraud; please contact our Fraud line on 082 241 0016.

  21. Customer Complaints

  22. General

    1. These terms and conditions will be governed by and construed in accordance with the laws of South Africa, and you shall submit to the jurisdiction of the South African Courts.

    2. These terms and conditions are severable, in that if any provision is determined to be illegal or unenforceable by any court of competent jurisdiction, then such provision shall be deemed to have been deleted without affecting the remaining provisions of the terms and conditions.

    3. Our failure to exercise any particular rights or provision of these terms and conditions shall not constitute a waiver of such right or provision, unless acknowledged and agreed to by us in writing.

    4. These terms and conditions, as varied by us from time to time pursuant to clause 2.1, above constitute the sole agreement between you and VPS.

    5. When contacting our friendly call center agent, at no point should you furnish any VPS employee with the full card number or expiry date, CVV and/or bank PIN.

    6. It is your responsibility to immediately notify your bank should there be a security breach on your bank card or account for the card used on any of our online channels.

    7. In addition to the above terms and conditions, VPS's standard terms and conditions relevant to your subscriber account will also continue to apply. Also, your bank's standard terms and conditions relevant to the use of your debit or credit card will apply.

    8. You agree that the information you have provided upon registration for any of the Services is true and accurate. You agree to inform VPS immediately if the information provided becomes incorrect.

    9. The Platform Terms and Conditions constitute the sole record of the agreement between you and VPS with regard to the Services.

    10. You may not change any of the Platform Terms and Conditions.

    11. You may not cede your rights or delegate your obligations in terms of the Platform Terms and Conditions.

  23.  

    VodaPay Services Terms and Conditions

    1. The Services

      The VPS Platforms offer the Services set out in the Services Schedule below and includes but is not limited to:

      1. Bill payments which is a service provided by VPS to enable VPS customers to pay bills with third party service or product providers using the VodaPay Platforms. See the VodaPay Bill Payments terms and conditions in Annexure A below.

      2. Static and Dynamic QR Code Payments is a service provided by VPS to enable customers to pay third party service or product providers using the static and dynamic QR Code which customers can scan through their smartphone to make the payments.

      3. Buy Pre-Paid water and electricity from authorised municipalities set out on the VodaPay Platforms from time to time. See the VodaPay Prepaid Electricity and Water terms and conditions in Annexure B below.

      4. Coupon payments that were rewarded to a customer based on a rewards campaign on the VPS Platforms.

      5. Purchases of prepaid Mobile Products on the VodaPay Platforms. See the VodaPay Mobile Products (Airtime and Bundles) terms and conditions in Annexure C below.

     

    Annexure A: VodaPay Bill Payments Terms and Conditions

    1. Terms and Conditions

      These Terms and Conditions govern all payments of bills on the VodaPay Platforms. By using the VodaPay application (the "Bill Payments Page") whether as a visitor or a registered user you are bound by these terms and conditions ("Terms") as well as the VodaPay Platform Terms and Conditions as set out above (the "VodaPay Platform Terms and Conditions").

    2. The Service

      1.  Bill Payment (the "Service") is a service provided by VPS to enable VPS customers to pay bills with third party service or product providers ("Service Providers") using VPS the VodaPay Platforms.

      2.  VPS will endeavor to facilitate your bill payment within reasonable time. VPS cannot in any way guarantee a turnaround time for handling and posting payments by Service Providers. 

      3. Please contact the Service Provider for further assistance should your bill not be updated within reasonable time.

      4. Only those Service Providers registered with Easy Pay are enabled for this Service, i.e. bills that have an Easy Pay number linked to them.

      5. VPS, through the VodaPay Platforms, will present only those bill details as provided by the Service Provider and it is your responsibility to contact your Service Provider directly if you have any queries with regards to the details presented. The Service is NOT a bill presentment facility and therefore will display the amount due. This amount cannot be altered.

      6. It is your sole responsibility to confirm the bill details prior to making a payment. VPS will not be liable for any loss suffered due to incorrect information that was supplied by you, including but not limited to: the incorrect cell number, bill/account number or amount.

      7. VPS does not charge a service fee for paying your bill on this platform. However, the relevant bank fees associated with this transaction will be applicable.

      8. Where no amount is populated in the amount due field you may choose to pay any amount in Rand and Cents.

    Annexure B: VodaPay Prepaid Electricity and Water Terms and Conditions

    1. Terms and Conditions

      These Terms and Conditions govern all purchases of prepaid water and electricity on the VodaPay Platforms. By using the VodaPay application (the "Prepaid Electricity and Water Page") whether as a visitor or a registered user you are bound by these terms and conditions ("Terms") as well as the VodaPay Platform Terms and Conditions as set out above (the "VodaPay Platform Terms and Conditions").

    2. The Service

      1. VPS Prepaid Electricity and Water (the "Service") is a service that enables you to purchase prepaid electricity and water from the authorised municipalities set out on the VodaPay Platforms from time to time.

      2. Prepaid electricity and water are available to purchase through the VodaPay Platforms.

      3. VPS will present you with your prepaid electricity or water token within 5 minutes of a successful transaction. You acknowledge and accept that there may be a delay between VPS and any of the third parties involved in the successful conclusion of your prepaid electricity or water purchase.

      4. Although VPS will endeavor to complete most purchases within 5 minutes, VPS does not in any way guarantee this turnaround time.

      5. Should you not receive your prepaid electricity or water token within 5 minutes or for any queries about the service please contact us through our instant chat on the VodaPay application. You will interact with our chat bot Tobi but should you wish to contact us for any queries or complaints you will be able to request a call back and our friendly call center agent will call you back.

      6. VPS does not charge a service fee for purchasing prepaid electricity or water on the VodaPay Platforms. However, the relevant bank fees associated with this transaction will be applicable.

      7.  All transactions must be in Rand amounts, no cent amount will be processed.

      8. VPS does not determine the number of units to be allocated with prepaid electricity or water purchase, the determination lies with your municipality. The VodaPay Platforms are a channel to facilitate purchases, therefore you must contact your municipality for queries relating to unit allocation. 

      9. If you are in arrears with your municipal accounts and you use the Service, you may receive less value or no value if the amount you are purchasing for equals or is less than the arrears amount.

    Annexure C: VodaPay Mobile Products (Airtime and Bundles) Terms and Conditions

    1. Terms and Conditions

      These Terms and Conditions govern all purchases of prepaid mobile products on the VodaPay Platforms. By using the VodaPay application (the "Mobile Products Page") whether as a visitor or a registered user you are bound by these terms and conditions ("Terms") as well as the VodaPay Platform Terms and Conditions as set out above (the "VodaPay Platform Terms and Conditions").

    2. The Service

      1. This mobile product purchase service (the "Service") allows you to purchase prepaid mobile products such as Airtime/Data/SMS/Voice and Data bundles through the VodaPay Platforms across all mobile networks.

      2. The list of available mobile products is controlled by the mobile network providers and is subject to change

      3. VPS will present you with the direct top-up of your purchased mobile product type within 5 minutes of a successful transaction. You acknowledge and accept that there may be a delay between VPS and any of the third parties involved in the successful conclusion of your mobile product purchase.

      4. Although VPS will endeavor to complete your recharge within 5 minutes, VPS does not in any way guarantee this turnaround time.

      5. Should you not receive your direct top-up within 5 minutes or for any queries about the service you please contact us through our instant chat on the VodaPay application. You will interact with our chat bot Tobi but should you wish to contact us for any queries or complaints you will be able to request a call back and our friendly call center agent will call you back.

      6. VPS does not charge a service fee for purchasing mobile products on our platform. However, the relevant bank fees associated with this transaction will be applicable.

      7. All transactions must be in Rand amounts, no cent amount will be processed.

      8. VodaPay does not determine the rules related to the value, validity and use to be purchased mobile product, the determination lies with your mobile network. You must contact their Network for queries relating these rules.
