Abbreviated Terms and Conditions for Play Every Day

 

1.The promotional competition will run from 1 April 2017 to 30 June 2017.

2. The promotional competition can be played from Vodacom App (latest version), *111#, www.vodacom.co.za and Vodacom’s mobi site.

3. Apple is in no way affiliated with the Vodacom Play Every Day promotional competition. Apple is not a sponsor of this promotional competition, and prizes won through Vodacom Play Every Day will not include any Apple products.

4. The competition is open to all Prepaid, Hybrid and Post Paid customers and excludes Community Services numbers, cellphone numbers paid fully by a corporate and M2M. 

5. Minors require their guardian’s consent to participate in this promotional competition.

6. Every customer will get one free entry per day to play for various prizes. Customers accessing Play Every Day from the MyVodacom App will qualify for two free plays per day. Customers can get up to 20 More Plays per day, and will be billed R1.00 per additional play. 

7. Each entry is valid until 23:59 on the day of allocation and shall thereafter automatically expire.

8. Prizes can be won in the following categories:

a. Voice and Data Bundle rewards

b. Digital Content rewards

c. Lifestyle Discount rewards (travel, restaurant & entertainment, apparel and other retail stores)

d. Electronic and gaming rewards

e. Win a Car Draw entries and rewards

The Vodacom Play Every Day promotional competition (the Promotion) offers its customers the opportunity to participate by playing to win a variety of rewards (Rewards) including, but not limited to, the following 

• Vodacom network service rewards, e.g. data bundles, SMS bundles, minutes bundles for voice calls, bonus airtime

• Content rewards, e.g. music, games, videos, news content

• Lifestyle rewards, e.g. vouchers to be redeemed for percentage or Rand value discounts on purchases at retail or online stores, restaurants or hotels 

• Win a Car Draw entries

• Mystery Rewards, e.g. clothing, apparel, shopping vouchers, movie tickets, electronics 

• Electronics & Gaming rewards, e.g. mobile phones or accessories, gaming systems, electronic goods, appliances

• Grand Prize Draw entries

1. General Terms & Conditions of the Promotion

The Promotion commences 1 April 2017 and continues until 23:59 on 30 June 2017 (the Promotional Period).  Vodacom reserves the right to change or extend the Promotional Period on reasonable prior notice.

A customer can access “Play Every Day” through multiple channels, i.e. the My Vodacom app, www.vodacom.co.za web or mobi-site, USSD on *111#, Vlive! channel or in-store at Vodacom’s authorised contract retail outlets.

Customers will be required to accept these Terms & Conditions before participating in the Promotion.   This applies to any and all channels that the customer may select to participate in the Promotion. 

By accepting these Terms and Conditions, the customer hereby consents to Vodacom using his/her personal information in order to market its products to him/her once the promotion has ended subject to his/her right to opt out of such marketing messages and further subject to his/her right to restrict receipt of unwanted marketing material as contained in the Consumer Protection Act of 2008.

This Promotion is available only to active Vodacom customers.

Apple is in no way affiliated with the Vodacom Play Every Day promotional competition. Apple is not a sponsor of this promotional competition, and prizes won through Vodacom Play Every Day will not include any Apple products.

All prepaid, contract, Top Up and uChoose Vodacom Consumer customers, including those who activate a new SIM card on or port in to the Vodacom network during the Promotional Period, will qualify to participate in the Promotion.  Vodacom Corporate customers with Employee Liable accounts (employee pays for additional usage on the account) are also eligible to participate in the Promotion.

The following customers are excluded from participating in the Promotion

• All Vodacom Corporate customers with Corporate Liable accounts (company pays 100% of the account)

• All Machine to Machine customers

• Community services SIMs / phone numbers

Bulk SMS applications are not permitted to participate in the Promotion. Vodacom reserves the right to disconnect and suspend the service of non-customer SIMs and non-compliant devices as specified by the regulating body ICASA that are being used on the Vodacom network for the purposes of the Promotion.  A non-customer SIM is an application that uses a SIM card to send SMSs in volumes not possible by a natural person.

Vodacom reserves the right to change these terms and conditions and will provide participating customers with reasonable notice of such change prior to implementing such changes where such change is required under the Consumer Protection Act.

2. Terms & Conditions of the Promotion

Eligible Vodacom customers may participate in the Promotion using one or more of the following channels: 

• My Vodacom app

• www.vodacom.co.za web and mobi-sites

• Vlive! 

• My Vodacom USSD menu

Participating customers will be eligible for one (1) free Play Every Day entry each day for the duration of the Promotion.  There will be no charge to the customer for this entry. Customers accessing Play Every Day from the MyVodacom App will qualify for two free plays per day.   Customers can get up to 20 More Plays per day, and will be billed R1.00 per additional Play.

The free daily entry as well as any additional entries will expire at 23:59 on the day of allocation.

Prepaid, Top Up and uChoose customers will have the cost of each addition Play deducted from their Vodacom airtime account. 

Each Prepaid, Top Up and uChoose customer may enter the Promotion a maximum of twenty (20) times per day, in addition to the free daily entry, provided the customer has sufficient available credit in their Vodacom airtime account.

Contract customers will have the cost of each additional Play added to their monthly bill. Each contract customer may enter the Promotion a maximum of twenty (20) times per day in addition to the free daily entry.

Vodacom reserves the right to change this daily limit. 

Entries may not be transferred to another customer.

There will be no refunds for unused entries.

Vodacom is not liable for any direct or indirect costs owing due to participation in this Promotion.

Customers participating in the Promotion will be eligible to win Rewards from various categories, as set out in the Overview above and section 3 below.

Terms and conditions specific to these Rewards are detailed per category in section 3 below.

3. Terms & Conditions: Promotion Rewards

Rewards will be allocated on a random basis to customers,

Not every entry will win a reward.    In this case, a customer will receive a notification that the entry has not been successful.

Rewards may not be transferred to other customers or exchanged for cash.

Rewards are categorised as follows:

• Vodacom network services rewards

• Content rewards

• Lifestyle rewards

• Win a Car Draw entry rewards

• Mystery rewards

• Electronics & Gaming rewards

• Grand Prize Draw entry rewards

Allocation, delivery or collection may differ for Rewards in each category. These are detailed in the relevant Reward Category section below.

Each Reward is subject to a validity period, which is specified in the sections below and in each Reward notification.

All Rewards for vouchers or items redeemed through a merchant, retail outlet or online store, will be subject to specific terms and conditions as detailed below.   These must be read in conjunction with the relevant merchant’s full terms and conditions, as per the Vodacom/merchant T&Cs.

In the case of a conflict between the Promotion Reward terms and conditions and the merchant’s standard terms and conditions, the Promotion Reward terms and conditions will take precedence.

Voice and Data Bundle Rewards

Voice minutes bundles, SMS bundles and Data bundles Rewards will be allocated immediately to a Prepaid, Top Up or uChoose customer who has won one of these Rewards.

Contract customers will be allocated these Reward bundles within 6 (six) hours of winning the Reward. 

Bundles will be available to use on the day of allocation, within any specified usage period, and will expire as per the stated validity period (e.g. DDMMYYYY HH:mm).   

Unused Reward bundles will expire and there will be no carry over or refund.

Reward bundles cannot be transferred to other customers.

Any usage that falls outside the specified usage period or after the bundle is depleted will be billed at the customer’s applicable price plan rates.

Vodacom voice minute bundles will specify usage, whether for Vodacom to Vodacom (VC-VC) calls or calls to any SA Network (Any Network).

Vodacom to Vodacom (VC-VC) Reward bundles can only be used to call other customers on the Vodacom network, subject to the exclusions listed below, and will be consumed on a per minute basis, irrespective of the customer’s applicable price plan.

Any Network Reward bundles can be used to call a customer on any South African mobile network, including Vodacom, MTN, Cell C, Telkom Mobile, Virgin Mobile, Trace Mobile, FNB Connect (and any other unspecified MVNOs in South Africa), and will be consumed on a per minute basis, irrespective of the customer’s applicable price plan.

All calls initiated within the specified usage period but terminated outside of the period will deplete from the Reward voice bundle until the last minute of the Reward bundle validity period and the remainder of the call will be billed according to the customer’s existing price plan rate.

The following call types are excluded from the Vodacom voice minute bundles: 

Conference & video calls to other networks; Call Sponsor: International & roaming calls, Premium rated calls; Value Added Service (VAS) Calls; Call Forwarding; Directory Enquiry; Reconnect Calls Reverse Charge calls General Through Connect (to other networks)Service calls; Message forwarding. 

Vodacom SMS Reward bundles can be used for sending SMS to national destinations including “SMS to email” but cannot be sent to international or premium rated numbers or services. One (1) SMS is equivalent to 160 characters, including spaces.

Data sessions initiated within the specified usage period but terminated outside of the period will deplete from the Data Reward bundle until the last minute of the stated bundle validity period and the remainder of the session will be billed from an existing active data bundle or at the specified out-of-bundle rate applicable to the customer’s price plan.

Prepaid, Top Up or uChoose customers converting to contract price plans or vice versa will not be able to retain their allocated voice minutes, Data or SMS Reward bundles once the conversion is successfully completed.

Prepaid customers converting to uChoose or vice versa will retain their allocated voice minutes, Data or SMS rewards bundles after the conversion is successfully completed. 

Digital Content Rewards

Rewards are available in this category:

• Videos

• Music

• Games

• Content 

These Rewards will be allocated immediately on winning the Reward.

The customer will receive a message providing a link to access the Reward.   This message will include information regarding the usage validity period and/or expiry period of the Reward.

If a customer wins a music Reward, the customer will be able to choose one (1) track from a range of music tracks available for the Promotion.   

Customers will not be charged for data used for the download of the music Reward.

Music Reward downloads are only available while the customer is on the Vodacom network within South Africa.

The music track will not be available for download after the expiry date.

Unused Rewards in this category will not carry over or be available for download, access or use after the Reward expiry date.

Lifestyle Discount Rewards

The following Rewards are available in this category:

• Shopping vouchers for discounts (percentage or Rand value) when purchasing at specified retail stores

• Shopping vouchers for discounts (percentage or Rand value) when purchasing at specified online retailers

• Vouchers for discounts when purchasing at specified restaurants

• Vouchers for discounts on stays at selected hotels

On winning a Reward in this category, the customer will receive a message indicating which Reward they have won.   This message will include information regarding the Reward, its usage validity period and/or expiry period.

Reward vouchers may not be exchanged for cash.

Vouchers may not be transferred.

No refunds or change will be issued for Reward vouchers.

Voucher validity varies per reward and must be redeemed at the respective merchant on or before the dates specified; thereafter the voucher will expire and become invalid or unredeemable. 

Any dispute relating to voucher redemption shall be resolved between the customer and the relevant merchant.  Vodacom assumes no liability in this regard and by acceptance of these terms and conditions the participant indemnifies Vodacom against any claim of whatsoever nature arising out of the redemption of any Reward voucher issued in terms of the Promotion.

Lifestyle Discount Rewards may be subject to merchant specific terms and conditions, as below: 

Edcon Group: Lifestyle Rewards

In the case of the customer being rewarded with an “Edgars” discount voucher, the voucher code may be used by the customer to purchase any regular priced merchandise from any participating Edgars stores in South Africa.

In the case of the customer being rewarded with an “Edgars Active” discount voucher, the voucher code may be used by the customer to purchase any regular priced merchandise from any participating Edgars Active stores in South Africa.

In the case of the customer being rewarded with a “Jet” discount voucher, the voucher code may be used by the customer to purchase any regular priced merchandise from any participating Jet and JetMart stores in South Africa.

In the case of the customer being rewarded with a “Red Square” discount voucher, the voucher code may be used by the customer to purchase any regular priced merchandise from any participating Red Square stores in South Africa.

In the case of the customer being rewarded with a “CNA” discount voucher, the voucher code may be used by the customer to purchase any regular priced merchandise from any participating CNA stores in South Africa.

In the case of the customer being rewarded with a “Boardmans” discount voucher, the voucher code may be used by the customer to purchase any regular priced merchandise from any participating Boardmans stores in South Africa.

The customer must present the Reward voucher in-store in order to qualify to redeem the voucher.

The discount voucher code may not be transferred by any means to anyone else.

The discount voucher cannot be used in conjunction with any other offer, including in-store discount promotions.

The discount voucher cannot be 

(1) used to pay an Edcon account; 

(2) exchanged for cash; 

(3) used to purchase cellular products (handsets and airtime); Laptops, Printers, Digital Devices or Gaming Consoles.

(4) used to purchase gift cards; or 

(5) used to purchase 3rd party items such as electricity, DSTV subscriptions, event tickets or other similar items.

The Reward voucher is valid until 30 July 2017 and may only be used once.

Unused Reward vouchers will not be redeemable after the expiry date.

Should the Reward voucher code be deleted or the customer’s cellphone lost/stolen, neither Edcon nor Vodacom will be liable for any reimbursement of any nature.

SA Florist: Lifestyle rewards 

Vouchers are subject to a minimum spend of R500.

Products are available in South Africa Only. 

All prices listed are in South African Rands and include VAT.

SA Florist endeavours to meet the demand, but offer subject to availability of stock.

Reward voucher codes for Flook goods are only redeemable at the merchant’s online store. The customer can access the Flook online store through the link in the Reward notification message or via www.flook.co.za.  

In order to receive the stated discount, the customer must select the product specified in the Reward voucher; enter the Reward voucher code when prompted and follow the steps to checkout and registration for delivery.    The discount will only be applied after successful completion of registration for delivery.

The customer will not be charged for delivery of the goods.

Flook will not deliver to a post office box.

Reward vouchers may not be exchanged for cash.

The Reward voucher code can only be used once and will expire on 09 June 2017.

In the event of a stock out situation or if a size is not available Flook will undertake to find an alternative or to re-order the specific item.  

Flook are reliant on suppliers’ stock and inventory but every effort will be taken to find a replacement in the quickest time possible.

Should no replacement be available Flook will provide the customer with a coupon to redeem on any items in the Flook online store to the same value of the Reward voucher.

Where the code is used for physical products, Flook’s standard terms and conditions apply.

Incredible Connection (Lifestyle rewards)

The Reward voucher discounts for Incredible Connection goods are only redeemable at the merchant’s online store. The customer can access the Incredible Connection online store through the link in the Reward notification message or via www.incredible.co.za.

In order to receive the stated discount, the customer must select the product specified in the Reward voucher; enter the Reward voucher code when prompted and follow the steps to checkout. The discount will only be applied after successful completion of this process.

The customer will not be charged for delivery of the goods.

Incredible Connection will not deliver to a post office box.

Reward vouchers may not be exchanged for cash.

The Reward voucher code can only be used once and will expire on 07 June 2017.

In the event of a stock out situation or if a product is not available Incredible Connection will undertake to find an alternative or to re-order the specific item.  

Should no replacement be available Incredible Connection will provide the customer with a coupon to redeem on any items on the Incredible Connection online store to the same value of the Reward voucher.

Reward vouchers may not be used on any other already discounted items or special offers in the online store.

Only one code/deal may be used per purchase.

Mystery Prize Rewards

On winning a reward in this category, the customer will receive a message indicating which Reward they have won.   This message will include information regarding the Reward, its usage validity period and/or expiry period.

No refunds or change will be issued for Reward vouchers.

Vouchers may not be transferred or used for payment of retail accounts.

Voucher validity varies per reward and must be redeemed at the respective merchant on or before the dates specified; thereafter the voucher will expire and become invalid or unredeemable. 

Flook Sporting Deals (Pty) Ltd (Mystery Prizes)

Reward voucher codes for Flook goods are only redeemable at the merchant’s online store. The customer can access the Flook online store through the link in the Reward notification message or via www.flook.co.za.  

In order to receive the stated discount, the customer must select the product specified in the Reward voucher; enter the Reward voucher code when prompted and follow the steps to checkout and registration for delivery.    The voucher will only be applied after successful completion of registration for delivery.

Ster Kinekor (Mystery Prizes)

The Reward voucher is Double 3D movie tickets in the form of an e-voucher, excluding 3D glasses.

The e-voucher is redeemable at any Ster-Kinekor Theatre in South Africa except Cine Prestige, IMAX and 2D movies. 

E-vouchers are redeemable at the ticket counter or self-service terminals at Ster-Kinekor Theatres only.

The Reward voucher code can only be used once and will expire on 30 June 2017.

Lost or stolen e-vouchers will not be replaced.

The e-voucher cannot be used in conjunction with any other special, promotion and/or discount and/or club offerings.

No refunds will be made on e-vouchers.

On winning a Reward in this category, the customer will receive a message indicating which Reward they have won.   This message will include information regarding the Reward and the process for confirming the Reward and the handover of the Reward.

Rewards may not be transferred or exchanged for another product or for cash. 

Vodacom will use reasonable efforts to contact the winners on the cellphone number that was used to participate in the Promotion.   Vodacom will attempt to contact the winners at least three (3) times after the Reward has been awarded.  Should the participant not be available on the contact number provided during this time period, or rejects or declines acceptance of the Reward, that person’s right to the Reward will be deemed to have been waived and the Reward will be forfeited. 

Vodacom reserves the right to award any forfeited Rewards to another participant in the Promotion.

Once the winners have been contacted successfully and their entries validated, their Reward will be dispatched by Vodacom or the third party merchant supplying the prize.   

The Reward will be delivered to the winner, by an appointed courier company, at the address specified by the winner.

It is the responsibility of the winner to ensure that there is someone at the agreed address authorised to accept delivery of the Reward. There will be no delivery charges payable by the winner.

It is the sole responsibility of the winner to procure a television license, if required. 

All items carry a 1 year warranty with the exception of the HiSense 40” TV, which carries a 3 year warranty and the Samsung TV, which carries a 2 year manufacturer warranty. 

Support information will be included in product packaging.

Save in the event of its negligence, neither Vodacom, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any Reward.  Full terms and conditions for Hardware and Devices are available in Vodacom/specific merchant.

Grand Prize Draw

The following Rewards are available in this category:

• International holiday packages, including flights, accommodation and meals (where specified), through Flook Sporting Deals.

• Local getaways include accommodation only and exclude travel (flights, transfers or car rentals)

The monthly draw will take place monthly on the first Tuesday of the following month.  

1 May (00:00) to 31 May (23:59) – Only entries received during this period will be entered into the draw on the 6th of June 2017.

1 June (00:00) to 30 June (23:59) – Only entries received during this period will be entered into the draw on the 4th of July 2017. 

On winning a Reward in this category, the customer will receive a message indicating which Reward they have won.   This message will include information regarding the Reward and will confirm that the customer will be contacted within a specified period to confirm the Reward.

Vodacom will use reasonable efforts to contact the winners on the cellphone number that was used to participate in the Promotion. Vodacom will attempt to contact the winners at least three (3) times after the Reward has been awarded.  Should the participant not be available on the contact number provided during this time period, or rejects or declines acceptance of the Reward, that person’s right to the Reward will be deemed to have been waived and the Reward will be forfeited.

Once the winners have been contacted successfully and their entries validated, their Reward will be confirmed by way of a Reward letter issued by the third party merchant supplying the prize.  This Reward letter will be sent to the winner by Vodacom, via e-mail or fax, if email is not available. 

Reward vouchers in this category may not be transferred or exchanged for an alternative travel package, goods or cash.

It is the responsibility of the traveller to ensure that they are in possession of valid travel documents as required.

All Reward travel packages are subject to the terms and conditions outlined by the supplier for the specific travel package or deal.  

Holiday packages do not include spending money, any additional expenses will be for the winner’s account.

Reward voucher codes for Flook travel packages are only redeemable at the merchant’s online store. The customer can access the Flook online store through the link in the Reward notification message or via www.flook.co.za.  

In order to book for the stated package, the customer must select the product specified in the Reward voucher; enter the Reward voucher code when prompted and follow the steps to checkout and registration for delivery.    The voucher will only be applied after successful completion of registration for delivery.

Reward vouchers may not be exchanged for cash.

The Reward voucher code can only be used once and will expire on 31 October 2017.

Win A Car Draw 

Vodacom (Pty) Ltd (“Vodacom”) is running the Win a car competition on the Renault Clio Authentique 900 TCe (“the Competition”) where participants of Play Every Day are entered into a monthly draw to stand a chance to win one (1) car per month. 

All participants during the term of the Competition agree to be bound by the following Terms and Conditions:

1. The Competition runs from 00h00 midnight on 1 May 2017 (“start date”) and ends at 23:00 midnight on 30 June 2017 (“end date”). Any entries received after the closing date will not be considered for the competition.

2. One (1) lucky entrant stands a chance of winning a car for the period 1 May to 31 May and 1 June to 30 June 2017, via Play Every Day.  

3. The monthly draw will take place on the first Tuesday of the following month.  

o 1 May (00:00) to 31 May (23:59) – Only entries received during this period will be entered into the draw on the 6th of June 2017.

o 1 June (00:00) to 30 June (23:59) – Only entries received during this period will be entered into the draw on the 4th of July 2017. 

4. Vodacom shall solely determine the specifications and colour of the vehicles to be won and the Vodacom’s decision is final.  

5. Vodacom shall not be liable for any manufacturing faults, recalls, damage or loss of or to any vehicle once handed over to a winner.

6. The cost and arrangement of licensing, registration and insurance of any prize is excluded. Winners must contact the Renault dealer that does the handover to arrange for the legal transfer of any prize and must arrange for third party insurance against damage or loss from the moment possession is taken of the prize.

7. Vodacom or Renault will not cover Insurance or petrol for the vehicle. 

8. The vehicle will be covered by the standard 5 year/150 000km warranty and 3 year/45000km service plan. 

9. The winners will be randomly selected by means of an electronic random draw selection from all eligible entries which meet the requirements set out in these Terms and Conditions. 

10. Only entries received during the Competition period as stipulated in clause 1 above will qualify as potential winners

11. The Competition is only open to natural persons 18 years or older. Entries received from business accounts held by legal persons (amongst others Corporates and SMEs, etc.) are excluded from participating and winning in the Competition. 

12. Participants are not required to have a valid driver’s license to win a prize, but a prize may only be collected by a representative of a winner who is in possession of a valid driver’s license at the time of collection of such prize.

13. Entrants are allowed to enter as many times as they like, but are only eligible to win once for the duration of the Competition.

14. Participants must be in possession of a valid SA identity document or valid permanent residence permit valid for a period exceeding 12 (twelve) months for the Republic of South Africa and valid at the end date of the Competition.

15. The selected winners must be able to identify themselves (in a manner determined by Vodacom) as the qualifying entrants to the Competition and have to comply with the required validation procedure in order to claim the prizes.

16. The selected winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Vodacom being in arrears to be eligible to win the prizes.

17. There are no additional charges for participating in the Competition.  

18. All risks and ownership of the prize shall pass to the winner on transfer/delivery thereof and hence all of Vodacom’s obligations in regard to the Competition as well as in regard to the prize shall terminate. Vodacom will advise of arrangements in respect of the prize distribution at the time of contacting the selected winner.

19. Notwithstanding the fact the prize vests on the winner immediately upon the determination of the results, any prize that remains unclaimed/ undeliverable after a month of transfer or no reasonable effort is made on the part of the winners to claim the prize despite having been advised of the results of the Competition will be forfeited. 

20. The winner will be contacted during working hours (08h00 to 17h00) by phone on or after the draw date, using the cell phone number associated with his/ her entry into the Competition.

21. Vodacom (Pty) Ltd will use reasonable efforts to contact the winner telephonically on the contact details used to participate in the Competition. Vodacom (Pty) Ltd shall attempt to contact the winner for a period of 2 (two) working days after his/ her name has been drawn and verified as a winner.

22. Should a participant not be available on the contact number during the timeframe stipulated or reject, forfeit or decline acceptance of the prize, that person's right to the prize will be deemed to have been waived and the prize will be forfeited. Vodacom reserves the right to then award the prize to the next selected entrant.

23. The claim for the prize will be subject to security and validation, failing which the winner will forfeit the prize and the prize will be awarded to the next selected qualifying entrant.

24. If a winner cannot accept the prize for any reason whatsoever, the prize will be awarded to the next selected qualifying entrant.

25. Vodacom reserves the right to withhold any prize until it is satisfied that the claim by the winner is valid.

26. In the event that the user of the mobile phone (i.e. the participant in the Competition) is not the person that is responsible for payment of the qualifying contract/ existing qualifying contract, then the prize will be awarded to the person that is the account holder and responsible for payment of the qualifying contract/ existing qualifying contract.

27. Vodacom shall request the winner’s consent in writing to their image and/or likeness being used and published by Vodacom in connection with the Competition for a period of 12 (twelve) months after they have been announced as  winners. The winner may decline the use of his/her image and/or likeness by Vodacom.

28. The winner’s names and location may be displayed on www.vodacom.co.za/vodacom/competition-winners as well as Vodacom Social Media Assets as well as on screens/in store TV within Vodacom Approved sales channels.

29. The prize is not transferable or exchangeable.

30. The judges’ decision on any aspect of the Competition including the allocation of the prize will be final and binding and no correspondence will be entered into

31. In the event of a dispute in regard to any aspect of the Competition and/or the Terms and Conditions, Vodacom’s decision will be final and binding and no correspondence will be entered into.

32. User data collected via the Competition will not be used for any other purpose than for the Competition only. 

33. User data collected via the entry for this Competition will be stored for as long as it is legally required to and in accordance with Vodacom’s Privacy Policy, http://www.vodacom.co.za/vodacom/terms/privacy-policy  If there is no legal requirement, the collected information will only be stored for as long as it is needed.

34. Employees, directors and agents of Vodacom and all participating stores, their immediate families, life partners, business partners and associates and any person directly involved with the sponsoring, devising, production, management or marketing of this Competition are not eligible to participate in this Competition.

35. The duration of the Competition may be extended or curtailed at the discretion of Vodacom.

36. Vodacom is not liable for any technical failures affecting participation and / or prize redemption process of the Competition.

37. Vodacom shall not be liable for taxes or any costs incurred by the winners for entering the Competition or in claiming the prize. 

38. Neither Vodacom nor any other person or party associated with the Competition, their associated companies, agents, contractors and sponsors and any of its personnel involved in the Competition, shall be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the Competition or from claiming the prize or after claiming the prize.

39. In addition, neither Vodacom nor its agents shall be responsible for any loss or misdirected entries, including entries that were not received due to any failure of hardware, software, or other computer or technical systems affecting participating and/or prize redemption process of the Competition.

40. If Vodacom is required by law to alter or cancel any aspect of the Competition or to terminate it as a result of changes in legislation, or for any reason whatsoever, it will have the right to terminate the Competition being offered, with immediate effect and without notice. In such event all entrants hereby waive any rights which they may have against Vodacom and its associated companies, agents, contractors and/or sponsors.

41. Vodacom may refuse to award the prize if these Terms and Conditions have not been adhered to or if it detects any irregularities or fraudulent practices. Vodacom is entitled in its entire discretion to reject any participant for any reason and will not be obliged to notify that they are rejected. 

42. All information relating to the Competition which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.

43. Vodacom Reserves its rights pertaining to any winners who may default on account – standard terms & conditions for remedy per Vodacom contract & upgrade application documentation.
